If rent is not paid before the 20th, landlord shall consider this lease agreement broken by tenant. 5 - Landlord's failure to enforce the late fees (or other breach) does not waive the landlord's right to enforcement in the future. 6 - Property is cat friendly up to 2 cats. Dogs and other pets are not allowed unless written permission from landlord or property manager is given. 7 - Tenant is responsible for any damages caused by the pet to the property. 8 - Pet shall not become a nuisance (incessant barking/howling/loud noises or aggressive/destructive behavior) to the property, neighborhood, landlord or other roommates. If pet can't be controlled by the owner in a satisfactory manner the landlord reserves the right to have the pet removed and/or consider the lease contract broken/void by the tenant. 9 - Tenant shall not be a nuisance (loud music, late parties, constant influx of people) to the property, neighborhood, landlord or other roommates. All tenants are given the right to quiet enjoyment of the property. 10 - If at any point the cost of any damage or the sum of damages are higher than the prepaid Security Deposit the tenant must pay the landlord for the remaining balance to cover the expenses, as applicable by law. 11 - If tenant breaks this contract for any reason an extra fee of one month's rent ($2,000.00) will be charged from tenant, and tenant will be given 30 days to vacate the property. The same fee shall be used if tenant decides to terminate the contract early. Unless waived by writing by the landlord. 12 - The landlord reserves the right to vacate the property at any point, as long as a minimum of 30 days notice is given. If landlord requests the property to be vacated, no fee shall be charged from tenant besides the base rent and any subsequent amount from the Security Deposit must be returned, as long as no damages are found. 13 - All roommates or any visitor that stays for longer than three weeks shall be put on the lease. Documents and a background check might be required by landlord. 14 - Tenants are not allowed to sublet the property, AirBnB or offer any other type of short/long term lease service in the property without the written permission of the landlord. 15 - Landlord will be responsible for mowing the grass. Any plants grown or planted by the tenant shall be of tenant's responsibility and landlord is not required to maintain or keep said plant. 16 - Tenants are not allowed to make any change to the property, specially permanent changes, that is not allowed by writing by the landlord. 17 - Tenants are allowed to rang wall art and shelves, as long as they remove it themselves at the end of the lease. Any hole in the wall smaller than a penny will be filled by the landlord at not extra cost to the tenant. Any larger hole must be filled by tenant and wall must be brought back to it's original state or Security Deposit will be used to fix up the property. 18 - Tenant is given 1 parking spot under the carport, and all the driveway space in the 3306 side of the building. Tenant is responsible for coordinating the parking on their side of the building. 19 - Tenant is responsible for all utilities, including water, gas, electricity, internet and any other service they might use. 20 - Lease will be considered broken if tenant is found to break the law inside or outside the property. 21 - In the event that any one or more provisions of this Agreement shall be deemed to be illegal or unenforceable, such illegality or unenforceability shall not affect the validity and enforceability of the remaining legal and enforceable provisions hereof, which shall be construed as if such illegal or unenforceable provision or provisions had not been inserted. 22 - This agreement will be governed, construed, and enforced in accordance with the laws of the State of Michigan, without regard to its conflict of laws rules.
