1. FIXED-TERM LEASE AGREEMENT, RENEWAL AND TERMINATION: : Tenant agrees to lease the Premises for the fixed term of 6 months, beginning and ending (the "Lease Term"). Upon expiration, this Lease Agreement will become a month-to-month agreement automatically, unless Tenant or Agen notify the other party in writing at least 30 days prior to expiration that they do not wish this Lease Agreement to continue on any basis. After the Lease Term, this lease may be terminated, without cause, by either party by one calendar month advance notice. After Tenant has given written notice to vacate, Tenant must make the Premises available to show to prospective tenants during the normal business hours. If Tenant is not available, Landlord will be authorized to enter and show the Premises to prospective tenants. If Tenant does not cooperate with showing the Premises to prospective tenants. During the notice period, Tenant will be responsible to pay the Landlord an additional 30 days rent after giving possession back to the Landlord or until the property is re-rented. 2. FIXED MONTHLY RENT: Tenant agrees to pay Landlord as base rent for the Premises "as is" the sum of $800 per month, due and payable monthly on the first(1st) day of each month during the term of this Lease Agreement. The first month's rent is required to be submitted on or before moving in. 3. LAYTE PAYMENT FEES: A late charge of $50 will be assessed to Tenant account if full rent payment is not made by ethe fifth(5th) day of the month (NO EXCEPTIONS). The later charge will be due immediately without demand and will be added to and paid with the late rent payment. Neither ill health, loss of job, financial emergency, or other excuses will be accepted for late payment. 4. INSUFFICIENT FUNDS FEE: Tenant agrees to pay the insufficient Funds Fee of $25 for any form of payment that is returned by the financial institution for any reason. 5. CONDITION OF PREMISES: The Tenant agrees to accept said property in its present condition and to keep said property in such repair as the same is at the commencement of the term, or may be put in by the Landlord during the continuance thereof; reasonable use and wear (and damage by fire or other unavoidable causalities) excepted; and upon the end of this tenancy to yield up the property peacefully to the Landlord in good and tenantable repair as aforesaid. 6. ALTERATIONS: Tenant agrees not to make or permit to be made any alterations or additions to the said property without the prior written consent of Landlord. 7. Tenant agrees to keep the front of the Premises neat and clean. 8. LAWN CARE: Tenant shall be responsible for taking care of the lawn and yard. 9. VEHICLES AND PARKING: Tenant agrees to park cars only in designated parking areas. 10. NON-BUSINESS USE: The Tenant agrees the Premises shall be used as a single-family private dwelling unit only. 11. LOCKS AND LOCKOUTS: Locks shall not be changed or altered. The Tenant hereby acknowledges having received _______ keys. Upon vacating the premises, failure to return keys will result in locksmithing charges being deducted from the Tenant's security deposit. Should the Tenant lock themselves out of the Premises and be unable to again access through their own resource, they may call upon a professional locksmith at the Tenant expense. 12. ILLEGAL ACTIVITY AND NOISE: Tenant will not use, or permit to be used, the demised Premises or any part thereof for any illegal immoral or improper purpose; not to make or permit to be made any disturbance, noise or annoyance whatsoever detrimental to the Premises or the comfort and peace of the inhabitants of the Premises. Tenant understands that it will be the Tenant's responsibility to ensure that they maintain a quiet safe atmosphere. Violations will constitute a default and will be ground for termination of this Lease Agreement by Landlord. 13. HAZAROUD MATERIAL: Tenant will not store any dangerous, flammable or explosive material on the Premises. 14. ACCESS TO PREMISES: Tenant shall permit Landlord to enter the Premises at reasonable times and upon reasonable notice for the purpose of inspecting or showing the Premises to prospective tenants or for making necessary repairs. 15. EXTENDED ABSENCES: Tenant will notify Landlord if the property will be vacant for more than ten(10) days. 16. NO-SMOKING POLICY: Tenant agrees and acknowledges that the Premises will be designated as a SMOKE-FREE living environment. Tenant or anyone else will not smoke anywhere on the Premises. Tenant will be subject to a fee in an amount equal to one full month's rent for any violation of the Lease Agreement. Violations will constitute a default and will be ground for termination of the Lease Agreement by Landlord. 17. UTILITY BILLS: Tenant agrees that utility bills and service contracts, including but not limited to water, sewer, electric, internet and gas services, for the Premises will be paid by the Tenant. The Tenant is responsible for payment of the applicable service, including metering, hook-up fees or other miscellaneous charges associated with establishing, installing and maintaining such utility. UNDER NO CIRCUMSTANCES will the Landlord be responsible for any utilities or utility bills. Tenant agrees to leave the utilities on for the move-out inspection and after the move-out inspection, have all utility services discontinued and pay for all utility services due. 18. AIR FILTERS: Premises is supplied with a replaceable air filter as part of the HVAC system. It is imperative for the longevity and operation of the system that the air filter be regularly checked and replaced. The Tenant agrees, at their sole cost, risk and expense, to be responsible for checking the air filter once a month and replace if necessary. The Landlord reserves the right to regularly inspect the air filter to determine whether the air filter needs to be replaced. 19. COLD WEATHER: When the temperature drops below freezing, Tenant will be responsible for taking precautions to prevent freezing pipes and fixtures. Tenant will be responsible for repairing the pipes and fixtures if they fail to take precautions to prevent freezing. 20. PEST-CONTROL POLICY: Tenant will keep Premises fee of pests, bugs, rodents, etc. and is responsible for any ongoing pest control services, if the Tenant desires such a service. Landlord is not responsible for any damage done to the Tenant person or any other persons or Tenant property from said pest, bugs, rodents, etc. 21. INSURANCE: Landlord and Tenant shall each be responsible to maintain the appropriate insurance for their respective interest in the Premises and property located on the Premises. Tenant understands that the Landlord will not provide any insurance coverage for Tenant's property. Landlord will not be responsible for any loss of Tenant's property, whether by theft, fire, riots, strikes, acts of God or otherwise. Landlord encourages Tenant to obtain renter's insurance for other similar coverage to protect against risk of loss. 22. REPAIR AND MAINTENANCE: Tenant will be responsible for repairing all damage or destruction to the Premises which occur due to the intentional act or neglect of the Tenant or anyone else. 23. BUILDING PROBLEMS: Tenant agrees to notify Landlord immediate if roof leaks, water spots appear on ceiling or at the first sign of termite activity. Tenant also agrees to notify the Landlord immediate upon first discovery of any signs of serious building problems such as foundation cracks, a tilting porch, a crack in plaster buckling of drywall or siding, a spongy floor, a leaky water heater, etc. If the Tenant doe does not notify the Landlord in a prompt matter the Tenant may be held financially responsible for any repairs. 24. DRAINS BLOCKAGES: Landlord warrants that the Premises sewage drains are in good working order and that they will accept the normal household waste for which they were designed. They will not accept things such as diapers, sanitary napkins, tampons, children's toys, wads of toilet paper, ball of hair, grease, oil, table scraps, clothing, rage, sand dirt, rocks, newspapers, etc. Tenant agrees to pay for clearing the drains and plumbing pipes of any and all blockages except those which the plumber who is called to clear blockage will attest in writing the problems were caused by defective plumbing, tree roots or acts of God. 25. INDEMNIFICATION: To the extent permitted by Law, Tenant will indemnify and hold Landlord and Landlord's property, including the Premises, free and harmless from any liability for losses, claims of injury or death of any person, including Tenant, or for damage to property arising from Tenant or Tenant's family or guest using and occupying the Premises or from the acts or omission of any person or persons, including Tenant, in or about the Premises with Tenant's express or implied consent. Tenant will not be liable to Landlord for claims resulting from Landlord negligence. 26. ENTIRE AGREEMENT: This Lease Agreement constitutes the entire Agreement between the Tenant and Landlord and supersedes any prior understanding or representation of any kind preceding the date of this Lease Agreement. There are no other promises, conditions, understanding or other Lease Agreements, whether oral or written, relating to the subject matter of this Lease Agreement. This Lease Agreement may be modified in writing and must be signed by both Landlord and Tenant 27. LEGAL FEES: in the event that the tenant violated the terms of the Lease Agreement or defaults in the performance of any covenants in the Lease Agreement and the Landlord engages an attorney or institutes a legal actinon, counterclaim, or summary proceeding against Tenant based upon such violation or default, Tenants shall be liable to Landlord for the costs and expensed incurred in enforcing this Lease Agreement, including any action against the Landlord pursuant to this Lease Agreement and the Landlord prevails, Tenant shall be liable to Landlord for costs and expenses of defending such action, including reasonable attorney fees and costs.
