Schedule your showing today and come see what this apartment has to offer! # RESIDENT QUALIFICATION & TENANT SELECTION CRITERIA These Resident Qualification and Tenant Selection Criteria apply to applicants seeking to lease residential property managed by Management. Applicants should carefully review these criteria before submitting an application and paying an application fee. Management applies these criteria consistently to applicants without regard to race, color, religion, sex, national origin, familial status, disability, or any other status protected by applicable federal, state, or local law. Nothing in these criteria limits an applicant's right to request a reasonable accommodation under applicable Fair Housing laws. # 1. APPLICATION REQUIREMENTS Each prospective resident who will be 18 years of age or older at the commencement of the lease must submit a separate rental application unless otherwise permitted by Management's application system. Each applicant must: * Complete the rental application truthfully and completely. * Provide sufficient information to verify identity. * Provide a valid government-issued photo identification or other acceptable identification. * Provide authorization for applicable credit, rental-history, criminal-background, identity, and other authorized screening. * Provide requested income documentation. * Pay the applicable non-refundable application fee of $60. * Identify all persons who will occupy the property. * Identify all animals that will reside at the property, except that assistance-animal requests will be handled according to the reasonable-accommodation procedures described below. A Social Security number may be requested when necessary to obtain authorized screening reports. Applicants who do not have a Social Security number should contact Management regarding available alternative verification procedures. An application will not be considered complete until Management has received all required information, documentation, authorizations, and applicable fees. Providing false, materially misleading, fraudulent, or intentionally incomplete information may result in denial of the application. # 2. FAIR HOUSING AND EQUAL OPPORTUNITY Management complies with applicable federal, Texas, and local Fair Housing laws. Applicants will not receive different qualification standards, application procedures, rental terms, deposits, fees, or treatment because of a characteristic protected by applicable law. Qualification decisions will be based upon the written criteria contained in this policy and other lawful property-specific requirements disclosed to the applicant. Leasing personnel do not have authority to waive these criteria selectively. # 3. OCCUPANCY Occupancy must comply with applicable federal, state, and local laws, building and housing codes, property configuration, bedroom dimensions, and legitimate health and safety considerations. As a general property-management guideline, occupancy should not ordinarily exceed two persons per bedroom unless a different occupancy level is appropriate or required based upon applicable law, unit size, configuration, age of occupants, or other legally relevant circumstances. Management will not apply occupancy standards for the purpose of excluding families with children or another protected class. All occupants must be disclosed on the rental application and lease. Adults who will occupy the property must satisfy applicable application requirements. # 4. INCOME REQUIREMENTS Applicants must demonstrate sufficient, lawful, stable, and verifiable income or financial resources to meet the rental obligation. Unless otherwise disclosed for a specific property: **Combined gross monthly qualifying income must equal at least three times the monthly rent.** Income may be considered collectively for financially responsible co-applicants. Management may consider verifiable lawful income from sources including, but not limited to: * Employment. * Self-employment. * Retirement or pension income. * Social Security benefits. * Disability benefits. * Veterans benefits. * Court-ordered support. * Investment income. * Trust distributions. * Government benefits or housing assistance where applicable. * Other lawful and verifiable sources of income. The source of lawful income will not be rejected merely because it is not traditional wage employment. ## Employment Income Applicants relying upon employment income may be required to provide documentation such as: * Recent pay statements. * Employer verification. * Employment offer letter. * Employment contract. * Other reliable evidence of current income. Employment must be reasonably verifiable. Failure of an employer to respond to a verification request will not automatically result in denial if the applicant can provide other reliable documentation establishing qualifying income. ## Self-Employment Self-employed applicants may be asked to provide documentation reasonably sufficient to establish continuing income, which may include: * Recent bank statements. * Tax returns. * Profit-and-loss statements. * 1099 forms. * Business financial records. * Contracts. * Other reliable documentation. Management may request additional documentation when reasonably necessary to verify qualifying income. # 5. RENTAL AND RESIDENCE HISTORY Management will ordinarily review up to the previous 24 months of available rental or residence history. Applicants without traditional rental history will not automatically be denied solely because no prior landlord exists. Examples include applicants who: * Previously owned a residence. * Lived with family. * Recently entered the rental market. * Were housed by the military. * Lived in student housing. * Otherwise lack conventional landlord references. Where rental history exists, applicants may be denied for documented material rental-performance issues, including: * Unpaid rent owed to a current or former landlord. * Unpaid charges for resident-caused property damage. * A final eviction judgment within the previous three years. * Material lease violations resulting in termination of tenancy. * Repeated documented late rental payments. * Material unauthorized occupancy. * Material unauthorized animal violations. * Documented intentional or excessive property damage beyond ordinary wear and tear. * Documented conduct resulting in termination of tenancy because of material lease violations. * Outstanding rental-related judgments. An eviction filing alone will not automatically be treated as an eviction judgment. Dismissed cases, cases in which the applicant prevailed, inaccurate records, and records not reasonably attributable to the applicant should not be treated as adverse rental history. Management may consider documentation provided by an applicant explaining inaccurate or incomplete rental-history information. # 6. CREDIT QUALIFICATIONS Management may obtain a consumer credit report or tenant-screening report as permitted by law. Credit will be evaluated primarily for information reasonably related to the applicant's ability and demonstrated history of meeting residential financial obligations. Relevant information may include: * Unpaid balances owed to current or former landlords. * Rental-related judgments. * Utility collections. * Material delinquent residential-service accounts. * Material payment history affecting the applicant's ability to satisfy the rental obligation. * Other significant credit information reasonably related to tenancy. Management does not rely solely upon a credit score unless a specific minimum score has been separately established and disclosed for the property. Medical debt will not be used as a substitute for evaluating rental-payment history. The existence of unrelated consumer debt by itself will not necessarily result in denial when the applicant otherwise demonstrates the financial ability to satisfy the lease. Applicants may be required to satisfy outstanding balances owed to a prior landlord before approval. # 7. CRIMINAL BACKGROUND SCREENING Management may conduct criminal-background screening as permitted by applicable law. An arrest by itself is not proof that an applicant committed an offense and will not, standing alone, constitute an automatic basis for denial. Criminal-history decisions will primarily be based upon verified convictions or other legally permissible records. Criminal history will be evaluated according to its reasonable relationship to legitimate concerns involving: * The safety of residents and others. * Protection of property. * Serious criminal activity occurring at residential property. * The peaceful use and enjoyment of the property. * Other legitimate housing-management concerns. Relevant criminal history may include convictions involving: * Serious violence against another person. * Sexual offenses. * Arson. * Kidnapping. * Robbery. * Burglary. * Serious intentional destruction of property. * Illegal manufacture or distribution of controlled substances. * Other serious offenses that present a demonstrable threat to residents, employees, property, or residential operations. Except when applicable law permits or requires a different result, criminal history that warrants additional review will be referred to designated management personnel rather than decided independently by a leasing agent. When appropriate, factors considered may include: * Nature of the offense. * Severity of the offense. * Date of the offense. * Date of completion of the sentence. * Whether the conduct involved violence, property damage, or residential safety. * Whether the offense is reasonably related to risks associated with residential tenancy. * Reliable evidence concerning the disposition of the case. * Other legally relevant circumstances. Applicants will not be denied because of a vague characterization such as having a "history of drug abuse." Disability-related conditions will be handled in accordance with applicable Fair Housing requirements. When a background-screening report contains potentially inaccurate or incomplete information, applicants may exercise applicable rights to dispute that information with the consumer reporting agency. # 8. PETS Pets are subject to the individual property owner's pet policy. The property owner may establish reasonable restrictions concerning: * Number of pets. * Animal type. * Breed. * Size. * Weight. * Age. * Other lawful pet restrictions. Unless otherwise stated for the property: * Maximum number of pets: two. * Non-refundable pet fee: $300 per approved pet. * Monthly pet rent: $25 per approved pet. Applicable fees must be paid before occupancy. Animals must comply with applicable vaccination, licensing, and animal-control laws. Applicants may be required to complete an approved third-party pet-screening process. Pet approval is separate from applicant qualification, and completion of pet screening does not guarantee approval of an animal. # 9. ASSISTANCE ANIMALS AND REASONABLE ACCOMMODATIONS Assistance animals are not considered pets for purposes of Fair Housing accommodation requests. Applicants or residents with disabilities may request a reasonable accommodation to a rule, policy, practice, or service when the accommodation may be necessary to provide an equal opportunity to use and enjoy the dwelling. Requests involving an assistance animal will be evaluated separately from the property's pet policy. Approved assistance animals will not be charged: * Pet fees. * Pet deposits. * Pet rent. Ordinary pet breed, size, and similar restrictions will not automatically apply to an approved assistance animal. Where the disability and disability-related need for the requested accommodation are not apparent or already known, Management may request reliable information reasonably necessary to evaluate the accommodation request as permitted by law. Management will not request unnecessary medical records or detailed information regarding an applicant's diagnosis. A reasonable-accommodation request may be denied when permitted by law, including circumstances in which the requested accommodation would impose an undue financial and administrative burden, fundamentally alter the nature of Management's operations, or where the specific animal presents a direct threat or significant risk of substantial property damage that cannot be sufficiently reduced through another reasonable accommodation. Requests for reasonable accommodations should be directed to Management. An applicant will not be denied merely because a reasonable-accommodation request is pending. # 10. IDENTITY AND APPLICATION INFORMATION Applicants must provide sufficient reliable information for Management to reasonably verify: * Identity. * Income. * Rental history, where applicable. * Credit information, where applicable. * Criminal history, where applicable. Management does not require an applicant to establish citizenship merely as a condition of applying for ordinary private rental housing unless a particular housing program or applicable law requires specific eligibility documentation. All identification and verification requirements will be administered consistently. # 11. INCOMPLETE OR UNVERIFIABLE INFORMATION Management may deny an application when information material to qualification cannot reasonably be verified after reasonable attempts. Before denying solely because a third party failed to respond to a verification request, Management may permit the applicant to provide alternative reliable documentation. Management may deny an application for: * Materially false information. * Fraudulent documentation. * Material misrepresentation. * Intentional omission of information necessary to determine eligibility. * Refusal to authorize lawful screening necessary to evaluate the application. * Failure to provide reasonably requested qualification documentation. Minor errors that do not materially affect qualification should not automatically result in denial. # 12. CONDITIONAL APPROVAL Where Management permits conditional approval, the alternative qualification requirements must be applied consistently to similarly situated applicants. Depending upon the specific deficiency and as permitted by law, conditional approval may include: * An approved guarantor. * An increased lawful security deposit. * Other objectively established financial safeguards permitted by law. Conditional approval will not be based upon an applicant's protected status. A leasing agent may not independently create alternative qualification requirements for a particular applicant. Any condition imposed because of information contained in a consumer report may constitute an adverse action and will be handled according to applicable consumer-reporting laws. # 13. PROPERTY-SPECIFIC REQUIREMENTS Individual owners may establish lawful property-specific requirements, provided those requirements: * Are established before the applicant is evaluated. * Are disclosed when applicable. * Do not conflict with these criteria or applicable law. * Are applied consistently to similarly situated applicants. * Are not based upon a protected characteristic. A property owner may not instruct Management to make an exception for one applicant while applying a materially different standard to a similarly situated applicant for a discriminatory reason. # 14. PROCESSING APPLICATIONS Applications will be processed under Management's established application-processing procedures. Management may continue marketing a property until: * An applicant has been approved; * Required deposits and other amounts have been received as required; * The lease has been executed; and * Any other stated conditions of approval have been satisfied. Submitting an application does not guarantee approval or reserve the property unless Management has expressly agreed otherwise in writing. When multiple applications are received, Management will use a consistently applied processing method. Management will not alter the processing order because of an applicant's protected status. # 15. APPROVAL AND NOTIFICATION Applicants will receive notice of approval or denial according to applicable Texas law and Management's application procedures. Applicants should not assume approval until actual approval has been communicated by Management. Approval may be conditioned upon timely completion of required move-in steps, including: * Execution of the lease. * Payment of the security deposit. * Payment of required rental amounts. * Completion of permitted animal documentation. * Satisfaction of lawful conditions stated in the approval. Failure to satisfy approval conditions within the stated deadline may result in Management proceeding with another qualified applicant. # 16. CONSUMER REPORTS AND ADVERSE ACTION Management may use third-party consumer reporting agencies to obtain: * Credit reports. * Tenant-screening reports. * Rental-history reports. * Criminal-background reports. * Other lawful consumer reports. When Management takes an adverse action based in whole or in part upon information contained in a consumer report, Management will provide any notice required by applicable law. Adverse actions may include: * Denial. * Requiring a guarantor. * Requiring a higher security deposit than would otherwise apply. * Imposing another less-favorable condition because of information contained in a consumer report. Applicants have rights under applicable consumer-reporting laws to obtain information from the reporting agency and dispute inaccurate or incomplete information. # 17. CONSISTENT APPLICATION OF CRITERIA These criteria are intended to reduce subjective decision-making. Leasing personnel should not: * Create qualification standards during the application process. * Waive requirements selectively. * Make decisions based upon personal impressions of an applicant. * Ask unnecessary questions regarding disability, religion, family composition, ethnicity, national origin, or other protected characteristics. * Suggest that a particular property or neighborhood is more or less appropriate for an applicant because of a protected characteristic. * Discourage an applicant from applying because of a protected characteristic. * Treat substantially similar applicants differently without a documented legitimate reason. Questions involving Fair Housing, reasonable accommodations, assistance animals, unusual criminal-history circumstances, or exceptions should be referred to designated management personnel. # 18. APPLICANT SELECTION CRITERIA ACKNOWLEDGMENT Signing this acknowledgment indicates that you have had the opportunity to review the landlord's tenant selection criteria. The tenant selection criteria may include factors such as: * Criminal history. * Credit history. * Current income. * Previous rental history. * Accuracy and completeness of application information. If you do not meet the selection criteria, or if you provide inaccurate or incomplete information, your application may be rejected and your application fee will not be refunded.
