FIRE SAFETY & DECK PROTECTION To protect the structural integrity of the home and prevent fire hazards: NO FIRE PITS: Open-flame fire pits (wood, charcoal, or propane) are strictly prohibited anywhere on the premises. GRILL RESTRICTIONS: Use of BBQ grills (charcoal, gas, or pellet) is STRICTLY PROHIBITED on the elevated wood deck. Grills must only be used on the designated concrete patio at a safe distance from the house. DAMAGE: Any damage to the deck (charring, melting, or grease staining) is the sole financial responsibility of the Tenant. 3. UTILITIES, OCCUPANCY & COMMERCIAL USE UTILITIES: Tenant must transfer all accounts (water, electric, gas, waste) into their name within ten (10) days of the lease start date. OCCUPANCY: Premises shall be occupied solely by individuals listed on this Lease. NO COMMERCIAL USE: Conducting any business, trade, or commercial activity (including daycare or car repair) is prohibited. Short-term rentals (Airbnb/VRBO) or "rental arbitrage" are a material breach of this lease. 4. SMOKING & VAPING POLICY (STRICTLY ENFORCED) PROHIBITION: Smoking of any kind is strictly prohibited inside the residence, including tobacco, marijuana, or electronic cigarettes (vaping). FINES: Violation results in an immediate $250.00 fine per occurrence. REMEDIATION: Tenant is responsible for all costs for professional cleaning, ozone treatments, and repainting required to restore the premises. 5. PARKING & HOA COMPLIANCE PARKING: Tenant and guests must utilize the driveway and garage only. Street parking is strictly prohibited. HOA: Tenant agrees to abide by all Cherry Creek HOA regulations. Any HOA fines (lawn, trash cans, etc.) shall be paid by Tenant as "Additional Rent" within 5 days. 6. HVAC, APPLIANCE & PEST MAINTENANCE HVAC FILTERS: Tenant shall change HVAC air filters every thirty (30) days. Damage resulting from failure to change filters or extreme temperature settings (below 68 F in summer/above 78 F in winter) is the Tenant's financial responsibility. CONSUMABLES: Tenant is responsible for replacing refrigerator water filters, light bulbs, and smoke detector batteries. Service calls found to be "user error" or due to dirty filters will be billed to the Tenant. PESTS: Landlord certifies the home is pest-free at move-in. After 14 days, Tenant is responsible for all pest control costs (bedbugs, ants, roaches). 7. PLUMBING, MOLD & ALTERATIONS PLUMBING: No "flushable" wipes, feminine products, or grease down drains. Clogs caused by misuse are cleared at Tenant's expense. MOLD CONTROL: Tenant must run bathroom fans during/after showers and report leaks immediately. Tenant is liable for mold damage caused by poor ventilation. ALTERATIONS: No structural changes, painting, or satellite dishes attached to the roof/siding are permitted. 8. PET POLICY & UNAUTHORIZED PETS LIMITS: Max of two (2) pets (cats/dogs), not to exceed 25 lbs at maturity. FEES: One-time non-refundable fee of $150.00 per pet upon signing. PET RENT: $30.00/month per pet (small/medium) or $45.00 for large dogs (if approved). UNAUTHORIZED PETS: Finding an unregistered pet results in an immediate $150.00 fine, the non-refundable fee, and back-dated pet rent. CLEANING: Professional carpet cleaning/deodorizing receipt is mandatory upon move-out. 9. GAZEBO & OUTDOOR ACCESSORIES PROTECTION: Tenant must secure or remove gazebo curtains/netting during high winds, severe storms, or heavy snow. AS-IS: Gazebo curtains and netting are provided as a courtesy. Landlord is not obligated to repair/replace these due to wear and tear or misuse. 10. LIABILITY & INDEMNIFICATION (HOLD HARMLESS) HOLD HARMLESS: Landlord is not liable for any injury to Tenant or guests inside or outside the property (including deck/gazebo). Tenant agrees to defend Landlord from all claims arising from Tenant's use. INSURANCE: Mandatory. Tenant must maintain a policy with a minimum of $300,000 liability, naming Landlord as an "Interested Party." 11. LEGAL, ABANDONMENT & CRIME CRIME-FREE: Any criminal or drug-related activity by Tenant or guests is cause for immediate termination. ABANDONMENT: If Tenant is absent for 15 days while rent is unpaid, Landlord may consider the property abandoned per NC Law. LEGAL FEES: Tenant is responsible for all attorney fees and court costs incurred by Landlord to enforce this Lease or initiate eviction. 12. RIGHT OF ENTRY & LOCKOUTS ENTRY: Landlord may enter with 24 hours' notice (except emergencies). LOCKOUTS: Landlord does not provide lockout services. Tenant must contact a locksmith at their own expense.
