Leased Property 1.1 The Landlord agrees to rent to the Tenant a portion of the home located at 1618 McFadden Street, Columbia, SC 29204 (the "Property"). Rent 3.1 The base rent for the Property is $1,790.00 per month ("Rent"). Utilities and Services (Zillow-Compliant) 4.1 Utilities are not included in the monthly Rent. 4.2 Tenant shall be responsible for payment of all utilities and services serving the Property, including but not limited to: Electricity Water and sewer Gas (if applicable) Trash service Internet, cable, or streaming services 4.3 Utilities shall be placed in Tenant's name where permitted. If any utility cannot be separately metered or placed in Tenant's name, Tenant agrees to reimburse Landlord for Tenant's proportional share within ten (10) days of receipt of billing documentation. 4.4 Failure to maintain utility services or to pay utility charges when due shall constitute a material breach of this Lease. 5. Security Deposit 5.1 Upon execution of this Lease, Tenant shall pay a $300.00 security deposit ("Security Deposit"). 5.2 The Security Deposit shall be held in a non-interest-bearing account. 5.3 The Security Deposit shall be returned within thirty (30) days after termination of tenancy, less lawful deductions, excluding normal wear and tear. 5.4 Permitted deductions include, but are not limited to: a. Excessive wall damage or unauthorized holes b. Repainting due to misuse or excessive damage c. Plumbing clogs caused by Tenant d. Damage to doors, windows, fixtures, or furnishings e. Flooring damage beyond normal wear f. Cleaning or repairs due to Tenant negligence g. Pest treatment caused by Tenant or guests h. Water or freeze damage caused by negligence i. Any other deductions permitted by the Act 5.5 The Security Deposit may not be applied toward Rent. 6. Inspections and Entry 6.1 A move-in and move-out inspection report shall be completed. 6.2 Landlord may enter the Property at reasonable times with proper notice to inspect, repair, or show the Property in compliance with the Act. 7. Tenant Improvements 7.1 Tenant shall not make improvements, alterations, or additions to the Property without written consent of the Landlord. 8. Insurance 8.1 Tenant's personal property is not insured by the Landlord. Tenant is encouraged to obtain renter's insurance. 9. Attorney Fees 9.1 In any action arising out of this Lease, the prevailing Party shall be entitled to reasonable attorney fees and costs. 10. Governing Law and Severability 10.1 This Lease shall be governed exclusively by the laws of the State of South Carolina. 10.2 If any provision conflicts with the Act, the Act shall control. 10.3 Invalid provisions shall not affect enforceability of remaining provisions. 11. Assignment and Subletting 11.1 Tenant may not assign, sublet, or grant a license to use the Property without prior written consent of the Landlord. 12. Care and Use of Property 12.1 Tenant shall promptly notify Landlord of damage or conditions affecting habitability. 12.2 No illegal activity is permitted on or about the Property. 12.3 Tenant shall comply with all health, safety, housing, and fire laws. 12.4 Tenant shall take reasonable steps to prevent moisture and mold and promptly report any issues. 12.5 If the Property is vacant for seven (7) consecutive days or more, Tenant shall notify Landlord or arrange inspections. 12.6 At lease end, Tenant shall surrender the Property in good condition, normal wear and tear excepted. 13. Rules and Notices 13.1 Tenant shall comply with Landlord rules and regulations. 14. General Provisions 14.1 All monetary amounts are stated in U.S. dollars. 14.2 Waiver of any breach shall not constitute waiver of future breaches. 14.3 This Lease binds heirs, successors, and assigns. 14.4 All Tenant payments are deemed additional rent. 14.5 Tenants are jointly and severally liable, if applicable. 14.6 Locks may not be changed without written consent. 14.7 NSF fee: $45.00 per returned check. 14.8 Headings are for convenience only. 14.9 This Lease may be executed electronically and in counterparts. 14.10 This Lease constitutes the entire agreement. 14.11 Showings may occur within thirty (30) days of lease expiration with 24-hour notice. 14.12 Time is of the essence. 15.
