Utilities: The tenant shall be responsible for the timely payment of all utility services, including but not limited to gas, electricity, water, and sewer, throughout the entire duration of the lease. Property Maintenance & Care: The tenant is required to maintain the premises in a clean, sanitary, and well-kept condition. The tenant agrees to promptly report any defects, malfunctions, or necessary repairs to the landlord. Maintenance Threshold: The tenant is responsible for the cost of minor, non-structural repairs and routine maintenance tasks (such as replacing light bulbs, smoke detector batteries, or HVAC filters) up to $700 per incident. For repairs exceeding $700, or for issues involving vital systems (heating, plumbing, electrical, or structural integrity) not caused by tenant negligence, the landlord will cover the costs. The tenant must obtain landlord approval prior to authorizing any major repairs. Alterations and Modifications: No structural modifications, alterations, interior painting, or cosmetic changes to the premises shall be permitted without the prior written consent of the landlord. Snow and Ice Removal: The tenant is responsible for the prompt removal of snow and ice from all driveways, walkways, and sidewalks on the property. Any municipal fines, penalties, or citations resulting from a failure to maintain these areas will be the sole financial responsibility of the tenant. Lawn Care & Landscaping: The tenant is responsible for seasonal landscaping upkeep, which includes mowing the grass a minimum of twice per month during the summer season and keeping the grounds free of leaves and debris. Annual Rent Escalation: The monthly rent shall increase by a fixed rate of 4% annually upon each lease renewal. Legal and Attorney Fees: In the event that legal action or court proceedings are required by either party to enforce the terms of this agreement, the prevailing party shall be entitled to recover reasonable attorney fees and court costs from the non-prevailing party. Rent Due Date & Late Fees: Rent is due in full on the 1st day of each calendar month. A late fee of 5% of the monthly rent will be assessed if payment is not received by midnight on the 5th day of the month. Landlord Access to Property: The landlord reserves the right to enter the premises for inspections, necessary repairs, or to show the property to prospective tenants or buyers, provided a minimum of 24 hours' advance notice is given to the tenant (except in cases of emergency).
