UTILITIES: Tenants will pay for all utilities from the time the property is occupied, which include Gas, Water, Trash, Electricity, and cable/internet. Tenant will be responsible for any damages to the property resulting from utility company disconnects due to failure of tenant to pay the utility bill on time. Tenants will pay for telephone and any Cable TV connections and charges. No exterior antennae or other modifications to the structure may be made to the property without written permission from the Owner/Manager including but not limited to Cable or Satellite TV connection. 2. PERSONAL PROPERTY: Prior Holdings LLC shall not be responsible for any damage or loss to tenant's personal property, or for any injuries tenant or tenants' guests sustain, unless caused by our negligence. Effective on September 6, 2024, tenants will be required to maintain a rental insurance policy on the property/contents at 100 Leila Lane. Tenants will provide landlords a copy of this rental insurance policy within 30 days after the signing of this agreement. 3. UNREASONABLE DISTURBANCES: Tenant at all times during the lease term shall conduct himself and require other persons on the premises with his consent to conduct themselves in a manner that does not unreasonably disturb neighbors or constitute a breach of the peace. 4. USE OF PROPERTY: The Tenant(s) agree to obey all federal, state, and local laws and to act in a manner that does not disturb the peace of other's quiet enjoyment. A. Improvements. The tenant is not permitted to conduct alterations to the property more than $100. If the tenant is permitted, they must seek written permission from the Prior Holdings LLC before performing any work. B. Landlord's Access to Premises. The landlord may enter the property within Hours by giving notice to the tenant. Notice may be in the mail, slipped under the door, or via cell phone or text. In addition to granting notice, the landlord may also enter the premises under any of the following conditions: In any emergency that requires immediate action and preservation of the property. If illegal activity is occurring on the property. If tenant unreasonably withholds consent. If the tenant has vacated the property or has not been present for more than fifteen (15) days. 5. KEYS: To provide routine emergency maintenance service, Owner/Manager will retain a key to the property. In case of routine maintenance, we shall try to give the tenant advance notice of our entry. We reserve the right, after you have been given notice that you are vacating, to show the property to prospective residents. Please make sure that you have a spare key as Owner/Manager is not always available to open the property in the event you misplace your key. 6. DELINQUENT RENT: If Owner/Manager fails to receive the monthly rent by the 5th day of the month in which it is due, tenant shall pay Owner/Manager an additional amount in the sum of $10.00 per day, beginning with the 6th day of the month until such rent is paid in full, to compensate for the added expense of processing such delinquent accounts. If the late charge is not paid with the monthly rent, Owner/Manager shall not be obligated to accept the rent. 7. RETURNED CHECKS: A $25.00 fee will be charged for checks returned to Owner/Manager from the bank. 8. WALLS: Tenants shall not place on the walls or ceiling any gummed surfaced material or large nails for hanging pictures, etc. Only small nails or hook combinations shall be used for such purposes. 9. SUBLETTING: The tenant is barred from subletting or assigning any part of the property to another person or entity without the written consent of the landlord. 10. LAWN CARE: Tenant is responsible for taking care of lawn and landscaping. If any cost is incurred by the Owner/ Manager, then that cost will be passed on to the resident. 11. Smoking is not permitted in the unit. 12. MAINTENANCE & REPAIRS: Tenants must take good care of property and all equipment and fixtures in and around property. The tenant is required to maintain the same sanitary condition throughout the term of the lease agreement as it was upon move-in. If any necessary repairs are needed it is the tenant's responsibility to inform the landlord as soon as possible of any defect(s). Owner will repair the plumbing, heating, and electrical systems. Owner may, at Resident's cost, make all repairs and replacements whenever the need results from Resident's negligence (to be determined by the individual making the repairs on plumbing, heating and electrical systems), any recklessness, illegal activities and violations of the provisions of this lease. 13. AIR FILTERS: Tenant is responsible for changing out the Heat and Air unit air filter on a monthly or bi-monthly. 14. PESTS: Owner/Manager will spray for roaches if they are determined to be present when tenant moves in; otherwise, if it is determined that the resident is responsible, resident will be required to spray at his/her own expense until roaches are no longer present.
