Service Calls / Maintenance Repairs Tenant shall be responsible for the cost of all service calls for any issues in the house during the Tenant's occupancy. CRITICAL LEGAL LIMITATION ( 92.052, 92.006): This provision is SUBJECT TO and LIMITED BY the Landlord's non-waivable statutory duty to repair conditions that materially affect the physical health or safety of an ordinary tenant. The Landlord CANNOT contractually shift this statutory duty to the Tenant for health/safety conditions [1] [7]. Tenant-responsible service calls include: minor plumbing issues (clogged drains, running toilets), appliance repairs for Tenant-supplied appliances, pest control, HVAC filter replacement, and cosmetic repairs.
