LEASE TERM
The lease term shall be a minimum of twelve (12) months unless otherwise agreed in writing by Landlord.
RENT
Rent shall be due on the first (1st) day of each month. Any rent not received by the due date may be subject to late fees as permitted by Arizona law.
SECURITY DEPOSIT
Tenant shall provide a security deposit prior to occupancy. The security deposit may be used to cover unpaid rent, damages beyond normal wear and tear, excessive cleaning, unauthorized alterations, lost keys, and any other charges permitted by law.
UTILITIES
Tenant shall be responsible for payment of all utilities and services associated with the property, including electricity, gas, water, sewer, trash, and any other utility services unless otherwise agreed in writing.
OCCUPANCY
Only tenants listed on the lease agreement may reside at the property. No additional occupants may reside at the property without prior written approval from Landlord.
GUESTS
Guests may not remain on the property for more than fourteen (14) consecutive days or more than thirty (30) days in any twelve-month period without written approval from Landlord.
NO SMOKING POLICY
The property is strictly non-smoking. Smoking, vaping, marijuana use, e-cigarettes, cigars, pipes, hookahs, or any similar products are prohibited inside the residence, garage, patio, yard, and within twenty-five (25) feet of any door or window.
Tenant shall be responsible for all cleaning, deodorizing, repainting, HVAC cleaning, flooring replacement, and any other costs required to remove smoke-related odors or damage.
NO ILLEGAL DRUGS
The use, manufacture, distribution, cultivation, or storage of illegal drugs on the property is strictly prohibited and shall constitute a material breach of the lease.
NO SUBLEASING OR SHORT-TERM RENTALS
Tenant shall not assign, sublease, rent, or advertise the property on Airbnb, VRBO, Furnished Finder, or any similar platform without written consent from Landlord.
MAINTENANCE
Tenant shall maintain the property in a clean, safe, and sanitary condition. Tenant shall promptly notify Landlord of any maintenance issues, leaks, plumbing problems, electrical concerns, or damage.
PLUMBING
Tenant shall be responsible for the cost of clearing plumbing stoppages caused by misuse, including grease, wipes, feminine hygiene products, paper towels, toys, food waste, or foreign objects.
AIR CONDITIONING AND FILTERS
Tenant shall replace HVAC filters regularly and operate heating and cooling systems in a reasonable manner to prevent damage.
ALTERATIONS
Tenant shall not paint, install fixtures, mount televisions, replace locks, install satellite dishes, or make any alterations to the property without prior written approval from Landlord.
PETS
No pets shall be permitted without prior written approval from Landlord. Any approved pets shall be subject to additional fees, deposits, or conditions determined by Landlord.
RENTER'S INSURANCE
Tenant shall maintain renter's insurance throughout the lease term and provide proof of coverage upon request. Landlord shall not be responsible for Tenant's personal property.
PROPERTY CONDITION
Tenant acknowledges receipt of the property in good condition and agrees to return the property in substantially the same condition, excluding normal wear and tear.
LANDLORD ACCESS
Landlord may enter the property with proper notice as required by Arizona law for inspections, repairs, maintenance, emergencies, or to show the property to prospective tenants or purchasers.
EARLY TERMINATION
If Tenant requests early termination of the lease, Tenant shall remain responsible for rent and costs incurred by Landlord until a replacement tenant is secured, subject to Arizona law. Any approved early termination may require an early termination fee equal to two (2) months' rent.
ABANDONED PROPERTY
Any personal property left behind after move-out shall be handled in accordance with Arizona law and may be disposed of after applicable notice requirements are met.
ATTORNEY FEES AND COLLECTION COSTS
Tenant shall be responsible for reasonable attorney fees, court costs, collection costs, and expenses incurred by Landlord in enforcing the lease, as permitted by Arizona law.
DEFAULT
Failure to pay rent, unauthorized occupants, unauthorized pets, smoking violations, property damage, illegal activity, or any other material lease violation shall constitute default under this lease and may result in termination as permitted by Arizona law.
