Lease Term This Lease shall begin on [Start Date] and end on [End Date], unless terminated earlier in accordance with this Agreement and applicable Texas law. 2. Care, Use, and Condition of Premises Tenant shall maintain the Premises in a clean, orderly, sanitary, and well-kept condition at all times. Tenant agrees to exercise reasonable care to prevent damage, deterioration, or unsafe conditions. Tenant shall be financially responsible for any damage to the Premises, fixtures, appliances, flooring, walls, doors, windows, plumbing, HVAC system, or landscaping caused by Tenant, occupants, guests, or invitees, excluding normal wear and tear as defined under Texas law. Tenant shall immediately notify Landlord in writing of any condition that may cause damage or require repair. Failure to timely report issues that result in additional damage shall make Tenant responsible for the resulting costs. Utilities and Services (Tenant Responsibility) Tenant shall be solely responsible for arranging, maintaining, and paying for all utilities and services used at the Premises during the lease term, including but not limited to: Electricity Water Propane All utility accounts shall be maintained in Tenant's name throughout the lease term. Any interruption of service due to nonpayment shall constitute a lease violation. 4. Propane Responsibility Tenant shall be fully responsible for monitoring propane levels and arranging and paying for all propane refills required for Tenant's use during the lease term. Landlord shall not be responsible for propane depletion, outages, damage to appliances caused by empty tanks, or service interruptions due to insufficient propane. At move-out, propane levels must be returned to the same level as documented at move-in, or Tenant shall reimburse Landlord for the full cost of refilling plus an administrative fee if applicable. 5. HVAC System and Air Filter Replacement Tenant shall be responsible for the routine maintenance of the HVAC system, including replacing HVAC air filters at least every 30 60 days (or more frequently if required due to pets, allergies, or usage). Tenant must use filters of the correct size and rating recommended for the system. Failure to replace air filters resulting in reduced efficiency, system damage, coil freezing, or mechanical failure shall be considered Tenant-caused damage, and Tenant shall be liable for all related repair or replacement costs. 6. Pest Control and Infestation Responsibility Tenant shall maintain the Premises in a manner that prevents pest infestations, including proper food storage, cleanliness, trash disposal, and routine housekeeping. Tenant shall be responsible for any pest infestation (including insects, rodents, or other vermin) that arises during the lease term, except where infestation is proven to be pre-existing and documented at move-in. At move-out, Tenant shall: Ensure the Premises is free of pests; and Pay for professional pest control treatment, if required by Landlord due to infestation, sanitation issues, or evidence of pests. Move-Out Condition and Cleaning Upon move-out, Tenant shall surrender the Premises in substantially the same condition as received, except for normal wear and tear, and shall: Remove all personal property and trash Professionally clean the Premises if required by Landlord Restore propane levels as required Ensure HVAC filters are clean and properly installed Ensure the Premises is pest-free Failure to comply may result in deductions from the security deposit in accordance with the Texas Property Code. 8. Compliance With Texas Law This Lease shall be governed by and construed in accordance with the laws of the State of Texas, including the Texas Property Code.
