Once the contract is in signed by both Tenant and Landlord, Tenant will pay to the Landlord a full monthly rent as security deposit in advance before moving in. 2. Rent is due and payable in full on the 1st day of each month. The rent shall be payable in advance on the 1st day of each month, except when that day falls on a weekend or legal holiday, in which case rent is due on the next business day. 3. Rent will be paid by check to Landlord or by electronic transfer. 4. In the event the Tenant shall take or return possession of the premises on the day other than the first day or the last day of the month, the amount of rent for the last month of the lease term shall be prorated to the fraction of days of occupancy for the respective month. 5. A late payment charge shall be added to the monthly payment if any portion of the rent is unpaid after the 5th of each month. The late charge is $250.00, plus $50.00 for each additional day that the rent remains unpaid after the 5th of each month. The five-days grace period shall in one way be construed to give permission, either expressed or implied, for late payment. Any time rent is paid after the 5th day of the month, for whatever reason, the payment must be in the form of cashier's check or money order only. 6. Tenant and Landlord agree that a late payment for more than 20 days is a breach of this rental Agreement. In such event, Landlord may terminate the Agreement and repossess the premises. 7.If any check offered by Tenant to Landlord in payment of rent or any other amount due under this Agreement is returned for lack of sufficient funds, resulting in a stop payment charge of any other reason, Tenant will pay Landlord a returned check charge of $35.00. 8. The premises are to be used only as a private residence for Tenants named above in this Agreement. Occupancy by guests for more than 1 week is prohibited and will be considered a breach of this Agreement except a written notification (including email) from the Tenants in advance. 9. Tenant agrees to deduct $500 cleaning fee from the Security Deposit. Tenant shall keep said premises in good condition and surrender the same at the end of this rent term, in a good state of cleanliness and maintenance. Tenant shall not mar or deface premises, and agrees to pay costs of repair of same, over and above the amount of Security Deposit. 10. If cleaning of the property interior, private patio are all satisfactorily completed by Tenant, and all rent and charges are paid to the termination date, and a proper 30 days written notice to vacant has been given, a refund check of the remaining fund of the Security Deposit less than $500 will be issued no later than 30 days after termination. Cleaning of the property interior includes: General cleaning, painting, and/or waxing of all surfaces (floors, woodwork, walls, windows, etc.); Cleaning of all appliances, kitchen and bathroom fixtures, closets, and cupboards. Professional cleaning (washing of carpets and drapes), if necessary. 11. Tenant is responsible for all the utility charges incurred in the house. Landlord is responsible for HOA charge regarding to yard maintenance. 12. Tenant shall not sublet whole or any part of the premises or assign this Agreement to other parties without a prior written consent of Landlord. 13.Tenant shall: Keep the premises clean, sanitary and in good condition, and upon termination of the tenancy, return the premises to Landlord in a condition identical to that existed when Tenant took occupancy, except normal wear and tear. Immediately notify landlord of any defects or dangerous conditions in and around the premises of which Tenant becomes aware. Reimburse Landlord, on demand by Landlord, for the costs of any repairs to the premises for damages caused by Tenant or Tenant's guests or invitees through misuse or negligence. 14. Except as provided by law or by a prior written consent of Landlord, tenant shall make every repairs to the premises, including fixing nail holes in the walls or painting dirty walls caused by Tenant, at Tenant's sole expense during the term of the tenancy. Landlord shall be responsible for replacement of major items, such as roof or water heater degraded through natural wear and tear. 15. Tenant and their guests or invitees will not use the premises or adjacent areas in such a way as to: Violate any law or ordinance, including law-prohibiting usage, possession, or sale of illegal drugs. Produce waste that severely causes property damage. Create a nuisance by annoying, disturbing, inconveniencing or interfering with the quiet enjoyment and peace of any other tenants or nearby residents. Smoke tobacco, cigars or marijuana. 16. No animal, bird or other pets are permitted in the premises at any time. 17. No Smoking: No smoking of any substance is allowed in the premises or common area. 18. No drug activities are permitted in the premises at any time. 19. Tenant is entitled to quiet enjoyment of the premises. In the event of emergency, court order, or Tenant's abandonment, however, Landlord or Landlord's representative may enter the premises to make inspection, repairing or improvement. For other events, Landlord may enter the premises to conduct periodical inspection for safety and maintenance related problems, or to show the premises to prospective buyers or tenants. In such events, Landlord shall give Tenant a 24-hours' notice before entering. 20. Tenant will notify Landlord in advance if Tenant will be away from the premises for 10 or more consecutive days. During such absence, Landlord may enter the premises at times when reasonably necessary to maintain the property and inspect for needed repairs. 21. If after signing this Agreement, Tenant fails to take possession of the premises, Tenant will still be responsible for paying rent and complying with all other terms of this Agreement. 22. In any action or legal proceeding to enforce any part of this Agreement, the prevailing party shall recover reasonable attorney fees and court fees.
