Terms: Tenant agrees to rent this dwelling on a 12 month basis. Tenant agrees to pay in advance $1500.00 per month on the first day of each month. Payments: All monthly payments are to be made by check, money order, or cash. All payments are to be made payable to Brent Crider. A late fee of $75.00 shall be added and due for any rent made after the 9th of the month. Any dishonored check shall be treated as unpaid rent, and subject to an additional fee of $100.00. Any fees incurred due to processing insufficient funds by landlord will be passed on to tenant. Security deposit: The amount of $1500.00 paid as a security deposit shall be refunded to Tenant within 30 days after the premises have been completely vacated or change of ownership less any amount to Owner; (a) any unpaid rent, (b) cleaning costs, (c) key replacement costs, (d) cost of repair of damages to premises and or common areas above ordinary wear and tear, (e) any other amount legally allowable under the terms of this agreement. A written accounting of said charges shall be presented to Tenant. If deposit does not cover such costs and damages, the Tenant shall immediately pay said additional costs for damages to owner. Utilities: Owner agrees to pay water. Tenant is responsible for any gas, electric, cable, internet, or dish service of their choice. Approval by Owner must be made prior to installation of such service. Tenant is responsible for all removal and costs in disconnecting such services. Occupants: Guest(s) staying over 15 days without written consent of Owner shall be considered a breach of this agreement. Pets: No animal, fowl, fish, reptile, and/or pet of any kind shall be kept on or about the premises for any amount of time. Noise: Tenant agrees not to cause or allow any noise or activity on the premises which might disturb the peace and quiet of another neighbor including the Owner. Said noise and/or activity shall be a breach of this agreement. Parking: Street parking is available for Resident. Resident must follow all ordinances of the Town of Highland. Parking in front of mailboxes is prohibited. Conditions of Premises: Tenant agrees to keep the premises and all items in good order and good condition and to immediately pay for costs to repair and/or replace and portion of the above damaged by Tenant, their guests, and/or invitees, except as provided by law. At the termination of this Agreement, all above items in this provision shall be returned to Owner in clean, working condition except for reasonable wear and tear. It is agreed that all dirt, holes, tears, burns, and stains of any size or amount on walls, floors, window treatments, fixtures, and/or any part of the premises does not constitute reasonable wear and tear. Tenant shall not paint, wallpaper, alter, or redecorate, change or install locks, install antenna or other equipment, screws, fastening devices, large nails, or adhesive material, place signs, displays, or other exhibits on any portion of the premises without written consent of the Owner except as may be provided by law. Property Maintenance: Tenant shall deposit all garbage and waste in a clean and sanitary manner in the proper receptacles and shall cooperate in keeping the garbage/recycling area neat and clean. Tenant shall be responsible for disposing of items of such size and nature as not normally acceptable by garbage hauler. Tenant shall be responsible for keeping the kitchen, bathroom, and laundry room drains free of things that may tend to cause clogging. Tenant shall pay expenses and damage causes by stopping of waste pipes or overflow from shower, wash basin, and all sinks. Insurance: Tenant acknowledges that Owners insurance does not cover personal property damage caused by fire, theft, rain, Acts of God, Acts of Others, and/or any other causes, nor shall Owner be held liable for such loses. Tenant is hereby required to obtain their own insurance policy to cover any personal loses (Renters Insurance). Proof of such insurance must be in writing and submitted to Owner when this rental agreement commences. Right of Entry and Inspection: Owner may enter, inspect, and/or repair the premises at any time in case of emergency or suspected abandonment. Owner shall give 12 hours advance notice and may enter for the purpose of showing the premises to prospective renters, potential buyers, lenders, for smoke alarm inspections, and/or for normal inspections and repairs. Owner is permitted to make alterations, repairs, and maintenance that is in Owner's judgement. Termination: A 30 day written notice must be provided to terminate this agreement by either party. Where law requires "just cause", such just cause shall be stated on said notice. Should the Tenant hold over beyond termination date, the Tenant shall be liable for any additional rent and damages due to the loss of prospective new tenants or owner. Miscellaneous: Tenant, their guests are aware of NO SMOKING inside the premises and NO ILLEGAL DRUG ACTIVITY inside the premises or on the property itself. Owner will be responsible for lawn and snow maintenance. Tenant Confirms that two sets of keys were issued. (2 front door, 2 back door) These are to be returned upon termination of the lease. Tenant has use of the following: front entryway, backyard patio, West gated entrance. This agreement constitutes the entire agreement between Owner and Tenant. No oral agreements have been entered into, and all modifications or notices shall be in writing to be valid.
