RENTAL AGREEMENT The Beach House, LLC 195 Sunrise Dr, Apt #3, Key Biscayne, FL 33149 1. The Parties This agreement is made on the date of booking, between The Beach House FMB, LLC, "Owners" of 195 Sunrise Dr. #3, Key Biscayne, FL 33149 and John Doe, hereinafter known as "Guests." 2. The Property 195 Sunrise Dr. #3, Key Biscayne, FL 33149. The property is a one bedroom, one bath, condominium with family room and kitchen. The condominium provides a pool for guests and comes with electronic access to the private beach nearby. 3. Guests The maximum occupancy is a total of 4. Guests agree to abide by occupancy limits. If limits are exceeded, owners shall have the absolute right to cancel this agreement and remove guests from the premises. In the event this agreement is cancelled due to exceeding occupancy limits as set forth, any monies paid by Guest will be forfeited by Guest. **Pets are not permitted without prior approval. 4. Rental period and fees The rental period is between xxxxx thru xxxxx. The rental fee is $xxxx, per month. The full payment is due on the 1st of the month. Reservations made include lodging, all utilities, and use of amenities. Towels, linens, and certain cleaning supplies are provided. Food, beverages, toiletries, and other personal items are not provided. Cleaning Fee: There is a $125 cleaning fee added to each reservation per month. This fee includes full cleaning, sanitization, washing of linens, disposing of trash, and resetting the property like new. Additional cleanings can be purchased at the same rate. Security Deposit: One month rent will be the security deposit. Guests are responsible for the care of the premises, appliances, and furnishings and for any and all damage caused by Guest or anyone associated with Guest. Guest agrees that Owners may deduct charges for any damages and excess cleaning fees and any excessive applicable utility charges. The security deposit will be returned to the guest within three busness days of guests departure. Cancellation: The owner will honor cancellation requests if they are made sixty (60) days in advance. 5. Termination The Landlord has the right to inspect the premises with prior notice as stated with the applicable State laws. Should the Guest violate any of the terms of this agreement, the rental period shall be terminated immediately in accordance with State law. The Guests waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Guests shall vacate the premises at the expiration time and date of this agreement. 6. Phone Calls Complimentary High-Speed Internet service is provided on the premises. Phone service is not provided. 7. Maintenance and Repairs The Guests shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. The Guests shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Owner as being immediately habitable by the next Guests. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition. The Guests agree that the Owner shall deduct costs of said services from the security deposit prior to refund if Guests cause damage to the premises or its furnishings. 8. Trash The Guests shall dispose of all waste material generated during the rental period. Trash can be disposed of at a garbage collection dumpster on premises. 9. Pets Pets are not permitted without prior approval. 10. Subletting The Guest shall not have the right to sublet the property. 11. Quiet Enjoyment The Guests shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Guests shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Guests shall then immediately vacate the premises. 12. Smoking Smoking or vaping is not allowed inside the home. 13. Essentials Owners shall provide the following to the Guests: Towels, linens, cups, knives, forks, spoons, dishes, pots, pans, coffee maker, microwave, stove, refrigerator, certain cleaning supplies, starter package of toilet paper and paper towels. 14. Landlord's Liability The Guest and Guests' guests shall hereby indemnify and hold harmless the Owners against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Guests expressly recognize that any insurance for property damage or loss which the Owner may maintain on the property does not cover the personal property of Guests, and that Guests should purchase their own insurance if such coverage is desired. 15. Attorney's Fees Guests agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Owner enforcing this agreement. 16. Use of Property Guests expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guests do not intend to make the property a residence or household. 18. Shortened Stays and Conditions There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions. 19. Showings If the property should go on the MARKET FOR SALE, it may be shown to qualified buyers during the Guest's stay. Every effort will be made to schedule the showing at a convenient time and not interrupt the Guest's term. Guest shall allow reasonable viewings of the home between 9 am and 8 PM whether they may be present or not. 20. Firearms Only legally owned and permitted firearms shall be allowed on the premises according to State and local laws. 21. Fireworks Guest agrees that Fireworks and other hazardous materials shall not be used in or around the property. 22. Illegal Use Guest shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits. 23. Fire Alarms The property has fire alarms, the Guest must notify the Owner without delay if a fire alarm "chirps" or has a low battery condition. 24. Possessions Valuable items left behind by Guest will be held for the Guest and every reasonable effort will be made to contact the Guest for return. If items are not claimed for longer than 6 months they shall become the property of the Owner. The Owner shall not be held liable for condition of said items. 25. Cable TV Cable TV is provided and service level has been chosen by the Owner. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service. Discuss with owner any special requests. 26. Internet High speed wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service. 27.
