Owner's Additional Clauses (Addendum) A. Utilities; Waste; No Smoking 1. Utilities. Tenant is responsible for all utilities and services to the Premises, including gas, electricity, water, trash/recycling (waste management), and internet, except as expressly stated otherwise in the Agreement. 2. No smoking. Smoking and vaping (including e cigarettes) are strictly prohibited anywhere on the Premises, including inside the dwelling, garage, patios/balconies, and any areas associated with the rental. B. Move Out Condition; Cleaning; Carpets; Walls 1. Standard of condition. Tenant shall surrender the Premises at move out in the same level of cleanliness and condition as at move in, ordinary wear and tear excepted. 2. Cleaning/repairs. Owner may charge or deduct only for cleaning and repairs that are reasonably necessary to restore the Premises to the move in level of cleanliness/condition and otherwise permitted by California law (including rules relating to ordinary wear and tear). 3. Carpeted areas (3rd floor and stairs). Tenant must maintain carpeted areas in a clean condition, promptly address spills, and report stains or damage. Carpet cleaning, stain/odor treatment, or carpet repair/replacement may be charged only if reasonably necessary due to soiling, staining, odors, or damage beyond ordinary wear and tear, consistent with California standards (including "useful life" considerations). 4. Walls/painting. Tenant is responsible for damage beyond ordinary wear and tear (e.g., large holes, unauthorized paint, excessive stains/marks). Charges for patching, repainting, or related repairs may be assessed only to the extent reasonably necessary and permitted by California security deposit standards. C. Pet Policy (Conditional Approval) 1. Approval required. Owner prefers no pets; however, Owner may consider up to two (2) domesticated pets, each under 20 lbs full grown, with prior written approval. 2. Pet screening. Approved pets require completion of a pet screening process prior to move in and any additional documentation reasonably requested (e.g., vaccination records and a current photo). 3. Pet deposit and pet rent. If approved, Tenant shall pay (i) a refundable pet deposit of $500 total (subject to any applicable legal limits) and (ii) pet rent of $50/month per pet, due with monthly rent. 4. Pet responsibilities. Tenant is responsible for all pet related damage, odors, pest treatment, extra cleaning, and any HOA violations attributable to Tenant/occupants/guests/pets. Repeated nuisance behavior (noise, aggression, complaints) constitutes a breach of the Agreement and may require removal of the pet or other remedies. 5. Service/assistance animals. Service animals and valid assistance animals are not "pets" and will be handled in accordance with applicable law and a separate process. D. Minor Maintenance; Small Repairs; Tenant Caused Damage 1. Basic upkeep. Tenant is expected to handle routine housekeeping and basic home upkeep and to promptly report maintenance issues to Owner/Manager. 2. Minor repairs under $100 (reimbursable). With Owner's prior approval (except emergency mitigation), Tenant may arrange minor repairs under $100 and will be reimbursed by Owner upon submission of receipts and a brief description within a week. Tenant is not authorized to hire contractors for work requiring a licensed professional without Owner's written approval (except in an emergency to prevent imminent damage). 3. Tenant caused damage. Damage caused by Tenant/occupants/guests/pets due to negligence, misuse, or unauthorized work shall be repaired at Tenant's expense. E. Home Warranty Procedure (First American Home Warranty) 1. Warranty process. For major covered issues involving HVAC, appliances, or plumbing, Tenant shall submit service requests through First American Home Warranty (FAHW) in accordance with Owner's instructions. 2. Service call fee. Tenant is responsible for the FAHW service call fee per service visit/incident (currently $95, subject to change by FAHW). Owner pays the rest of fee. 3. Denials / not covered. If FAHW denies coverage or an item is not covered, Tenant must notify Owner promptly and obtain Owner approval before hiring an outside contractor (except for emergency mitigation to prevent property damage or restore essential services). F. HOA Rules; Fees; Violations 1. HOA compliance. Tenant agrees to comply with all HOA rules and community standards applicable to the Premises and to ensure occupants and guests comply as well. 2. HOA violations/fines. Any HOA fines, charges, or costs resulting from Tenant/occupant/guest conduct or violations may be charged back to Tenant as permitted by the Agreement and HOA rules. G. Access; Inspections; Showings Near End of Term 1. Inspections. Tenant agrees to cooperate with reasonable periodic inspections (typically no more than annually unless needed for maintenance, insurance, financing, or compliance). 2. Showings. During the last 30 60 days of the tenancy, Tenant agrees to allow Owner/Agent to show the Premises to prospective renters, with reasonable advance notice and during reasonable hours, except in emergencies or as otherwise permitted by California law.
