8) Improper Use & Tenant Maintenance Responsibility
Tenant responsible for repairs caused by misuse, neglect, or failure to maintain property. Examples: drain/toilet clogs, appliance misuse, HVAC filter neglect, fixture damage, electrical misuse, surface damage, cleanliness neglect, unauthorized alterations.
Tenant must perform routine maintenance (filters, bulbs, cleanliness, pest prevention).
Landlord only responsible for structural/system failures not caused by tenant.
Improper calls to landlord may result in $75 service call fee + repair costs.
All charges billed as Added Rent.
9) Renter's Insurance & Force Placed Coverage
Mandatory Coverage: Tenant must maintain active renter's insurance at all times during tenancy.
Policy must include personal liability coverage of at least $100,000
Landlord must be listed as Additional Insured and Beneficiary.
Proof of coverage required prior to move in and upon each renewal.
Lapse in coverage constitutes a lease violation.
Force Placed Insurance: If tenant fails to maintain required renter's insurance, landlord may procure coverage at tenant's expense. Coverage will be a landlord contents/liability policy protecting landlord's furnishings, appliances, and liability exposure. Tenant acknowledges this coverage does not protect tenant's personal belongings, which remain uninsured unless tenant maintains their own renter's insurance. Tenant agrees to reimburse landlord for the full monthly premium cost plus a $50 monthly administrative fee for management and enforcement. These charges will be billed as Added Rent, due with the next rent cycle.
Tenant Acknowledgment Form: Prior to move in, tenant must sign a Tenant Acknowledgment Form for Insurance Compliance, confirming they understand: Renter's insurance is mandatory, Landlord may force place insurance if tenant defaults, Tenant will be billed for the premium plus administrative fee if landlord must procure coverage.
Default Consequences: Continued failure to maintain renter's insurance or refusal to reimburse landlord for force placed coverage constitutes default under the lease and may result in termination or eviction proceedings.
10) Entry & Access Clause
Landlord may enter with 24 hour written notice for inspections, repairs, or showings.
Emergency access permitted without notice.
Tenant may not unreasonably withhold access.
11) Default & Remedies Clause
Nonpayment of rent or violation of lease terms constitutes default.
Remedies include eviction, recovery of damages, attorney's fees, and acceleration of rent.
Tenant remains liable for all unpaid rent and costs.
12) Subletting & Assignment Clause
Subletting, Airbnb, or assignment of lease is strictly prohibited without landlord's written consent.
Unauthorized subletting is grounds for immediate termination.
13) Alterations & Improvements Clause
Tenant may not paint, remodel, or alter property without landlord's written approval.
Unauthorized alterations will be restored at tenant's expense.
14) Move Out Condition Clause
Tenant must return property clean and free of trash.
Carpets vacuumed, appliances cleaned, and all keys/remotes returned.
Failure to comply may result in deductions from security deposit.
15) Furnishings, Abandonment & Governing Law
Furnishings Provided: The property is rented fully furnished, including landlord provided furniture, appliances, and home gym equipment. Tenant is responsible for maintaining all furnishings in good condition.
Damage Liability: Tenant is financially responsible for any damage, stains, or loss to furnishings beyond normal wear and tear. Missing or damaged items will be deducted from the security deposit or billed as Added Rent.
Move Out Condition: All furnishings must be returned in the same condition as received, clean and undamaged. Tenant must return all keys, remotes, and landlord provided items at move out.
Abandonment of Property: If tenant leaves personal belongings behind after vacating, landlord may dispose of them after 10 days without liability.
Governing Law: Lease is governed by Georgia law; disputes resolved in local courts.
Severability: If one clause is invalid, the remainder of the lease remains enforceable.
