Routers/extenders remain Landlord property. 5) Insurance (Material Term) Tenant must maintain renters insurance (personal property + liability) and provide proof within 48 hours of request; Landlord may be listed as "additional interested party" for cancellation notices. Failure = material breach. 6) Communications & House Rules Non-emergency hours: 8:00 AM 5:00 PM (Mon Fri). Emergencies (active leak, fire, gas, loss of heat in winter, lock malfunction): text + call immediately. Quiet Hours: 10:00 PM 7:00 AM. No repeated noise disturbances. 7) Entry & Showings (Access) Notice: Landlord may enter with 24-hour written notice (text or email) at reasonable times. Showings: Landlord may group showings any day between 8:00 AM 8:00 PM, including weekends, while Tenant is packing/occupied. Refusal = breach: Unreasonably refusing or blocking access after proper notice is a lease violation. Landlord may seek court relief and recover actual costs caused by refusal (extra advertising, re-showing, lost application fees, demonstrable delay in re-renting). Emergency: Landlord may enter without prior notice. 8) Use, Odors, Cooking, Smoking Indoor cooking limited to microwave/air-fryer only (no stovetop/oven/open flame). No smoking/vaping/drug use inside. Odor/Mold duty: Keep space ventilated; promptly report moisture. Tenant is liable for odor/mold remediation caused by misuse (e.g., heavy cooking/smoke). 9) Maintenance & Alterations Tenant handles routine items (lightbulbs, clogged drains from misuse). No paint, holes, fixtures, adhesive hooks, or alterations without written approval. Any approved holes must be properly patched, sanded, primed & color-matched. Mismatched/visible patches = repaint charge for affected wall(s). Cleaning/Trash: Keep Premises sanitary; remove trash regularly; no buildup. 10) Guests, Pets, Parking, EV Guests: occasional overnights ( 2 nights/mo) with notice; no long-term stays. Pets: only if approved in writing; pet addendum & fee apply. EV charging: If unplugged by Tenant, re-plug immediately. Failure causing loss or inconvenience may be charged at $25 per incident plus electricity. 11) Early Termination (Tenant request) If Tenant asks to end early and Landlord agrees in writing: Early Termination Fee = 2 months' rent (liquidated damages for turnover/remarketing) + rent and utilities until the earlier of (a) re-rental commencement or (b) original lease end, with Landlord's duty to mitigate by actively marketing. All access/showing terms still apply. 12) Default & Remedies Non-payment: If rent/charges unpaid, Landlord may issue a statutory Pay-or-Quit notice (currently 14 days). Failure to cure = filing for unlawful detainer. Other breaches: Landlord may issue 21/30-day cure/terminate notice per statute. No self-help: Landlord will not remove belongings or change locks without a court order. After a Writ of Possession, property handling will follow law. Attorney's fees/costs recoverable as permitted by law. 13) Refusal-of-Access Damages (Actuals) When Tenant refuses access after proper notice, Tenant is responsible for actual, documented costs reasonably arising from the refusal, including: incremental advertising, application fee losses, scheduled showing costs, and demonstrable delay in re-rental directly attributable to the refusal (pro-rated rent loss for days access was refused and qualified applicants could not be shown). No penalty actuals only, itemized. 14) Condition; Move-In/Out Joint move-in checklist with photos/video forms the baseline. Move-out standard: broom-clean; appliances/bath/kitchen wiped; floors vacuumed/mopped; all hooks/tape removed; holes professionally patched/painted to match; odors eliminated; all keys/FOBs/garage openers returned; trash removed. Charges (see Exhibit A) will be actual cost if higher than schedule. 15) Illegal Activity & Nuisance Any illegal activity, serious nuisance, harassment, threats, or interference with peaceful enjoyment is a material breach and grounds for termination per statute. 16) Subletting/Assignment Prohibited without written consent. 17) Co-Signer Duty Co-Signer is jointly and severally liable for all Tenant obligations until lease ends and account is settled. Co-Signer must maintain current phone + email; failure to provide current contact within 48 hours of request is a breach. 18) Notices 19) Non-Waiver; Entire Agreement; Severability No waiver except in writing.
