HOA Notification and Document Disclosure In accordance with California Civil Code 1351 and 1353, the Landlord will notify the HOA of the Tenant's occupancy, as required by the governing documents of the Association. The Tenant will be provided a complete written copy of the HOA's CC&Rs, rules, and regulations at the time of lease signing or upon request. Tenant Responsibility for Compliance and Violations Pursuant to California Civil Code 1940.9, the Tenant must comply with all HOA rules and regulations throughout the lease term. The Tenant shall be financially responsible for any HOA-imposed fines, fees, or penalties arising from the actions or omissions of the Tenant, their guests, or their pets, provided the violations are properly documented and substantiated. Documentation of such violations, including written notices or fee assessments issued by the HOA, will be made available to the Tenant. The amount of any fee shall be based on the official fee schedule found in the HOA's CC&Rs and governing rules. Violation Policy and Termination of Tenancy The Tenant shall not incur more than two (2) HOA violations during the lease term unless otherwise determined by the Landlord in writing. More than two violations may constitute a material breach of the lease, and may be grounds for lease termination and lawful eviction pursuant to California Code of Civil Procedure 1161. Any such termination or eviction will comply with applicable notice requirements and legal processes, including 3-day notices to cure or quit, as required by California law. Prohibition of Federally Illegal Substances In accordance with the federal Controlled Substances Act (21 U.S. Code 801 et seq.) and supported by California precedent (Ross v. RagingWire Telecommunications, Inc., 42 Cal.4th 920 [2008]), the use, possession, cultivation, or distribution of any substance illegal under federal law including but not limited to marijuana is strictly prohibited on the premises, regardless of its legal status under California state law. Pet Policy, Deposit, Monthly Rent, and Waste Responsibility California Civil Code Compliance Pet Authorization, Deposit, and Monthly Pet Rent Tenant is permitted to keep an approved domestic pet on the premises, subject to the following conditions: A refundable pet deposit of $500 shall be paid at the commencement of the lease. This deposit is part of the total security deposit as defined under California Civil Code 1950.5, and may be used to cover pet-related damage beyond normal wear and tear. A monthly pet rent of $75 shall be added to the base rent and is due on the same day as the regular rent. Service Animals and Emotional Support Animals (ESA) Per California Civil Code 54.2, California Government Code 12955, and the federal Fair Housing Act (42 U.S.C. 3601 et seq.), animals that are verified as service animals or emotional support animals (ESAs) are not considered pets and are exempt from monthly pet rent. However, a refundable pet deposit may still be required, provided it is charged equally to all tenants and is only used for actual damages, in accordance with California Civil Code 1950.5. Proper verification or documentation must be submitted in compliance with applicable housing laws. Pet Waste Responsibility and Fine Tenant is responsible for properly cleaning up after their pet at all times. All pet waste must be promptly collected and disposed of in the designated exterior trash bin (not recycling or green waste containers). Failure to properly dispose of pet waste shall result in a $10 fine per occurrence, which may be added to the tenant's account balance and is due with the following rent payment. Repeated violations may be considered a breach of lease and subject to further enforcement action. Lease Termination, Notice Requirement, and Early Termination Fee California Civil Code Compliance Notice of Termination In accordance with California Civil Code 1946, Tenant shall provide the Landlord with at least thirty (30) days' written notice prior to vacating the premises, whether at the end of a month-to-month tenancy or prior to the expiration of a fixed-term lease. Early Lease Termination / Lease Break Fee If the Tenant chooses to terminate this lease before the end of the agreed fixed term, for any reason other than a legally protected right (such as constructive eviction, domestic violence, or military relocation under Civil Code 1946.7 or federal law), the Tenant agrees to pay a lease break fee equal to 1.5 times the monthly rent, totaling $2,550 (1.5 x $1,700). This amount represents a reasonable estimate of the costs incurred by the Landlord for early termination, including vacancy, re-marketing, and administrative processing. This lease break fee is not a penalty, but a liquidated damages provision permissible under California Civil Code 1671, and shall not exceed the actual damages incurred if the Landlord is unable to re-rent the unit immediately. Duty to Mitigate As required under California Civil Code 1951.2, the Landlord will make reasonable efforts to mitigate damages by attempting to re-rent the unit as soon as practicable. If the Landlord successfully re-rents the unit before the end of the original lease term, the Tenant will only be responsible for rent owed up until the new tenancy begins, plus any unpaid rent, fees, or cleaning/damage costs per Civil Code 1950.5. Use of Common Areas Waste Removal and Landlord Access The yard and entrance shall be considered common areas for the purpose of allowing the Tenant to transport household waste, green waste, and recyclables from the primary residence to the designated curbside area for scheduled residential pickup. The Landlord shall not conduct any activities in these common areas without providing the Tenant with at least 24 hours' written notice, in accordance with California Civil Code 1954, except in the case of emergency. This includes, but is not limited to, routine maintenance, landscaping, or other property management functions. Nothing in this clause shall prevent the Landlord from accessing the property as legally permitted, provided proper notice is given.
