Columbiana, Ohio 44408 (the "Property") to _____TBD______, Tenant, to premises described as: Home and property Identified by markers 50 feet from the driveway entrance to the WEST, 75 Feet from the side entrance to the North, 75 Feet from the basement rear entrance to the East, and 50 Feet from the House to the SOUTH of the home to Columbiana-Waterford Rd & adjacent residential property . Together with the following Furniture and Fixtures: Butcher Block Kitchen Island, Washer, Refrigerator Dryer, The rental shall commence on ___TBD____________, _________, and shall continue from month to month unless otherwise stated. This rental Agreement may be terminated at any time by either party by giving written notice 30 days in advance, unless a longer or shorter period of advance is agreed upon by the Landlord and Tenant. Tenant agrees to pay $1790.00 rent per month on the 1st day of each month. Payment is to be delivered to the Board of Education office on a workday either on or before the payment due date before 3PM EST. Tenant agrees to pay, upon execution of this Agreement, in addition to the rent, a security deposit of $1,790.00. This deposit will be held as security for any potential damages, cleaning, or unpaid rent that may occur during the term of this Agreement. Landlord may deduct from the security deposit for the following reasons: (1) damage to the Property beyond normal wear and tear; (2) unpaid rent or late fees; (3) cost of cleaning if the Property is not returned in a clean condition; and (4) any other expenses incurred by Landlord due to Tenant's violation of this Agreement. The security deposit or any remaining deposit after applicable deductions shall be returned to Tenant within 30 days of the date Tenant vacates the Property. Tenant agrees to pay all utilities and secure their own garbage collection service. Tenant agrees to carry renters insurance for personal belongings. Tenant has examined the Property and all furniture and fixtures contained therein, and accepts the same as being clean and in good order, condition, and repair, with the following exceptions if any. The Property are rented for the use only as a residence for __X___ adults and __X___ children. No animals or pets except _TBD_______ shall be kept on the Property without the Landlord's prior written consent. Tenant may not assign, transfer, or sublet to another person without the written consent of the Landlord. Tenant shall not disturb, annoy, endanger or inconvenience the schools or neighbors, nor use the premise for any immoral or unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance upon or about the premise. Tenant shall obey the rules and regulations for the Property attached hereto. Tenant shall keep the Property rented for his/her exclusive use in good order and condition and pay for any repairs caused by his/her negligence or misuse, or that of his/her invitees/visitors. The Landlord shall maintain any other parts of the Property and pay for the repairs not caused by Tenant's negligence or misuse or that of his/her invitees/visitors. Landlord shall not be liable for any damage or injury of or to the Tenant, Tenant's family, guests, invitees, agents, or to any person entering the Property and Tenant hereby agrees to indemnify, defend, and hold Landlord harmless from any and all claims or assertions of every kind and nature. With Tenant's permission, which shall not unreasonably be withheld, Landlord or his agent shall be permitted to enter to inspect, to make repairs, and to show the premise to prospective tenants or purchasers. In an emergency, Landlord or his agent may enter the Property without securing prior permission from Tenant, but shall give Tenant notice of such entrance immediately thereafter. Tenant shall neither paint nor make alterations to the Property without the Landlords prior written consent. This includes but is not limited to the modifications to walls, floors, ceilings, fixtures, furniture, windows, window treatments, doors and the exterior of the home. If Tenant abandons or vacates the premise, Landlord may at its option terminate this Agreement, and immediately re-enter the premise and remove all of Tenant's Property. The prevailing party may recover from the other party his/her costs and attorney fees of the action brought by the other party. Either party may terminate this Agreement in the event of a violation of any provisions of this Agreement by the other party.
