Utilities The Tenant shall be responsible for payment of all utilities and services for the Premises, including but not limited to gas, electricity, water, trash, and internet. 2. Yard Maintenance The Landlord will be responsible for the annual irrigation fee, sprinkler maintenance, and seasonal front yard maintenance (bi-weekly during the season).The Tenant is responsible for weed abatement in the front, back, and side yards. 3. HOA and Community Pool An annual HOA fee is due on January 1st of each year. This fee covers the landscaping, groundskeeping, and pool maintenance within the Hazelwood subdivision. The Landlord will be responsible for paying the HOA Management Company directly. Hazelwood Village offers two community pools that are open during the summer season, typically from Memorial Day weekend through Labor Day weekend. If the tenant chooses to use the community pools, a $35 monthly pool access fee will be added to the rent. This fee is optional; however, it is required to obtain and maintain ownership of a pool key. All tenant(s) must comply with the HOA's rules and regulations, which are updated annually. Tenants are also welcome to attend and participate in HOA meetings. 4. Hot Tub A hot tub is currently on the premises and may remain if the tenant wishes. If not desired, it can be removed upon request. If retained, the tenant assumes full responsibility for maintenance, electrical costs, repairs, and liability. Tenants must include hot tub liability coverage in their renter's insurance if the hot tub remains on the property. 5. Lease Termination Tenants must provide a formal 30-day written notice, signed by all tenants, prior to vacating the property at the end of the lease term. Early termination before the lease end date requires payment of two months' rent ($4,600) and forfeiture of the security deposit. Failure to comply may result in legal proceedings. Replacement tenants may be considered only with Landlord approval. 6. Security Deposit A $2,300 security deposit is required with the first month's rent before occupancy. An automatic $500 non-refundable cleaning deduction will be subtracted from your security deposit (for professional carpet and house cleaning). Additional deductions may apply for wall repairs, painting, flooring damage, or anything beyond normal wear and tear. Before and after photos will be documented. The Landlord will return any remaining deposit funds within 20 days of lease termination, accompanied by an itemized statement. 7. Appliances and Fixtures The Landlord will maintain the refrigerator, stove, oven, dishwasher, washer, dryer, microwave, and plumbing, unless damage is due to Tenant negligence (e.g., clogs, misuse, or improper handling). Determination of fault will be made by a professional evaluation. 8. Emergencies The Landlord will address natural disasters or incidents not caused by Tenant actions through their own insurance. Any property damage resulting from Tenant negligence will be the Tenant's responsibility, and any applicable rental insurance deductibles will apply. 9. Eviction Causes Grounds for eviction include, but are not limited to: a. Nonpayment of rent or repeated late payments b. Lease violations, property damage, illegal activity, nuisance, or failure to vacate c. Smoking in the home or smoke odor requiring remediation 10. Rent and Late Fees Rent of $2,300 is due on the 1st of each month. A 5-day grace period is allowed. Payments received after the grace period will incur a $10 per day late fee, capped at 5% of the monthly rent. 11. Renter's Insurance Tenants must maintain and submit a copy of their renter's insurance with a minimum of $100,000 personal liability coverage.Any claims and deductibles are the tenant's responsibility. The policy must cover personal belongings, temporary housing in case of emergencies, and accidental coverage. 12. Occupants All residents must be listed on this lease. Credit checks are required for all adult tenants (minors excluded). 13. Landlord's Intent If the Landlord decides to sell, occupy, or renovate the property before the lease ends, a 60-day written notice will be provided. Tenants will be released from their final month's rent in such cases. If the home sells and the new owner allows the lease to continue, all original terms remain in effect. While the property is listed for sale, the Landlord, listing agents, and potential buyers may show or inspect the home with 24-hour notice to the Tenant. 14. Tenant Rights Landlords are required to maintain a safe, habitable dwelling, including functional plumbing, heat, and electricity. Repairs will be made promptly in compliance with Idaho law. 15. Landlord Entry The Landlord must provide at least 24 hours' notice before entering the property, except in emergencies (e.g., fire, flood, or gas leak).
