As the weather gets cooler, enjoy the fireplace in the open concept living room. The pool is needing repaired. Due to limited contractors and parts, Landlord is still waiting on repairs. New skimmers are needed and pool needs re-plastered only. Parts have been ordered. Pool is functioning and can be used. Parked Vehicles: Vehicles of any kind should not be parked on any area other than the driveway or the designated street area. Vehicles leaking oil, gasoline or any other fluid are to be removed from the premises until repaired. Tenant is responsible for cleaning any markings, stains or damages caused by leaks or disorders from vehicles parked on premises by tenants or their guests. Vehicles in obvious disrepair, inoperative, unregistered or expired registration are not to be parked on or in front of the property and will be towed at Tenant's expense. Yard Maintenance: Tenant is responsible for regular maintenance both the back and front yards. Maintenance in the backyard includes removing dust, dirt, leaves and other debris by lightly rinsing with a hose weekly or as needed and/or by using a flexible lawn rake, a broom with stiff bristles or a stiff brush made for synthetic turf care and landscaping to ensure lawn stays clean and odor free. The level of maintenance will be required more often with high traffic, approved pets or during seasons when trees and shrubs lose their leaves or blooms. If approved for pets, remove pet droppings from turf by using a preferred method for removing solid pet waste and rinsing the area with a hose at least one time each week or more often as needed. Pool: Tenant is fully responsible for any and all claims regarding the pool and Landlord/Owner is indemnified against any liability and/or responsibility. Tenants should discuss an insurance rider policy with their insurance company to discuss additional liability insurance in case a loss or death results in the swimming pool. Tenant(s) agree to maintain said swimming pool and surrounding improvements in good condition and repair, in full compliance with said ordinances throughout the term of this lease agreement. Tenants further warrant and represent that they will make arrangements with a pool maintenance company to maintain said swimming pool in compliance with said ordinances. Owner(s) acknowledge that the Tenant will be fully responsible for the swimming pool upon entering into this leasing agreement and, as an additional inducement to the Owner, the undersigned tenant(s) agrees to indemnify and hold harmless the Landlord and any employees/contractors/representatives against any and all claims for injuries or damages asserted by any person against Landlord, agents or employees as a result of, related to, arising out of, or caused by the presence of said swimming pool on the subject property without regard to whether or not said swimming pool is in compliance with said ordinances. Tenant(s) will be solely responsible for all injuries, loss, and/or negligence, such as Tenant leaving a gate to the swimming pool area open and unlocked, for example. Pets: Only small common domesticated pets such as dogs, cats, fish are allowed. No more than a total of two dogs or two cats, or a combination of both. All other types of pets will have to obtain approval and meet city codes and HOA regulations. Pets in the home should only be the tenant's pets. All pets must wear identification collars or tags, and provide evidence of current vaccinations. Tenants should agree to keep their pets under control at all times and clean up after their pets, both inside and outside. Tenants should also agree not to leave pets outdoors or unsupervised for an unreasonable period of time, to keep pets in appropriate, contained areas, and not a nuisance to neighbors. Tenants will be solely responsible if the tenant's pet causes injury to other persons, guests/non-guests on the property and damage to the property caused by the pet. A pet fee of $250 will be applied per pet. An additional deposit will be required for pets over 60 lbs and will require approval by the Landlord. Landlord(s) has the right to change any and all terms within the pet policy/agreement at any time during the lease period. Landlord has the right to ask the tenant to remove the pet from the property or terminate the tenancy in the event of serious or repeated violations of the agreement. This is in addition to any terms listed in section 9 of the Lease Agreement. Miscellaneous: Tenant to have all carpets and home professionally cleaned and provide receipts at move-out. Walls need to be repainted or touched up if beyond normal wear. The HVAC filters should be replaced every 30 days. Failure to properly maintain the HVAC system may result in possible fees due to lack of care. If any smoking on the premises causes damages to the property, then the tenant will lose their security deposit and additional fees may be charged for remediation.
