1. Lease Term and Early Termination
Tenant shall enter into a 12-month lease. Early termination is allowed; however, Tenant remains responsible for rent until the unit is re-rented, subject to Landlord's duty to mitigate damages as required by law.
2. Rent Payment, Late Fees, and Returned Payments
Rent is due on the 1st day of each month. Rent shall be paid by electronic transfer, cashier's check, money order, or another method approved in writing by Landlord. Rent received after the 5th day of the month is subject to a $45 late fee, subject to California law. Returned checks or failed electronic payments may result in a $50 returned payment charge and may require Tenant to pay by certified funds going forward.
3. Security Deposit
Tenant shall pay a security deposit equal to one month's rent before move-in. The security deposit may be used only as permitted by California law, including unpaid rent, cleaning, repair of damages beyond ordinary wear and tear, restoration, replacement of Landlord property, and other lawful deductions. The security deposit shall not be used as last month's rent without Landlord's prior written consent.
4. No Subleasing or Short-Term Rental Use
Tenant may not sublease, assign the lease, rent rooms, operate an Airbnb or other short-term rental, or transfer possession of the unit to another person without Landlord's prior written consent.
5. Assistance Animals
Qualified service animals and other assistance animals required as a reasonable accommodation under applicable law are permitted as required by law. Documentation may be requested only as permitted by law.
6. Renter's Insurance
Tenant shall maintain renter's insurance with personal liability coverage of at least $200,000 and provide proof of coverage upon request.
7. Utilities
Tenant shall pay for all utilities and services associated with the unit, including electricity, gas, internet, cable, pest service, and any other applicable services unless otherwise agreed in writing. Tenant must place utilities in Tenant's name before move-in or within 5 days of possession.
8. Cleanliness, Sanitation, and General Care
Tenant must keep the unit clean, sanitary, ventilated, and free from damage, mold-causing behavior, pests, trash buildup, and misuse.
9. Maintenance Reporting and Plumbing Rules
Tenant must promptly report leaks, water intrusion, electrical issues, appliance problems, pest activity, mold, broken windows, plumbing stoppages, or unsafe conditions. Tenant may not place grease, wipes, feminine products, paper towels, diapers, food waste, or foreign objects in toilets, sinks, or drains. Tenant is financially responsible for plumbing stoppages or damage caused by misuse.
10. Moisture, Mold, and Ventilation
Tenant must use fans, open windows when appropriate, promptly report leaks or water intrusion, avoid excessive humidity, and not block ventilation, heating, or air circulation.
11. Appliances
The following appliances are included with the rental: stove, dishwasher, microwave, oven, fridge/freezer, and washer/dryer. Appliances are landlord-provided but Tenant must use them properly, maintain them in clean condition, promptly report issues, and avoid misuse. Any appliance provided "as-is" should be specifically identified in writing.
12. Alterations and Modifications
Tenant may not paint, install wallpaper, add shelving, mount televisions, change fixtures, install cameras, install satellite dishes, alter flooring, modify walls, or make any other changes to the unit without Landlord's prior written consent.
13. Locks, Keys, and Smart Locks
Tenant may not change locks, duplicate restricted keys, rekey doors, add locks, or install smart locks without Landlord's prior written consent.
14. Illegal Activity, Nuisance, and Safety
Tenant may not engage in illegal activity, nuisance behavior, threats, violence, drug activity, hazardous material storage, or any activity that disturbs neighbors or creates a safety risk.
15. No Smoking or Vaping
No smoking or vaping of any substance is allowed inside the unit or on patios. Tenant must follow additional guidelines set by HOA.
