    This is a single family residence 3 bedrooms, 1 and a half bathrooms. There is a large kitchen with dishwasher, stove and range included. Plenty of parking available. There is an attached 2 car garage and a spacious driveway. There is also a very large back yard with a covered patio, green space and mature fruit trees and access to a back alley. Property has been updated and newly painted. Accepting Section 8 applicants. Upon completion of the original lease term, lease will continue on a month-to-month basis unless otherwise agreed upon in writing, i.e., new lease/extension of lease. If a tenant vacates before end of term, tenant is liable for up to 3 months' rent. If lease has rolled over to month to month, each term will start on the first of the month and end on the last day of the month. Tenant is required, under all circumstances, to give 30 days' notice to vacate the premises. Upon transitioning to month-to-month lease agreement Landlord or Tenant may terminate lease without cause or reason if either party provides thirty day written notice. Tenant must provide certified written notice to Landlord. If the Tenant terminates the lease within the time agreed upon within the lease, Tenant shall forfeit entire security deposit and is additionally responsible to return unit in same condition delivered at move in. Landlord Shall not raise rent for a minimum of 12 months and will give 60-day notice of a rent increase. The only person(s) living in the Leased Premises shall be listed at time of signing. Any change in occupancy will require written consent of the Landlord. Tenant will use the Leased Premises only as a residence. The amount of rent is to be paid on a monthly basis. The rent is due in advance on or before the 1st day of each month. The rent due date is the date that Landlord must receive tenant's rent payment. Tenant(s) agree to pay the rent no later than the 3rd of each month. After the 3rd, rent is late. An additional $50 will be due. Upon the nonpayment of rent by the 10th day of the month the Landlord will have the rights to proceed against the tenant(s) for the collection and eviction as if Tenant(s) have defaulted on the rental payment. If the rent or any other charges are not received by the landlord on or before the 3rd of the month, tenant must pay a late fee of $50 for the first day it's late and $5.00 each day thereafter. Landlord may file a 5-day eviction of non-payment at their discretion no sooner than the 10th day of the month. A returned payment fee of $50 dollars will be added for all returned payments. A personal check will not be accepted as payment to replace a returned payment. Cash, cashier's check or money order may be acceptable forms of payment. Tenant has paid landlord a security deposit Tenant agrees that this security deposit is intended to secure the faithful performance by the Tenant of all terms, covenants and conditions of this Lease Agreement including but not limited to the cost of damages beyond normal wear and tear, unreturned keys, unpaid rent and any other amount due and legally allowable under the terms of this Lease Agreement and in accordance with state and local laws and regulations. Tenant may be responsible for any unpaid charges or attorney fees, suffered by the Landlord by reason of the Tenant's default of this Lease in accordance with state and local laws and regulations. Landlord's recovery of damages will not be limited to the amount of the security deposit. Provided the Tenant(s) fulfill all of the obligations of the Lease Agreement, the Landlord will return either an itemized accounting for charges, with any balance of the security deposit reconciled, or the remainder of the security deposit to the Tenant within 30-day days. The Security deposit is NOT considered last month's rent. Tenant understands they are responsible for returning the unit in the same condition delivered at move in. Tenant understands smoking in unit is automatic forfeiture of security deposit. Tenant also understands they will be responsible for repainting and replacing flooring in the event smoking occurs inside the Leased Premises. At the end of Lease Agreement, Tenant must vacate and shall immediately and peacefully surrender and return to the Landlord the possession of Leased Premises in as good condition as when Tenant took possession less normal wear and tear. The Leased Premises shall be cleared out of all occupants, furniture, personal articles, and effects of any kind. Notice to vacate must be in writing 30 days in advance. Tenant acknowledges and agrees to allow Landlord or agent thereof to show property to prospective tenants whether tenants are present or not with the appropriate advance notice of 24 hours. Tenant understands and agrees that essential services are to be always maintained and operational. Landlord will not pay and not be responsible for maintaining water, trash and sewer. Tenant agrees that Landlord will not be held responsible for the loss of use, or discontinuation or interruption of any utility or extra services beyond the Landlord's control. Tenant shall notify the Landlord of any malfunction of a utility. Tenant may not be negligent in his/her use of any included utilities or services. If by Tenant'(s) negligence, the utility bill or service fee dramatically increases, Tenant(s) will be billed for any overages which will then be due and payable by Tenant(s) as additional rent. Tenant understands if utilities they are responsible for are transferred out of their name during the lease agreement it is an automatic violation of the lease and can result in lease termination. Landlord will supply and maintain the following appliances: Dishwasher, range, stove, disposal, and central heat and air. Tenant will keep appliances provided by the Landlord in good working order and shall report any malfunction to the Landlord. Any damage sustained due to the neglect or misuse by Tenant will become the full responsibility of the Tenant, either in the appliance repair or replacement. Tenant agrees that the items specified above are the property of the Landlord and will remain in the Leased Premises at the end of this lease. Tenant must have written approval before installing any appliance. Landlord accepts no responsibility for the maintenance, repair or upkeep of any appliances supplied by the Tenant. Tenant agrees he/she is responsible for any damage that occurs to the Leased Premises resulting from the addition of any appliance that is supplied by the Tenant. Landlord shall not be responsible for any repairs not pre-approved in or about the Premises. It is the responsibility of the Tenant to promptly notify the Landlord of the need for any repair or defect of which the Tenant becomes aware of. If any required repair is caused by the negligence or destruction of the Tenant and/ or Tenant's guests, the Tenant will be fully responsible for the cost of the repair and/ or replacement that may be needed. The tenant must keep the premises in a clean, sanitary and good condition always and is to remove all rubbish, garbage, and other waste in a clean, tidy and sanitary fashion. The Tenant is not permitted to paint, make any alterations, improvements, or additions to the Premises without first obtaining the written consent of the Landlord. Tenant shall irrigate, cut/maintain lawns/landscaping, remove leaves, grass and debris and keep same clear of rubbish or weeds. If an approved pet resides on Leased Premises, pet must be secured and out of way of maintenance for maintenance work to be completed. Any space where maintenance is taking place must be free and clear of personal items, and in a condition for work to be performed. Landlord will do their best to remedy any maintenance issues and repairs in a timely fashion. No rent deductions will be made for maintenance issues arising in Leased Premises. The tenant acknowledges that the Tenant has inspected the Leased Premises and at the commencement of this Lease Agreement, the interior and exterior of the Leased Premises, as well as all equipment and any appliances are found to be in an acceptable, working, safe and good condition. The Tenant agrees to return the Leased Premises to the Landlord at the end of the Lease Agreement in the same condition it was at the beginning of the lease agreement. No Pets of any breed or species are allowed on the premises without written approval from Landlord. Properly certified service animals will be required to show proof of documentation. Accepted pets: Pet deposit required. $250 to $500 depending on animal, breed and size. Deposit may be refundable depending on wear and tear of the property caused by pet(s). The Tenant may not interfere with the peaceful enjoyment of the neighbors. Tenant is entitled to enjoyment of the premises. Tenant and Guests will not use premises or adjacent areas in a way to: 1- violate any laws or ordinances- including laws prohibiting the sale of drugs. 2- Commit waste/property damage. C. The Tenant will be responsible for any fine and/or violation that is imposed on the Landlord due to the tenant's negligence. D. The tenant shall abide by all Federal, State, and Local Laws. E. Waterbeds and liquid furniture are not permitted without the written permission of landlord. F. The Tenant may not store or park a recreational, commercial, watercraft or inoperable vehicle on the premises. G. Tenant will notify landlord if tenant shall be away from site for more than 14 consecutive days. During absence, landlord may enter premises to perform necessary maintenance and inspect for repairs. Tenant will notify landlord if any guest plans to stay more than 7 days. Landlord and/or his agents, with 24 hours written notice have the right during the term of this Lease Agreement to enter during reasonable hours to inspect the premises, make repairs or improvements or show prospective buyers and/or tenant(s) of the property. In the event of an emergency, Landlord reserves the right to enter Premises without notice. Tenants will not change or install additional locks, bolts or security systems without the written permission of the Landlord. . Tenant shall be responsible for any and all damages that may occur as a result of forcible entry during an emergency where there is an unauthorized placement of a lock. The tenant understands and agrees that if there is more than one Tenant that has signed the Lease Agreement, each Tenant is individually and fully responsible for all obligations of the terms of the Lease Agreement.
