Permitted uses for this district can be found in Article XI, subsection A. Please note #1, which states that residential uses are ONLY permitted if they are accessory to a commercial use (one of the uses listed in no’s 2 through 7). So in order for any residential use to be placed there, it would require a use variance from the zoning hearing board. Property is located in the special flood hazard area (floodplain), zone AE. Only certain uses are permitted within the special flood hazard area. A floodplain variance would likely be required before ANY structure is constructed here. This variance would be heard by Borough Council. Floodplain – this property is located within the special flood hazard area (floodplain) As stated above, this would require a variance from Borough Council before any type of structure could be placed here. Assuming a variance is granted…then the following: Any residential structure would certainly need to be elevated 1.5 feet above the Base Flood elevation. This would require an elevation certificate from a licensed surveyor. Any non-residential structure would need to be dry-floodproofed to 1.5 feet above the base flood elevation. Again, this would require an elevation certificate from a licensed surveyor. Also the “floodproofing” design would need to be sealed by a licensed engineer.
