This Residential Lease Agreement ("Lease") is entered into on _, 20_, by and between:
Landlord/Owner: ________
Mailing address: ________
Email: ____ Telephone: __
and
Tenant(s):
Landlord and Tenant agree as follows.
Premises
Landlord leases to Tenant the residential property located at:
2802 Ruth Evans Drive, __, North Carolina __
County: ____
The property is a 3-bedroom, 2-bathroom single-family house, together with its fixtures and any included appliances, grounds, parking areas, and improvements ("Premises").
The Premises may be used only as a private residence. No business involving customers, employees, inventory, hazardous materials, or increased traffic may operate there without Landlord's prior written consent.
Lease Term
The fixed term begins at a.m./p.m. on , 20, and ends at _ a.m./p.m. on , 20.
Tenant must surrender possession, remove all personal property, return all keys and access devices, and provide a forwarding address by the end of the term unless the parties sign a written renewal.
Holding over does not renew this Lease unless Landlord agrees in writing. If Landlord accepts a holdover tenancy without a written renewal, the tenancy will be month-to-month under the same provisions to the extent applicable, at monthly rent of \$_, subject to North Carolina law.
Rent
Monthly rent is $2,000, payable in advance on or before the first calendar day of each month, without demand, deduction, setoff, or counterclaim except where North Carolina law expressly provides otherwise.
Rent shall be paid to:
Payee: _________
Address or approved electronic method: ____
The first month's rent of $2,000 is due on or before , 20_.
Partial payment does not waive Landlord's right to collect the balance or pursue lawful remedies. Acceptance of rent after a breach does not waive any other breach unless Landlord agrees in a signed writing.
Late Fee and Returned Payments
If monthly rent is five calendar days or more late, counting the first late day as the day after rent was due, Tenant shall owe a one-time late fee of \$100, equal to 5% of monthly rent. No late fee may be charged more than once for the same late payment.
Tenant shall reimburse Landlord for any lawful bank charge actually incurred because a payment is returned or rejected, plus any fee independently authorized by applicable law.
The late-fee provision follows N.C. Gen. Stat. 42-46, which permits the greater of \$15 or 5% of monthly rent after the statutory waiting period. North Carolina General Assembly
Security Deposit
Tenant shall pay a security deposit of \$2,000 before receiving possession. It is not advance rent and may not be used by Tenant as the last month's rent.
Landlord shall hold the deposit in a qualifying trust account or provide a qualifying bond, and shall notify Tenant within 30 days after the term begins of the institution's name and address or the bonding company's name.
Deposit institution or bonding company: ____
Address: ________
The deposit may be applied only as North Carolina law permits, including unpaid rent, qualifying utility charges, damage beyond ordinary wear and tear, lawful damages from breach, qualifying reletting costs, removal and storage expenses, court costs, and fees authorized by law.
After termination and delivery of possession, Landlord shall provide the balance and written itemization within 30 days. If the claim cannot reasonably be determined within 30 days, Landlord may provide an interim accounting within 30 days and a final accounting within 60 days. Tenant shall provide a forwarding address.
North Carolina permits up to two months' rent as a deposit for a tenancy longer than month-to-month, requires protected custody and notice, and prohibits deductions for ordinary wear and tear. North Carolina General Assembly
Occupants and Guests
Only the following persons may reside at the Premises:
A guest staying more than seven consecutive nights or fourteen total nights in any six-month period requires Landlord's prior written consent, except where prohibited by law.
Tenant may not assign this Lease, sublease any portion of the Premises, list it as a short-term rental, or permit another person to establish residency without Landlord's prior written consent. Any approved adult resident may be required to complete screening and sign the Lease.
Each Tenant is jointly and severally liable for all rent, damage, and other obligations. Landlord may pursue any one Tenant for the entire lawful amount owed.
Utilities and Services
Tenant shall place the following services in Tenant's name by the beginning of the term and pay all related charges:
Electricity: ____
Water and sewer: ____
Natural gas or propane: __
Trash: ______
Internet, telephone, and cable: Tenant
Pest control: ___
Other: ______
Landlord shall pay: lawn mowing
Tenant shall prevent interruption of essential services and shall not allow utility charges associated with Tenant's occupancy to become a lien against the Premises.
Condition and Move-In Documentation
Tenant acknowledges having inspected the Premises or having had an opportunity to do so. Except as stated on the signed Move-In Condition Report, Tenant accepts the Premises in clean and habitable condition.
The parties shall complete and sign a written condition report with photographs before or promptly after possession. Tenant shall return any Landlord-provided report within five calendar days after receiving possession. This documentation does not waive either party's statutory rights or duties.
Tenant shall promptly report hidden damage, leaks, unsafe conditions, pest activity, malfunctioning smoke or carbon-monoxide alarms, and needed repairs in writing. Emergencies must be reported immediately by telephone, followed by written notice.
Landlord's Duties
Landlord shall comply with nonwaivable duties imposed by North Carolina law, including applicable building and housing codes; making repairs necessary to keep the Premises fit and habitable; keeping supplied facilities and appliances in good and safe working order after legally sufficient notice; and installing or maintaining required smoke and carbon-monoxide alarms.
Nothing in this Lease waives a duty or remedy that cannot lawfully be waived.
Tenant's Maintenance Duties
Tenant shall:
Keep the Premises clean, sanitary, ventilated, and reasonably safe.
Dispose of waste properly and prevent pest infestation.
Use plumbing, electrical, heating, cooling, appliances, and fixtures reasonably.
Replace ordinary consumables, including accessible light bulbs and HVAC filters, as reasonably needed.
Maintain reasonable heat during cold weather and take reasonable steps to prevent frozen pipes.
Keep sinks, toilets, tubs, and drains free of stoppages caused by Tenant, occupants, or guests.
Promptly give written notice of needed repairs, water intrusion, mold-like growth, unsafe conditions, and malfunctioning alarms.
Not disable, remove, or damage any smoke alarm, carbon-monoxide alarm, safety device, or security device.
Not deliberately or negligently damage the Premises.
Pay the actual and reasonable cost of damage or service calls caused by Tenant, an occupant, guest, pet, or invitee, excluding ordinary wear and tear.
Comply with lawful governmental requirements and any written community rules delivered to Tenant.
Tenant may not perform or authorize major repairs or deduct repair costs from rent unless Landlord agrees in writing or applicable law expressly authorizes it.
Alterations and Locks
Tenant may not paint, remodel, mount fixtures, install satellite equipment, alter landscaping, change locks, add security devices, or make other alterations without Landlord's prior written consent.
Any approved alteration becomes part of the Premises unless Landlord requires restoration. Tenant shall give Landlord working keys or access credentials for every approved lock or security device, subject to legal protections for victims of domestic violence, sexual assault, or stalking.
Landlord's Right of Entry
Landlord and Landlord's contractors or agents may enter at reasonable times for inspections, repairs, maintenance, pest treatment, code compliance, appraisals, insurance inspections, or to show the Premises to prospective tenants, purchasers, lenders, or contractors.
Except for emergencies, suspected abandonment, court authorization, or when impracticable, Landlord will give at least 24 hours' notice. Tenant shall not unreasonably deny access. Landlord may enter without prior notice when reasonably necessary to address an emergency or protect persons or property.
Rules and Prohibited Conduct
Tenant, occupants, guests, and invitees shall not:
Engage in unlawful activity at or near the Premises.
Create a nuisance or materially disturb neighbors.
Threaten or endanger any person.
Store hazardous, explosive, or highly flammable materials other than ordinary household quantities.
Discharge weapons unlawfully.
Tamper with utilities, meters, locks, alarms, or safety equipment.
Allow conditions that materially increase fire, casualty, or insurance risk.
Use grills, fire pits, pools, trampolines, or similar equipment without written consent where consent is reasonably required for safety or insurance compliance.
Smoke or vape inside the house, garage, or other enclosed structure.
Violation by an occupant, guest, or invitee is deemed a violation by Tenant to the extent permitted by law.
Pets and Assistance Animals
No animal may be kept at the Premises without Landlord's prior written approval, except an assistance animal entitled to accommodation under applicable law.
Approved pets: _________
Nonrefundable pet fee: \$
Monthly pet rent, if applicable: \$
Tenant is responsible for animal-related damage, waste, odors, fleas, injuries, nuisance, and other lawful charges. The pet fee does not limit Tenant's liability. Assistance animals are not pets, and no pet fee or pet rent will be charged for a qualifying assistance animal.
Insurance and Personal Property
Tenant shall maintain renters insurance throughout the term with at least \$100,000 in personal-liability coverage, unless prohibited by law, and shall provide proof upon reasonable request.
Landlord's insurance generally does not cover Tenant's personal property, relocation costs, or personal liability. Landlord is not an insurer of Tenant's property and is not responsible for loss except to the extent liability is imposed by law. Tenant should obtain coverage for theft, water loss, fire, weather, and other risks.
Casualty and Damage
Tenant shall immediately notify Landlord of fire, flooding, storm damage, significant leaks, or other casualty. Tenant may not remain in an area that governmental authorities or Landlord reasonably determine is unsafe.
Rights following casualty, including repair, rent obligations, and termination, shall be governed by this Lease and applicable law. Tenant remains liable for damage caused by Tenant, occupants, guests, invitees, or animals.
Default and Remedies
A default includes:
Failure to pay rent when due.
Material violation of this Lease.
Unauthorized occupants, animals, assignment, or subletting.
Material misrepresentation in a rental application.
Failure to maintain required utilities or insurance.
Unlawful activity or substantial nuisance.
Refusal of lawful access.
Abandonment of the Premises.
Upon default, Landlord may give any notice or demand required by this Lease or applicable law and pursue lawful remedies, including summary ejectment, recovery of possession, unpaid rent, actual damages, court costs, and authorized fees.
Landlord may charge only those complaint-filing, court-appearance, second-trial, attorney, collection, or other fees permitted by N.C. Gen. Stat. 42-46 or other applicable law, and only after the statutory conditions are satisfied. Landlord shall not use self-help eviction, unlawfully interrupt utilities, or exclude Tenant without legal process.
No notice requirement in this Lease eliminates a notice or judicial process required by law.
Early Move-Out and Reletting
Tenant remains responsible for rent and other lawful damages through the end of the term if Tenant vacates early without a legally protected basis or written release.
Landlord may take possession when legally permitted, attempt to relet the Premises, and apply amounts received from a replacement tenant as required by law. Tenant shall be responsible, to the extent permitted by law, for unpaid rent, actual damages, and reasonable qualifying costs of reletting, including a licensed broker's reasonable fee.
Nothing in this section limits rights available under laws protecting military personnel or victims of domestic violence, sexual assault, or stalking, or rights resulting from Landlord's statutory breach.
Abandonment and Personal Property
The Premises may be treated as abandoned only when permitted by law. Property left behind shall be handled under North Carolina law, including applicable notice, storage, disposal, or sale requirements.
Tenant shall not abandon the Premises without giving written notice and returning all keys and access devices. Returning keys does not by itself release Tenant from liability unless Landlord agrees in writing.
Renewal and Termination Notices
This Lease ends on the stated expiration date unless renewed in writing. Tenant shall give Landlord at least 60 days' written notice of Tenant's intention either to request renewal or vacate at the end of the term. This notice does not create a right to renewal.
If the tenancy becomes month-to-month, either party may terminate it by giving at least the notice required by North Carolina law. A longer notice period applies only if enforceable.
Notices
Routine notices shall be delivered personally, by first-class mail, or by email where legally permissible.
Notices to Landlord:
Name: ____________
Address: __________
Email: ____________
Notices to Tenant: the Premises and any additional address or email below:
Statutory notices shall be served in the manner required by law. Email alone is insufficient when the law requires another method.
Indemnity and Liability
To the extent permitted by law, Tenant shall indemnify Landlord from third-party claims, losses, and reasonable expenses caused by the negligent, reckless, or intentional conduct of Tenant, occupants, guests, invitees, or animals.
This provision does not release Landlord from liability for Landlord's negligence, willful misconduct, statutory duties, or other liability that cannot lawfully be waived.
No Waiver
Landlord's delay or failure to enforce a provision does not waive future enforcement. Acceptance of partial rent, late rent, or performance does not amend this Lease unless Landlord signs a written amendment or applicable law provides otherwise.
Governing Law, Severability, and Entire Agreement
North Carolina law governs this Lease. Any legal action shall be brought in a court having proper jurisdiction and venue.
If a provision is unlawful or unenforceable, it shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain effective.
This Lease and its signed addenda constitute the entire agreement. Any amendment must be in a writing signed by Landlord and Tenant, except lawful rules that may be adopted or amended without a signed modification.
Electronic Signatures and Counterparts
This Lease may be signed electronically and in counterparts. Electronic signatures and copies shall have the same effect as originals to the extent permitted by law.
Signatures
Each party acknowledges reading this Lease, receiving an opportunity to ask questions, and receiving a completed copy.
