TERM OF LEASE Minimum of 12 month lease required. 2. RENT Tenant shall pay a rent due on the 1st of each month. Rent payments shall be made via Zillow. A grace period of 3 days shall apply before a late fee is incurred. If rent is not received by the 4th day of the month, a $150 late fee will incur. 3. SECURITY DEPOSIT Tenant shall pay a security deposit of one month's rent prior to move-in. The landlord must return the tenant's security deposit within 15 days after the tenant moves out, if no deductions are made. If there are deductions for damages or other charges, the landlord must provide a written notice to the tenant within 30 days of the tenant vacating the property, detailing the amount being withheld and the reasons for the deductions. If the tenant disputes any deductions, they have 15 days from receiving the notice to respond. If no dispute is raised, the remaining balance of the deposit must be returned within 30 days of the notice. If the tenant does dispute the deductions, the landlord must return the undisputed portion of the deposit within 30 days, and resolve the disputed amount according to the lease terms. 4. UTILITIES & HOA FEES Tenant is responsible for all utilities, including water, electricity, trash, and internet. HOA fees will be covered by the Landlord. Renters will have access to the Holley by the Sea Community Center and Amenities. 5. MAINTENANCE & REPAIRS Tenant is responsible for basic upkeep, including lawn care, changing air filters, and minor repairs. The Landlord is responsible for major repairs and ensuring the property remains habitable, including working plumbing, electricity, and heating. Non-emergency repairs must be reported to the landlord within 7 days. Landlord may enter the premises for repairs, inspections, or emergencies with at least 24 hours' notice, except in cases of emergency. 6. ANNUAL WALK THROUGH The Landlord reserves the right to conduct an annual walk-through of the property to assess its condition and ensure compliance with the lease terms. The Landlord and Tenant will work together to schedule the inspection at a mutually convenient time. 7. USE OF PREMISES & PARKING Tenant shall use the premises as a residential dwelling only. Smoking is strictly prohibited inside the unit. Any cleaning or repairs required due to smoking inside will be the responsibility of the renter. The property includes two garage spaces and 4 driveway spaces. The HOA prohibits vehicles from being parked in the grass. 8. PET POLICY Pets are allowed at the discretion of the landlord. 8. EVICTION POLICY If the Tenant fails to pay rent on time, the Landlord may issue a 3-day notice to pay or vacate. If payment is not received within this period, the Landlord may proceed with filing for eviction in court. If the Tenant violates the lease terms, such as having unauthorized occupants or failing to maintain the property, the Landlord must issue a 7-day notice to cure or vacate. If the Tenant does not resolve the issue within this time, the eviction process may begin. In cases of illegal activity, including drug use, property damage, or threats to safety, the Landlord may issue a 7-day unconditional quit notice, requiring the Tenant to vacate immediately with no option to remedy the situation. If the Tenant does not vacate by the end of the notice period, eviction proceedings may commence. 9. SUBLEASING & SHORT-TERM RENTALS Tenant may not sublease the property under any circumstances. If the Tenant wishes to vacate before the lease term ends, any new occupant must go through the Landlord for approval and sign a new lease agreement. Tenant shall not use the property for short-term rentals (e.g., Airbnb, VRBO). 10. TERMINATION & MOVE-OUT Tenant must provide written notice before vacating per the terms of lease above. When moving out, the premises must be left in the same condition as at move-in, except for normal wear and tear. If the condition of the premises exceeds normal wear and tear the cost for repairs and/or cleaning will be dedicated from the security deposit per the terms above. 11. GOVERNING LAW This Agreement shall be governed by the laws of the State of Florida.
