Residential Lease Terms and Conditions This Property is leased subject to the following terms and conditions, agreed to by both Tenant and Landlord as material provisions of the Lease: 1. Occupants and Applications All persons eighteen (18) years of age or older must complete a rental application and be subject to screening and approval. No additional occupants may reside in the Premises without the prior written consent of the Landlord. Subleasing or short-term rentals (including Airbnb-type use) are strictly prohibited without written approval. 2. Income, Credit, and Background Screening Applicants must demonstrate verifiable income of at least 2.5- 3 times the monthly rent (or as otherwise required by Landlord). Employment, credit history, and background screening will be considered as part of the approval process. Any false or misleading information shall result in denial or termination of tenancy. 3. Eviction and Criminal History Applicants must not have any evictions within the past five (5) years. Criminal background results are subject to Landlord approval. 4. Rent, Due Dates, and Grace Period Rent shall be due on the 1st or 15th of each month as specified in the Lease. A three (3) day grace period shall apply. Rent not received by the end of the grace period shall be considered delinquent. 5. Late Fees and Non-Payment If rent is not received by the end of the grace period, a single late fee of $250.00 shall be assessed on the 4th day following the due date. Beginning on the 5th day and continuing daily thereafter, a fee of $35.00 per day shall apply until the rent is paid in full for that rental period. If rent remains unpaid for the rental period, an additional $500.00 fee may be assessed, along with all other remedies available under Missouri law, including but not limited to eviction proceedings. 6. Security Deposit A security deposit shall be required prior to move-in. The security deposit may be used to cover unpaid rent, damages beyond normal wear and tear, cleaning costs, or any other charges resulting from Tenant's breach of this Lease. The security deposit shall not be considered rent and may not be applied toward any monthly rent payments unless expressly agreed to in writing by the Landlord. Any remaining balance of the security deposit, after lawful deductions, will be returned to Tenant within the time period required by Missouri law. 7. Renter's Insurance Tenant shall maintain continuous renter's insurance throughout the lease term. Proof must be provided upon request. Failure to maintain coverage or provide proof within two (2) days of notice may result in lease termination. 8. Utilities Tenant shall be responsible for all utilities unless otherwise stated in writing, including but not limited to electricity, gas, water, sewer, trash, and internet. 9. Property Condition and Maintenance Tenant agrees to keep the premises clean, sanitary, and in good condition. Tenant is responsible for routine maintenance such as air filters, drain care, and general upkeep. Junk vehicles, excessive trash, and nuisance conditions are strictly prohibited. Tenant shall have five (5) days after written notice to correct violations. Failure to comply may result in a $100.00 charge and additional remedies. 10. Repairs Landlord shall be responsible for repairs due to normal wear and tear or material defects and will coordinate and complete such repairs as needed. However, Tenant shall be responsible for the cost of any repairs required due to misuse, negligence, or intentional acts by Tenant, occupants, or guests. Any such repair costs incurred by Landlord shall be billed to Tenant and shall be due and payable within fifteen (15) days of the repair being completed. If payment is not received within this period, the outstanding balance shall accrue interest at a rate of $10.00 per month until fully paid. 11. Landlord Right of Entry Landlord may enter the Premises with reasonable notice for inspections, repairs, or showings, except in emergencies. Tenant acknowledges that access may be required periodically to maintain property condition or facilitate leasing or sale. 12. Alterations No alterations, including painting, changing locks, or structural modifications, shall be made without prior written approval. Unauthorized changes may require restoration at Tenant's expense and may constitute a lease violation. 13. Illegal Activity and Smoking Illegal drugs, controlled substances, and related activity are strictly prohibited. Smoking is not permitted inside the Premises. 14. Lease adjustment Rent will increase by 2% each year on the anniversary of the lease start date. This adjustment helps keep the rent in line with normal market changes over time and will be applied each year as part of the lease terms. The Landlord may, at their discretion, review and negotiate this increase with the Tenant if both parties agree in writing. 15. Holdover Tenancy If Tenant remains in possession after lease expiration without written agreement, Tenant shall be responsible for daily charges and may be subject to eviction proceedings. 16. Entry for Marketing or Sale If the Property is listed for sale or re-rent, Tenant agrees to allow reasonable access for showings with proper notice. 17. Attorney Fees In the event of enforcement of this Lease, the prevailing party may recover reasonable attorney fees and court costs as permitted by law. 18. Material Lease Violations, Default, and Immediate Remedies Tenant acknowledges and agrees that strict compliance with all terms of this Lease is a material condition of tenancy. Any violation of this Lease, including but not limited to non-payment of rent, nuisance behavior, excessive noise, criminal or illegal activity, threats, property damage, unauthorized occupants, refusal of entry, repeated complaints, or failure to comply with any written notice from Landlord, shall constitute a material breach and default of Lease. Upon default, Landlord shall have the right to issue written notice as required by Missouri law. Tenant shall be required to cure the violation within the time period permitted by law, if a cure is allowed. Failure to timely cure, or any violation deemed serious in nature, shall entitle Landlord to terminate the Lease, demand immediate possession, and proceed with eviction proceedings without further notice as permitted by law. For violations involving illegal activity, intentional damage, safety risks, or repeated lease violations, Tenant agrees such conduct shall be deemed a non-curable breach, allowing Landlord to pursue immediate termination and all available legal remedies. Tenant further agrees that Landlord's acceptance of rent after a violation shall not constitute waiver of any rights or remedies, and Landlord expressly reserves all rights to enforce this Lease in full.
