Lease Term: The lease term shall be for a period of twelve (12) consecutive months, commencing on the agreed-upon commencement date and terminating on the agreed-upon expiration date, unless the Lease is otherwise terminated in accordance with its terms or applicable federal, state, or local law. 2. Monthly Rent: Tenant shall pay the full monthly rent in advance on or before the rent due date specified in this Lease. Rent shall be considered paid only when the full amount due has been received by Landlord or Landlord's designated payment service. 3. Security Deposit: A security deposit in the amount specified in this Lease shall be paid by Tenant before possession of the premises is delivered. The security deposit shall be held, applied, and returned in accordance with applicable federal, state, and local law. The security deposit may be used for lawful purposes, including unpaid rent, permitted charges, damage beyond ordinary wear and tear, or other amounts for which Tenant is legally responsible. 4. Grace Period and Late Payment: A grace period of five (5) calendar days shall apply to each monthly rent payment. The grace period does not change the contractual rent due date. If the full monthly rent is not received by the end of the fifth (5th) calendar day following the rent due date, the rent shall be considered delinquent. A one-time late fee of $50.00, or such other amount as may be permitted by applicable law, shall then be assessed. In addition to the applicable late fee, a daily late charge of $10.00 per day may accrue for each additional day that the rent remains unpaid, subject to any limitations imposed by applicable law. Late fees and daily charges shall be considered additional rent or other lawful charges only to the extent permitted by applicable law. Acceptance of late rent, partial payment, or late fees by Landlord shall not constitute a waiver of Landlord's rights or remedies under this Lease or applicable law. 5. Utilities and Services: The parties' respective responsibilities for utilities and services shall be as specified in this Lease. Tenant shall be responsible for timely establishing and maintaining any utility accounts designated as Tenant's responsibility and shall pay all charges associated with those services when due. Landlord shall remain responsible for utilities and services expressly designated as Landlord's responsibility, subject to the terms of this Lease. 6. Occupancy and Authorized Residents: The premises shall be occupied only by the individuals identified as authorized occupants in this Lease. No additional person may establish residency at the premises without Landlord's prior written approval, except as otherwise required or permitted by applicable law. Tenant shall not assign the Lease, sublease the premises, or permit another person to establish permanent residency without Landlord's prior written consent, except where prohibited by law. 7. Maintenance and Cleanliness: Tenant shall maintain the premises in a reasonably clean, sanitary, and orderly condition and shall use the premises in a manner that prevents unnecessary damage or deterioration. Tenant shall promptly notify Landlord of any condition requiring maintenance or repair, including water leaks, plumbing problems, electrical issues, heating or cooling problems, pest concerns, structural damage, or other conditions that could cause additional damage to the premises. Tenant shall not intentionally, negligently, or recklessly damage the premises or permit any occupant or guest to do so. 8. Repairs, Alterations, and Improvements: Tenant shall not make structural changes, significant alterations, renovations, installations, or improvements to the premises without Landlord's prior written consent. Tenant shall not install permanent fixtures, change existing fixtures, paint, modify flooring, install satellite equipment, alter electrical or plumbing systems, or make other material changes to the premises without written authorization from Landlord. Tenant shall not change, add, or replace locks or security devices without Landlord's prior written approval, except where otherwise permitted by applicable law. 9. Smoking and Vaping: Smoking and vaping are prohibited inside the premises and in any areas designated as non-smoking areas by Landlord. Tenant shall ensure that all occupants and guests comply with this requirement. If smoking or vaping is permitted in designated outdoor areas, Tenant shall comply with all posted property rules and shall properly dispose of all smoking-related materials. Tenant shall be responsible for any cleaning, deodorizing, repair, or other lawful costs resulting from smoking or vaping in prohibited areas. 10. Landlord's Right of Entry Landlord, Landlord's agents, contractors, or authorized representatives may enter the premises for lawful purposes, including inspections, maintenance, repairs, improvements, showing the premises to prospective tenants, purchasers, lenders, or contractors, or addressing suspected violations of this Lease. Except in an emergency or where otherwise permitted by law, Landlord shall provide Tenant with the notice required by applicable law before entering the premises. In the event of an emergency or circumstances requiring immediate attention to protect persons or property, Landlord may enter the premises without prior notice to the extent permitted by law. 11. Renter's Insurance Tenant is encouraged to maintain renter's insurance covering Tenant's personal property and personal liability. If renter's insurance is required under this Lease, Tenant shall maintain coverage throughout the entire lease term in the minimum amount specified by Landlord and shall provide proof of coverage upon request. Landlord's insurance does not provide coverage for Tenant's personal belongings, furniture, electronics, vehicles, or other personal property. 12. Damage and Tenant Responsibility Tenant shall be responsible for the cost of repairing damage to the premises caused by Tenant, any occupant, guest, invitee, or person under Tenant's control, to the extent permitted by law. Tenant shall not be responsible for ordinary wear and tear or for damage caused by circumstances for which Tenant is not legally responsible. Tenant shall promptly notify Landlord of any damage, loss, or condition that could result in additional damage to the premises. 13. Early Termination This is a fixed-term lease and is intended to remain in effect through the expiration date stated in the Lease. Tenant may request early termination by providing Landlord with at least ninety (90) days' written notice. Early termination shall be effective only upon Landlord's written approval and satisfaction of any applicable early-termination requirements set forth in this Lease and permitted by law. Landlord may terminate the Lease before its scheduled expiration only as permitted by this Lease and applicable law, including circumstances involving Tenant's material breach, nonpayment of rent, unlawful conduct, or other legally recognized grounds for termination. Nothing in this section limits any rights either party may have to terminate the Lease under applicable law. 14. Move-Out and Surrender of Premises: Upon expiration or lawful termination of the Lease, Tenant shall vacate the premises and return possession to Landlord in the condition required by this Lease and applicable law. Tenant shall: - Remove all personal belongings and trash; - Return all keys, access cards, remotes, garage openers, and other property belonging to Landlord; - Leave appliances and fixtures in the condition in which they were provided, ordinary wear and tear excepted; - Repair or pay for damage for which Tenant is legally responsible; - Provide a forwarding address for purposes of security-deposit correspondence; and - Leave the premises reasonably clean and free of personal property. Failure to properly surrender the premises may result in charges or other remedies to the extent permitted by applicable law. 15. Default and Remedies Tenant shall be considered in default if Tenant fails to comply with a material obligation under this Lease, including, but not limited to: Failure to pay rent or other lawful amounts when due; Repeated late payment of rent; Unauthorized occupants or unauthorized subleasing; Material damage to the premises; Unauthorized alterations or improvements; Violation of smoking or property rules; Unlawful activity on or associated with the premises; or Other material violations of this Lease. If Tenant defaults, Landlord may provide any notice and opportunity to cure required by applicable law and may pursue any lawful remedy available under the Lease or applicable law. Depending on the nature of the default, available remedies may include recovery of unpaid rent or other lawful charges, repair costs, termination of the tenancy, recovery of possession, and eviction proceedings. Landlord shall not be required to accept a partial payment as a cure of a default unless required by applicable law or agreed to in writing. 16. Compliance With Applicable Law: All provisions of this Lease shall be interpreted and enforced in accordance with applicable federal, state, and local laws and regulations. If any provision of this Lease conflicts with a mandatory provision of applicable law, the applicable law shall control to the extent of the conflict, and the remaining provisions shall remain in effect.
