Residential Lease Agreement This Residential Lease Agreement ("Agreement") is entered into by and between the undersigned Owner/Landlord ("Owner") and Tenant(s) ("Tenant") and governs the leasing of the residential property described below ("Premises"). This Agreement constitutes the complete and exclusive statement of the agreement between the parties and supersedes all prior or contemporaneous discussions, negotiations, representations, advertisements, or agreements, whether oral or written. Tenant acknowledges that no representations or promises have been made by Owner or Owner's agents other than those expressly set forth in this Agreement, and Tenant has not relied on any statement outside this Agreement in deciding to enter into this lease. 1. Premises Owner leases to Tenant the residential dwelling located at the address identified in the Lease Summary or any attached addendum, together with all fixtures, appliances, improvements, parking areas, storage areas, and appurtenant rights provided with the property, subject to the terms of this Agreement. The Premises shall be used solely as a private residence by Tenant and approved occupants and for no other purpose without the prior written consent of Owner. Except as required by applicable habitability laws, Tenant accepts the Premises in its present condition as of the commencement date and acknowledges that Owner makes no express or implied warranties regarding condition beyond those imposed by law. 2. Term of Lease The lease term shall begin on the commencement date stated in the Lease Summary and shall continue for the full term specified unless earlier terminated in accordance with this Agreement or applicable law. Tenant's taking possession of the Premises constitutes conclusive acknowledgment that the Premises were delivered in a clean, safe, and habitable condition. Any defects or concerns not reported to Owner in writing within ___ days after possession shall be deemed waived, except for latent defects materially affecting habitability. 3. Rent Tenant agrees to pay Owner the monthly rent stated in the Lease Summary. Rent is due in advance on the first day of each month without notice, demand, deduction, setoff, or offset. Tenant shall not withhold rent, perform repairs and deduct costs, or apply rent toward alleged claims or disputes except to the extent expressly permitted by applicable law. Rent shall be paid in the manner and location designated by Owner. 4. Late Fees and Returned Payments If rent is not received within the grace period stated in the Lease Summary, Tenant shall be charged a late fee in the maximum amount permitted by law. Any payment returned or rejected for any reason may result in additional charges and may require future payments to be made in certified funds or another method designated by Owner. Acceptance of late or partial rent does not waive Owner's rights, does not cure any default, and does not reinstate tenancy rights unless Owner expressly agrees in writing. 5. Security Deposit Tenant shall pay a security deposit in the amount specified in the Lease Summary prior to occupancy. The security deposit secures the faithful performance of all Tenant obligations under this Agreement. The security deposit may be applied to unpaid rent, utilities, cleaning beyond ordinary wear and tear, damage repairs, or any other lawful charges. The security deposit is not rent and may not be applied by Tenant toward rent or other charges without Owner's prior written consent. Any remaining balance shall be returned in accordance with applicable law. 6. Utilities and Services Unless otherwise stated in writing, Tenant is responsible for establishing, maintaining, and paying for all utilities and services serving the Premises, including but not limited to electricity, gas, water, sewer, trash, internet, and cable. Failure to maintain uninterrupted utility service constitutes a material breach of this Agreement. Owner may, but is not obligated to, restore utility service and charge all associated costs as additional rent. 7. Occupants Only the individuals listed as Tenant or approved occupants may reside at the Premises. Guests exceeding the permitted occupancy period or residing without Owner's prior written consent shall be deemed unauthorized occupants. Unauthorized occupancy constitutes a material breach of this Agreement and grounds for termination, subject to applicable law. 8. Maintenance, Repairs, and Alterations Tenant Responsibilities Tenant shall, at Tenant's sole cost and expense, maintain the Premises in a clean, sanitary, and safe condition at all times. Tenant is responsible for all routine maintenance and minor upkeep, which includes any maintenance or condition that does not require structural modification or specialized licensing and any condition arising from normal use, neglect, or accumulation of debris, whether or not such maintenance could reasonably have been prevented. Routine maintenance includes, without limitation, replacing light bulbs and batteries, maintaining smoke and carbon monoxide detectors as required by law, changing HVAC filters as directed, keeping plumbing fixtures free of obstructions, and promptly cleaning spills or conditions that may cause damage. Tenant shall immediately notify Owner in writing of any condition requiring repair. Failure to provide timely notice shall render Tenant responsible for any resulting damage, escalation of damage, or increased repair costs. Any costs incurred by Owner due to Tenant's failure to timely report a condition, or due to damage caused by Tenant, occupants, guests, or invitees, shall be deemed additional rent and payable upon demand. Tenant shall be responsible for all damage to the Premises occurring during the lease term that is caused by or attributable to Tenant, occupants, guests, or invitees, including damage resulting from misuse, negligence, improper use, or failure to report issues promptly. Damage occurring during the lease term shall be presumed to be Tenant-caused unless Tenant demonstrates otherwise. Owner Responsibilities Owner shall be responsible for repairs required to maintain the Premises in habitable condition as required by applicable law, excluding damage caused by Tenant or those under Tenant's control. Owner's obligation to repair is conditioned upon Tenant providing timely written notice and reasonable access as permitted by law. Failure to provide access may delay repairs and relieve Owner of responsibility for resulting conditions. Alterations and Improvements Tenant shall not make any alterations, additions, installations, or improvements to the Premises without Owner's prior written consent, which must be in a written agreement signed by Owner. Owner's knowledge of, acquiescence in, or failure to object to any alteration shall not constitute consent. Any approved alterations shall be performed in a workmanlike manner, in compliance with all applicable laws and codes, and by licensed professionals where required. Owner may require inspection of any approved alteration during and after completion and may condition approval on compliance with Owner standards. Unless otherwise directed by Owner in writing, all approved alterations shall become the property of Owner. At Owner's option, Tenant shall restore the Premises to its original condition prior to vacating, ordinary wear and tear excepted. Prohibited Repairs and Work Tenant shall not perform or contract for repairs affecting structural components, plumbing, electrical, HVAC, roofing, or mechanical systems. Any unauthorized repairs or alterations constitute a material breach of this Agreement, and Tenant shall be liable for all resulting costs, damages, and code compliance issues.
