LEASE TERMS AGREEMENT This Lease Terms Agreement ("Agreement") is entered into on the date of signing ("Effective Date") by and between: Landlord: James Alexander Gillman and Tenant(s): Collectively referred to as the "Parties." 1. PROPERTY The Landlord hereby leases to Tenant(s) the residential property located at: 22 Ten Lake Dr., Defuniak Springs, FL 32433 ("Premises") The Premises shall be used solely as a private residence. 2. LEASE TERM The lease term shall be for one (1) year beginning on the date of signing and ending one (1) year thereafter unless otherwise renewed or terminated in accordance with this Agreement. Tenant agrees to a minimum occupancy period of two (2) years, unless otherwise agreed to in writing by the Landlord. 3. RENT Monthly Rent: $2,500.00 Due Date: 15th day of each month Grace Period: 7 days Late Fees: $50.00 late fee if rent is not received by the 15th. An additional $100.00 late fee if rent remains unpaid after the 7-day grace period. Failure to Pay Rent: If Tenant becomes more than thirty (30) days delinquent on rent, such failure shall constitute an immediate violation of this Lease Agreement and shall be considered grounds for eviction, subject to all applicable Florida landlord-tenant laws and required legal notice procedures. All rent payments shall be made in a manner agreed upon by both Parties. 4. SECURITY DEPOSIT Tenant shall pay a $1,000.00 security deposit prior to move-in. PROPERTY INSPECTIONS Landlord reserves the right to conduct property inspections every three (3) months, provided at least one (1) week's notice is given to Tenant. 10. HOA / LAKE ACCESS An annual $100.00 HOA fee is required for lake fishing access. Payment of this fee is the responsibility of the Tenant if fishing access is desired. 11. DEFAULT Tenant shall be considered in default of this Agreement if Tenant: Fails to pay rent when due, Violates any material term of this Agreement, Causes substantial damage to the Premises, Uses the Premises for unlawful purposes, or Fails to comply with applicable laws or HOA requirements. Upon default, Landlord may exercise all rights and remedies available under Florida law, including termination of tenancy and eviction proceedings. 12. EVICTION NOTICE AND LEGAL COMPLIANCE Nothing in this Agreement shall waive or replace any notice requirements required under Florida Statutes Chapter 83. Landlord agrees to provide all legally required notices prior to initiating eviction proceedings. Tenant acknowledges that failure to cure lease violations within the legally required timeframe may result in termination of tenancy. 13. ATTORNEY'S FEES AND COSTS In the event of any legal action arising out of this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees, court costs, and related expenses as permitted by Florida law. 14. LANDLORD PROTECTION CLAUSES 14.1 Abandonment: If Tenant abandons the Premises, Landlord may take possession and re-rent without notice, and Tenant shall remain liable for unpaid rent and damages. 14.2 Unauthorized Occupants: Any person residing in the Premises not listed in this Agreement is considered an unauthorized occupant. Tenant will be in violation and may be subject to immediate termination of tenancy. 14.3 Holdover Tenants: If Tenant remains in the Premises after lease expiration without Landlord's written consent, rent shall automatically increase by 150% of the current monthly rent until possession is surrendered. 14.4 Landlord Entry Rights: Landlord may enter the Premises in accordance with Florida law for the purpose of inspection, repairs, maintenance, or showing the property to prospective tenants or buyers, with reasonable notice to Tenant unless an emergency exists. 14.5 Compliance with Laws: Tenant shall comply with all federal, state, and local laws, ordinances, and HOA regulations.
