Terms "tenant, Leaseholder, Sub-Leaser, Occupant" refer to the person(s) who sign the lease and are living in the dwelling or are included as occupants on the lease. The terms "monthly leasing cost" and "rent" are used interchangeably in this agreement to mean money paid to live in the dwelling monthly. The terms "property, dwelling, and unit" refer to the building structure that is being leased. The terms of this rental are as followings: Payment agreement: This lease is a 12-month initial lease agreement which is set at the established monthly cost of occupancy. The 12-month lease agreement will automatically convert to a month-to-month lease agreement after the terms of the initial 12-month lease agreement have been satisfied. Occupants who elect to vacate the dwelling before the terms of the initial lease agreement are satisfied may do so with a 30-day notice to vacate the dwelling. In this case, the occupant will be responsible for the monthly leasing costs until the full lease agreement has been satisfied or until a new leaseholder can occupy and assume the terms of this lease. Leaseholders of the month-to-month lease agreement must provide a 30-day notice to the leasing agent. Security Deposit: The security deposit, equal to the first and last months rents, will be returned 21 days after the property has been vacated and after the terms of the lease agreement are deemed to have been satisfied. The purpose of the deposit is to assure the soundness of the dwelling as presented to the occupant at the time of the initial occupancy or move-in-date including unpaid rent, excessive cleaning requirements, and other violations of the lease terms. Hoarding behavior that affects safety, hygiene, or compromises the structure of the dwelling. Damage due to neglect Damages and Repairs: The leaseholder is responsible for damage due to neglect. Damage beyond normal wear and tear. Damage caused by guests. Failure to report issues immediately, promptly, or appropriately. The property is a non-smoking property. Reporting Issues: Issues that could affect tenant safety and damage the property/dwelling should be immediately reported to the leasing agent using the appropriate reporting platform. The leaseholder is responsible for damage due to neglect or inappropriate reporting of issues that could damage the dwelling. Illegal Activity: Illegal activity is prohibited on this property including domestic abuse, violence against protected rights, drugs, and theft. Illegal activity may result in the immediate termination of the lease. Hanging Out and Socializing: Leaseholders and their guests may socialize and gather within the terms of this lease as agreed in sections Guest Policy, Quiet Hours and Noise, Illegal Activity. Furthermore, all social gatherings must be maintained on the property and not in the spaces of neighbors. Social gatherings must be considerate and respectful. Guests must enter and exit promptly, via designated entry points, and shall not remain on the property outside of the dwelling unit after the events. Failure to comply will be considered a violation of the lease agreement. Smoking, Drugs, and Damage Prevention: The property is a non-smoking property including cigarettes, vapes, marijuana, hookah, cigars, hashish, methamphetamine, heroin, DMT, PCP, opium, and prescription drugs that are illegally used for recreational purposes. Dwelling and Property Alterations: Dwelling and Property alterations are only permitted with written notification and approval from the leasing agent including painting, construction, furniture changes, and installations. Dwelling/Unit Entry: Leasing agents and service staff may enter the dwelling/unit with reasonable notice for the purpose of repairs, emergencies, inspection, and showing the unit if vacancy is pending. Termination: Either party (leasing agent or leaseholder) may terminate the lease within the terms of this lease agreement, and/or a governing agency with probable cause. Subletting Prohibited: Subleasing is not permitted. Liability: The leasing agent, service staff, and owner are not liable for loss of personal property and theft. Leasing agents, service staff, and owners are not liable for injury caused by the negligence of the leaseholder/tenant/occupant. Governing Law: This agreement shall be governed by the laws of the State of California. This lease agreement can be terminated by governing parties with probable cause. Entire Agreement: This document represents the full agreement. Any changes must be in writing and signed by all parties involved: leaseholder, sub-leaseholder, and leasing agent.
