Dish & Direct TV Installation: Installation of Dish or Direct TV requires written approval from both the owner and the HOA 30 days prior to installation. All equipment, wiring, and boxes must be removed before vacating the property and confirmed during the move-out inspection. Section: Parking 1. Designated Parking: The Tenant is allocated one (1) marked carport space for parking. This designated space is for the exclusive use of the Tenant. Vehicles MUST be parked facing in (NO reverse in overnight parking permitted.) 2. Additional Vehicle Parking: Any additional vehicles belonging to the Tenant or their guests must be parked only in open, uncovered, and unmarked parking spaces within the designated community parking areas, subject to availability. Parking in any other marked or reserved spaces is strictly prohibited. 3. Prohibited Vehicles: The parking of large vehicles, including but not limited to, recreational vehicles (RVs), fifth-wheel trailers, semi-tractor trailers, commercial trucks, or any other oversized vehicles, is strictly prohibited on the Premises or within the community parking areas at any time. 4. Vehicle Registration Information: Prior to the commencement of the lease and for the duration of the tenancy, the Tenant must provide the Owner with current and accurate vehicle registration (license plate number, make, model, and year) for all vehicles regularly parked at the Premises. 5. Updates to Vehicle Information: Any changes or updates to vehicle registration information, including the addition or removal of vehicles, must be provided to the Owner in writing within three (3) business days of such change. 6. Parking Violations: Tenant understands that any violation of these parking terms may result in fines, towing of the vehicle at the Tenant's sole expense, and/or may be considered a material breach of this Lease Agreement, subject to the remedies outlined in the "Termination Due to Tenant Non-Compliance" section. The Owner is not responsible for any damage or theft to vehicles parked on the Premises. Lease Termination Section: Termination Due to Tenant Non-Compliance (Add to your "Lease Termination" or "Default" section) 1. Termination for Material Non-Compliance (Remediable Breaches): "Should Tenant fail to comply with any material provision of this Lease Agreement, other than non-payment of rent, the Owner may deliver a written notice to the Tenant specifying the acts and omissions constituting the breach. The Lease Agreement shall terminate on a date not less than ten (10) days after receipt of such notice if the breach is not remedied by the Tenant within that ten (10) day period. If the breach is remediable by repair or the payment of damages or otherwise, and the Tenant adequately remedies the breach before the date specified in the notice, the Lease Agreement shall not terminate." 2. Termination for Non-Payment of Rent: "If rent is unpaid when due, and the Tenant fails to pay the rent within five (5) days after written notice by the Owner of non-payment and the Owner's intention to terminate the Lease Agreement if the rent is not paid within that period, the Owner may terminate the Lease Agreement and initiate eviction proceedings." 3. Termination for Material and Irreparable Non-Compliance: "Notwithstanding any other provision herein, if there is a non-compliance by the Tenant that is both material and irreparable, including but not limited to, the unlawful discharge of a weapon, prostitution, unlawful manufacturing, sale, use, storage, transfer, or possession of a controlled substance (as defined by A.R.S. 13-3451), the infliction of serious bodily harm, or any other activity on the Premises that is illegal under federal or state law and materially affects health and safety, the Owner may deliver a written notice to the Tenant specifying the acts and omissions constituting the breach. The Lease Agreement shall terminate immediately upon receipt of such notice, and no opportunity to cure the breach will be provided. Tenant acknowledges that such actions are a severe breach of this Lease and may result in immediate eviction." 4. Repetitive Violations: "If the Tenant engages in repetitive conduct that is the subject of notices under this section, after two (2) incidents of the same type documented by the Owner within a twelve (12) month period, or after receipt by the Owner of two (2) written complaints from other tenants about the repetitive conduct within a twelve (12) month period, the Owner may deliver a written notice to the Tenant specifying the conduct and the documentation, advising the Tenant that on documentation of the next incident of repetitive conduct of any type, the Lease Agreement will terminate upon that next incident without further opportunity to cure. If the Tenant has been involved in three (3) or more documented incidents of conduct of any type described in this section within a twelve (12) month period, the Owner may deliver a written notice to the Tenant specifying the conduct and the documentation and advising the Tenant that the Lease Agreement will terminate upon the next incident." Section: Security Deposit (Review and adjust your existing security deposit clause) "On termination of the tenancy, property or money held by the Owner as prepaid rent and security may be applied to the payment of all rent, and, subject to the Owner's duty to mitigate, all charges as specified in this Lease Agreement, or as provided by Arizona law, including the amount of damages which the Owner has suffered by reason of the Tenant's noncompliance with this Lease or A.R.S.
