Month-To-Month Rental Agreement A. RENT The Tenant agrees to pay for sewer, water, garbage pickup and all other utility charges. Rent per month shall be $4200. This rent is due the 1st of the month -- received by the 3rd day of each month. If the rent originally commences on a day other than the first, the rent shall be adjusted to the first of the next month. Tenancy from that point on shall be from Month-to-Month on the first day of the month. If a check is returned for any reason, there will be a $25.00 charge added to the full amount of the rent plus late charges (Article G). B. USE The house shall be a residence with no more than 3 adults without prior written consent of the owner (children exempt). Occupancy by guests staying over 15 days will be considered in violation of this provision. The tenant shall not sublet this house. This prohibition includes "sharing" arrangements -- and specifically, AirBNB or any similar participation is prohibited. No pets will be allowed. The tenant agrees to maintain a "no smoking" policy within the house interior. The tenant will properly operate plumbing, electrical, and heating systems. Regular and normal maintenance is the renter's responsibility, such as, but not limited to: disposing of trash and changing light bulbs. C. DEPOSIT Tenant agrees to pay $4200 security-damage-cleaning deposit. This deposit is totally refundable. Tenant understands that all or a portion of the deposit may be retained by the owner upon termination of tenancy if the tenant fails to return the home in the condition as outlined by the Check-In/Out Checklist. In addition, the renter might be responsible for charges that go beyond the amount of the deposit. The Tenant is expected to clean and restore the house to its condition at commencement of tenancy - - less normal wear and tear as outlined by Statute. Should the tenant be unable to perform these jobs, charges for painting, repairs, or cleaning will be charged at $200 per hour plus materials. Deposit (without interest), with specific accounting for any amount withheld, will be returned within 21 days after the tenant vacates. D. PUBLIC REGULATIONS The tenant shall conform to all applicable provisions of municipal, county and state codes, statutes, ordinances and regulations pertaining to use, occupation or maintenance of the premises. E. ACCESS The tenant shall allow owner access with 48-hour notice to make necessary repairs or improvements. Notice of 24-hours will be given to show the house. Tenant grants the Owner access without notice to the house for emergencies. F. LATE CHARGES Rent is due on the 1st received by the EOD the 3rd day of the month. The tenant understands that if the total rent is not received prior to the end of the 3rd day of the calendar month, there will be a $10 late charge assessed on a daily basis for each day thereafter that the rent remains delinquent. G. NOTICE TO VACATE Tenant agrees that to terminate tenancy, the owner must receive notice to vacate 20 days prior to the end of the month per state statute. Termination of this Rental Agreement shall always be on the last day of the month unless otherwise amended. The owner may give a 3-day written notice to vacate the property after failure to pay rent in full. The owner may give a 30-day notice to vacate the house with specific reason. H. LIABILITY Tenant agrees that all personal property in the house shall be at the risk of the tenant. Tenant further agrees not to hold the owner liable in any matter for or on account of any loss or damage sustained by action of any third party, fire, water, theft, or the elements, or for loss of any articles from any causes from said house or any other part of said premises. Neither shall the owner be liable for any injury to the tenant, family, guests, employees, or any person entering the premises. I. ATTORNEY Tenant agrees to pay all costs, expenses, and attorney fees as allowed by law, expended or incurred by the owner by reason of any default or breach by tenant of any of the terms of this agreement. J. DISPUTES The owner asks that in the event a dispute arises concerning the terms of this agreement or the rental of the property, both parties will cooperate in submitting the dispute to mediation through the Seattle-King County Dispute Resolution Center, or another mutually acceptable mediator prior to initiating litigation. In the event the matter is ultimately litigated the substantially prevailing party shall be reimbursed by the other party for its litigation costs and other costs which are not considered to be within the statutory definition of litigation costs, and for reasonable attorney fees. Right to Legal Counsel: City of Seattle law provides renters who are unable to pay for an attorney the right to free legal representation in an eviction lawsuit. K. JURISDICTION In any dispute litigated under the terms of this agreement, the Superior Court for King County, Washington shall have exclusive jurisdiction and venue; and the laws of the State of Washington shall apply. L. ALTERATIONS AND REPAIRS The tenant shall not paint, repair, or make any physical changes without the owner's written approval. The tenant shall not remove or replace antique or existing fixtures. The tenant will report leaky faucets, failed smoke alarms, and dangerous conditions immediately. M. YARD MAINTENANCE The tenant is not responsible for weeding flower beds, raking leaves, and mowing lawns. The Owner provides yard service for the house. The tenant should expect yard maintenance 8AM 5PM, daily without prior notice.
