The premises include the dwelling, appliances, furnishings, material items listed in the move-in inventory, and the yard/parking areas
below. Furnishings and material items remain with the property and are not offered for sale. Before move-in, the parties may agree
in writing to remove specified bedroom furnishings.
1. Use and occupancy. The premises are for residential use by listed occupants only. No additional person may establish residence without
prior written approval, subject to applicable law and reasonable-accommodation duties.
2. Rent and payment. Rent is due in advance on the 1st day of each month, without demand, using the method stated above. For a
mid-month start, prorated rent is monthly rent divided by 30 times the remaining days, unless the parties write another calculation here:
__________________. A late fee applies only if separately agreed in writing and lawful.
3. Security deposit. The total refundable deposit is $3,000, including the $500 pet allocation. It may be used only as allowed by California
Civil Code section 1950.5, including unpaid rent, necessary cleaning to the move-in level, tenant-caused damage beyond ordinary wear, and
authorized restoration of landlord property. Landlord will return or account for it within the time required by law.
4. Utilities. Utilities listed as included on page 1 are included in rent. Tenant will promptly report service interruptions, leaks, or unusual
usage. No surcharge or allocation applies unless the parties sign a lawful written agreement stating the bill, method, and tenant share.
5. Care and maintenance. Tenant will keep the premises reasonably clean and sanitary, promptly report repairs, pests, water intrusion, or
unsafe conditions, and pay for damage caused by Tenant or guests beyond ordinary wear. Landlord remains responsible for habitability and
legally required repairs.
6. Guests. Guests are permitted at reasonable times and must follow this agreement. No guest may occupy the premises as a resident
without written approval. Tenant is responsible for guest conduct and must not create a nuisance or disturb neighbors.
7. Quiet enjoyment. Tenant will not create a nuisance, threaten others, engage in unlawful activity, block access, or interfere with neighbors'
peaceful use. Quiet hours are 10 p.m. to 7 a.m. Sunday through Thursday and 11 p.m. to 8 a.m. Friday and Saturday, subject to local law.
8. Entry and privacy. Landlord may enter the rented portions only for a purpose permitted by California Civil Code section 1954 and with
required notice, except an emergency or another statutory exception. Twenty-four hours' written notice is presumed reasonable in most
nonemergency situations. The excluded owner's office is governed by the attached addendum.
9. Locks and keys. Tenant may not add or change locks without written consent and must return keys, remotes, and access devices at
move-out. Nothing permits unlawful entry or waives nonwaivable rights.
10. Pets and assistance animals. Only animal(s) approved in the attached Pet Addendum may be kept at the premises. Service and
assistance animals are not pets and are handled under fair-housing law. No pet deposit is charged for an assistance animal where prohibited
by law.
11. Smoking and safety. Smoking or vaping is prohibited inside the home and garage. Tenant may not disable alarms, overload circuits,
use unsafe heaters, burn candles/incense unattended, or charge damaged lithium batteries. Exits must remain clear.
12. Parking and vehicles. Tenant may use only the parking space(s) listed on page 1. No inoperable, leaking, unregistered, or commercial
vehicle may be stored without written consent. Vehicle repair beyond emergency work is prohibited.
13. Assignment and subletting. Tenant may not assign this agreement, sublet any part of the premises, lend access credentials, or offer
the premises on a lodging platform without Landlord's prior written consent.
14. Termination. For month-to-month tenancy, either party must give the written notice required by law. A fixed term ends as stated unless
extended or converted by law. Just-cause, relocation, rent-cap, and other protections apply when legally required. No self-help eviction,
lockout, utility shutoff, or seizure is permitted.
15. Required disclosures. Landlord will provide disclosures required by the property or tenancy, which may include known flood hazard,
bed bug notice, lead-based paint for pre-1978 housing, pesticide service, death within three years, shared-meter details, and notices
required by the Tenant Protection Act or local law. This agreement makes no exemption election.
16. Entire agreement. This agreement and signed addenda, disclosures, and inventory are the complete agreement. Amendments must be
written and signed except lawful changes by notice. Unenforceable terms are limited as required by law; nonwaivable rights remain in effect.
