Monthly Rent * Monthly rent: $2,350 * Rent is due on the 1st day of each month. * Rent must be paid by the method designated by the landlord. * Any applicable late fees will be stated in the lease and comply with Florida law. 3. Security Deposit * Security deposit: $2,350. * Security deposit is held to secure the tenant's obligations under the lease and may be used for lawful deductions, including unpaid rent, damages beyond ordinary wear and tear, or other amounts legally owed under the lease. * The security deposit will be handled in accordance with applicable Florida law. 4. Lawn Maintenance * Landlord will provide routine lawn maintenance at no additional charge to the tenant. * Tenant is responsible for maintaining the property between lawn-service visits, including promptly removing trash, pet waste, or other items from the lawn. * Tenant may not alter landscaping, remove plants, plant trees/shrubs, or install landscaping features without written approval from the landlord. 7. Washer & Dryer * Washer and dryer are provided as part of the rental. * Tenant is responsible for reasonable care and proper use of the appliances. * Tenant is responsible for damage caused by misuse, negligence, or unauthorized modification. 8. No Smoking * No smoking or vaping is permitted anywhere inside the residence, garage, or other enclosed areas of the property. * This prohibition applies to tenants, occupants, guests, and invitees. * Tenant is responsible for costs associated with smoke or vaping damage, odors, stains, or remediation beyond ordinary wear and tear. 9. Occupancy * Only the tenants and occupants specifically listed on the lease may reside at the property. * No additional occupants may move into the property without prior written approval from the landlord. * Tenant may not assign the lease or sublease the property without written authorization from the landlord. 10. Pets * No pets are permitted without the landlord's prior written approval. * Any approved pet must be specifically identified in a written pet addendum. * Tenant is responsible for all damage caused by pets, including damage to flooring, doors, walls, landscaping, screens, and other property, subject to applicable law. Important: Assistance animals and service animals must be handled in accordance with applicable fair-housing laws and are not treated simply as ordinary pets. 11. Property Condition * Tenant agrees to inspect the property before taking possession. * Tenant will receive a move-in condition report. * Tenant must report existing damage or defects to the landlord in writing within the time period specified in the lease. * Failure to report damage within that period may be considered evidence that the condition was not present at move-in, subject to applicable law. 12. Maintenance and Repairs * Tenant must promptly notify the landlord of leaks, plumbing problems, electrical problems, HVAC issues, water intrusion, mold concerns, appliance problems, or other conditions requiring repair. * Tenant may not make repairs, alterations, additions, or improvements without written authorization. * Tenant is responsible for damage resulting from negligence, misuse, unauthorized alterations, or failure to promptly report a problem. 13. Preventing Water Damage Tenant must: * Immediately report plumbing leaks or water intrusion. * Use plumbing fixtures only for their intended purpose. * Not flush grease, wipes, feminine hygiene products, paper towels, or other inappropriate materials. * Take reasonable precautions to prevent frozen pipes or other avoidable damage when applicable. 14. HVAC * Tenant agrees to use the HVAC system responsibly and replace air filters at the intervals specified by the landlord. * Tenant must promptly report HVAC malfunctions. * Tenant may not modify thermostat wiring or HVAC equipment. 15. Alterations Tenant may not, without prior written approval: * Paint walls * Install fixtures * Mount televisions or other equipment in a manner that damages walls * Install security systems * Change locks * Install satellite dishes * Install fencing * Make electrical, plumbing, or structural modifications * Make landscaping changes 16. Locks and Keys * Tenant may not change, re-key, or add locks without written approval from the landlord. * All keys, remotes, garage-door openers, and access devices must be returned at move-out. * Tenant is responsible for the reasonable cost of replacing lost keys/remotes or reprogramming access devices when necessary. 17. Landlord Entry * Tenant agrees to permit the landlord or authorized representatives to enter the property as permitted by Florida law for inspections, repairs, maintenance, showings, or other lawful purposes. * Except where otherwise permitted by law, reasonable notice will be provided before entry. 18. Insurance * Tenant is strongly encouraged to maintain renter's insurance covering personal property and personal liability. * Landlord's insurance does not insure the tenant's personal belongings. * If renter's insurance is required as a condition of the lease, the lease should specify the required coverage and documentation. 19. Tenant's Personal Property * Landlord is not responsible for loss or damage to tenant's personal property except to the extent caused by the landlord's negligence or as otherwise provided by law. * Tenant is responsible for securing and insuring personal belongings. 20. Illegal Activity * Tenant, occupants, and guests may not use the property for illegal activity or any activity that violates federal, state, or local law. * Illegal drug activity, criminal activity, or other unlawful conduct constitutes a violation of the lease and may result in termination and legal action as permitted by law. 21. Nuisance / Disturbances Tenant must not: * Create excessive noise * Disturb neighbors * Conduct activities that create a nuisance * Damage common or community property * Violate applicable HOA or community rules Tenant is responsible for the conduct of their guests and invitees. 22. HOA / Community Rules * Tenant must comply with all applicable Ashby Landing/HOA rules and regulations. * Any fines assessed against the landlord as a result of the tenant's violation of HOA rules may be charged to the tenant to the extent permitted by the lease and applicable law. 23. Parking / Vehicles * Vehicles must be properly registered, operable, and parked only in permitted areas. * No abandoned, unregistered, or inoperable vehicles may be kept on the property. * No vehicle repairs involving significant fluid leaks or damage to the driveway may be performed on the property. 24. Trash * Tenant must properly dispose of household garbage and comply with applicable trash/recycling schedules. * Tenant must not allow garbage, debris, or bulk items to accumulate on the property. 25. Pest Control * Tenant must maintain reasonable cleanliness and promptly notify the landlord of pest problems. * Tenant may be responsible for pest treatment caused by tenant negligence or unsanitary conditions, to the extent permitted by law. 26. Security / Safety Tenant must: * Keep doors and windows secured when appropriate. * Not disable smoke detectors, carbon monoxide detectors, or other safety devices. * Immediately report malfunctioning safety equipment. * Not tamper with electrical, plumbing, HVAC, or other building systems. 27. Subleasing / Short-Term Rentals * No subleasing or assignment without written approval. * No Airbnb, VRBO, short-term rental, vacation rental, or similar arrangement is permitted without the landlord's prior written consent. 28. Abandonment The lease should contain provisions addressing abandonment and the landlord's rights and remedies consistent with Florida law. 29. Default The lease should clearly define default, including: * Failure to pay rent * Unauthorized occupants * Unauthorized pets * Material property damage * Violation of no-smoking provisions * Illegal activity * Unauthorized subleasing * Material violation of HOA/community rules * Other material violations of the lease Landlord's remedies will be those permitted under the lease and applicable Florida law. 30. Late Payment / Returned Payments * Rent received after the applicable grace period, if any, may be subject to a late fee stated in the lease and permitted by Florida law. * Tenant is responsible for applicable bank/processing fees associated with returned or rejected payments, to the extent permitted by law. 31. Early Termination * Tenant may not terminate the lease early simply by moving out. * The lease should specifically state the landlord's rights and remedies if the tenant vacates before the end of the lease, consistent with Florida law. * Any agreed early termination should be documented in writing. 32. Move-Out Requirements At the end of the tenancy, tenant must: * Remove all personal property. * Return all keys, remotes, and access devices. * Remove all trash. * Clean the property. * Leave appliances and fixtures in the condition required by the lease. * Repair or pay for tenant-caused damage beyond ordinary wear and tear. * Provide a forwarding address. 33. Security Deposit / Damages * Landlord may make lawful deductions from the security deposit for amounts permitted under Florida law and the lease. * Tenant remains responsible for amounts owed that exceed the security deposit, where permitted by law. * Security deposit accounting and return will be handled according to Florida statutory requirements. 34. Notices * The lease should specify the addresses and permitted methods for delivering notices to both landlord and tenant. * If electronic notices are permitted, the lease should contain the appropriate electronic-notice provisions required by Florida law. 35. Attorney's Fees and Court Costs The lease should preserve all rights available under Florida law regarding recovery of reasonable attorney's fees and court costs in an action to enforce the rental agreement. Florida law specifically provides for attorney's fees to the prevailing party in qualifying landlord-tenant actions. 36. Governing Law / Venue * The lease will be governed by the laws of the State of Florida. * Any legal proceeding will be brought in the appropriate court and venue as required or permitted by applicable Florida law. 37. Entire Agreement * The written lease and its attached addenda constitute the entire agreement between landlord and tenant. * Any amendment or modification should be made in writing and signed by the parties unless otherwise permitted by the lease or applicable law. 38. Severability If any provision of the lease is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law. 40.
