PREMISES Landlord hereby leases to Tenants the residential property located at 4968 New Haven Avenue, Memphis, Tennessee 38117 (the "Premises"). 2. RENT AND DEPOSITS All rent, security deposits, and pet deposits must be paid through the designated online platform. The Landlord will provide account setup instructions once the lease is signed. 3. PETS A non-refundable pet deposit of $100.00 is required for up to one (1) pet. For each additional pet, a non-refundable fee of $100.00 is required, with a maximum of three (3) pets allowed in total. 4. SECURITY DEPOSIT A refundable security deposit of $1,700.00 is due at the time of signing this Agreement. The deposit will be returned within 30 days after lease termination, subject to: - Payment of all rent and utilities - Deduction of late, legal, or repair fees - Costs for damage beyond normal wear and tear - Cleaning or property removal expenses The security deposit may not be applied to the final month's rent. Any lease breach that results in legal action will result in forfeiture of the full deposit. 5. LEASE TERM The lease term shall begin on [Start Date] and end on [End Date], unless extended in writing. The initial term is for one (1) calendar year. 6. LEASE EXTENSION Tenants must complete and submit an Extension of Lease Agreement at least 30 days before the lease ends. Notification must be given via both email and phone. The Landlord must acknowledge receipt in writing. 7. EARLY TERMINATION Early lease termination is allowed if the Tenant's employment is negatively impacted due to economic hardship. Written notice must be provided at least 30 days prior to the intended move-out date and confirmed in writing by the Landlord. Rent may be prorated accordingly. 8. MONTHLY RENT Monthly rent is $1,700.00. Any applicable pet deposit, for (1 pet $ 100.00) must also be paid online. The first month's rent and pet deposit are due upon move-in and completion of the initial inspection. Rent may be prorated for the first partial month. 9. LATE FEES Rent is due on the 1st of each month. A late fee of $50.00 applies for payments made 5 days or later after the due date. Payments are applied to outstanding charges before rent. 10. NON-PAYMENT If rent remains unpaid for more than 30 days past the due date, the Landlord may declare the lease in default, retake possession, and hold Tenants responsible for unpaid balances. The full security deposit will be forfeited. 11. INSUFFICIENT FUNDS A $50.00 fee will be charged for each returned payment. Two (2) returned payments will result in lease termination. 12. QUIET ENJOYMENT Tenants are entitled to quiet enjoyment of the Premises, provided lease obligations are fulfilled. 13. INSPECTIONS The Landlord and Tenant will conduct inspections upon move-in and move-out. Both must sign Initial and Final Inspection Reports, which will determine any deposit deductions. 14. USE OF PREMISES The Premises shall be used solely for residential purposes. Commercial activities and large gatherings that disrupt the neighborhood are prohibited without written approval. 15. OCCUPANTS Only individuals and pets listed in the lease may reside on the Premises. Guests staying more than seven (7) consecutive days require written permission. 16. CONDITION OF PREMISES Tenants must promptly report any uninhabitable conditions. Landlord must be granted access for repairs. If issues remain unresolved, the lease may be terminated with prorated rent. 17. SUBLETTING Subletting or lease assignment is strictly prohibited without prior written consent from the Landlord. Unauthorized subletting is grounds for termination. 18. PROHIBITED ACTIVITIES Storing hazardous materials or engaging in illegal activities on the Premises is strictly prohibited and will result in immediate termination and forfeiture of the deposit. 19. UTILITIES Tenants are responsible for paying electricity, gas, and water (MLGW). The Landlord will assist in establishing accounts. Non-payment is a lease violation. A Ring system is provided at no cost. 20. ALTERATIONS No alterations or improvements may be made without prior written consent. Approved improvements become the property of the Landlord unless otherwise agreed. 21. DAMAGE TO PREMISES If the Premises are rendered uninhabitable through no fault of the Tenants, the lease will terminate, and rent will be prorated. 22. MAINTENANCE Tenants are responsible for maintaining the Premises in a clean and sanitary condition. Damage resulting from misuse or neglect is the Tenant's responsibility. 23. LAWN CARE Tenants are responsible for lawn maintenance. The Landlord may provide tools for use at the Tenant's own risk. 24. INSPECTION RIGHTS Landlord may conduct quarterly inspections with prior notice. Immediate entry is permitted in emergencies or for urgent repairs. 25. ABANDONMENT The Premises will be considered abandoned if Tenants are absent for 30 consecutive days without notice or if rent is unpaid for 15 days with no sign of occupancy. 26. EXTENDED ABSENCE Tenants must notify the Landlord of any absence exceeding 14 consecutive days. 27. SEVERABILITY If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in effect. 28. RENTERS INSURANCE Tenants are required to maintain renters insurance. The Landlord is not responsible for loss or damage to personal property. Proof of insurance is required prior to move-in. 29. BINDING EFFECT This Agreement shall bind and benefit the Parties and their respective heirs, successors, and permitted assigns. 30. GOVERNING LAW This Lease shall be governed by the laws of the State of Tennessee. 31. ENTIRE AGREEMENT This Agreement constitutes the entire understanding between the Parties. Any modifications must be in writing and signed by both Parties. 32. CUMULATIVE RIGHTS All rights under this Agreement are cumulative and do not limit other legal rights unless expressly stated. 33. WAIVER Failure by either party to enforce any provision does not constitute a waiver of that provision or any other. 34. SIGNAGE The Landlord may post "For Rent" or "For Sale" signs during the final 30 days of tenancy. Tenants may not post any signs without prior written consent. 35. INDEMNIFICATION To the extent permitted by law, Tenants agree to indemnify and hold the Landlord harmless from any claims, liabilities, or damages resulting from their use of the Premises, except where caused by the Landlord's negligence.
