Residential Lease Agreement 5237 S Francisco Ave, 2nd Floor, Chicago, IL 60632 1. Parties and Property This Residential Lease ("Lease") is made as of the date of the last signature below between Joseline Diaz ("Landlord"), acting through Landlord's managing agent Elevation Point Properties LLC, an Illinois limited liability company ("Managing Agent"), and [TENANT FULL LEGAL NAME(S)] (each and together, "Tenant") for the residential unit described below. 1.1 Unit. The leased premises are 5237 S Francisco Ave, 2nd Floor, Chicago, Illinois 60632 (the "Unit"), a residential apartment in the [two / three]-unit building at that address (the "Building"). The Unit has its own private front entrance. The Unit is leased together with the non-exclusive right to use, in common with Landlord and the other residents of the Building, the rear common area and rear stairs serving the Unit, and the front and back yards (together, the "Shared Areas"), subject to Section 8.12. No basement, garage, storage area or other part of the Building or grounds is included. No laundry facilities are provided, and Tenant may not install a washer or dryer in the Unit; if Landlord later adds laundry facilities, their use will be offered by a written addendum. 1.2 Included equipment; appliances not included. The Unit is delivered with a central gas furnace and central air conditioning, which remain Landlord's property and are maintained by Landlord under Section 9. The Unit does not include a refrigerator, stove or any other kitchen appliance. Tenant will supply Tenant's own refrigerator and stove at Tenant's cost, subject to Section 8.10, and will remove them at move-out. Landlord makes no representation about any equipment other than the furnace, air conditioning and fixtures permanently attached to the Unit. 1.3 Occupants. Tenant represents that the Unit will be occupied only by the persons listed below, and that this list is complete and accurate: Name Relationship to Tenant Adult or minor [TENANT] Tenant (signs the Lease) Adult [__________] [__________] [__________] [__________] [__________] [__________] Total number of occupants: [__]. No other person may move into or live in the Unit during the Term. Tenant will not add roommates, partners, relatives, friends or any other person as an occupant without Landlord's prior written consent, which Landlord may give or withhold in its discretion subject to applicable law. A person who stays beyond the guest limits in Section 8.2 is an unauthorized occupant, and allowing one is a material breach of this Lease. The only exception is a child under 18 who is born to, adopted by, or placed in the legal custody of Tenant during the Term; Tenant will notify Landlord in writing within 10 days after such a child begins living in the Unit. Every adult occupant must be approved by Landlord and must sign this Lease as a Tenant. 1.4 Owner-occupied building. Landlord, Joseline Diaz, holds title to the Building and lives in it with her household; the Building contains three dwelling units. Because the Building is owner-occupied and has six or fewer units, it is exempt from the Chicago Residential Landlord and Tenant Ordinance (Chicago Municipal Code Chapter 5-12), except that Sections 5-12-130(j) (notice periods for non-renewal and rent increases) and 5-12-160 (prohibition on lockouts) apply by their terms. Nothing in this Lease adopts, incorporates or extends any other provision of that ordinance to this tenancy. Landlord has appointed Managing Agent to manage the Building. Managing Agent is authorized to collect rent and other payments, receive notices and requests, give notices and consents on Landlord's behalf, arrange maintenance and repairs, and enforce this Lease. The names, addresses and telephone numbers of Landlord and Managing Agent appear in Section 14. Tenant will direct every payment, request, question, complaint and notice to Managing Agent at the contact information in Section 14, and not to Landlord personally, at Landlord's residence, or in person at the Building, except in an emergency involving immediate danger to persons or property. A communication delivered only to Landlord personally or at Landlord's unit, rather than to Managing Agent, is not effective notice under this Lease. 1.5 Condition at move-in. Tenant has inspected the Unit and accepts it in its present condition, except for items noted on the Move-In Condition Checklist signed by both parties at the time keys are delivered. Landlord will deliver the Unit clean, with all included appliances working, and in compliance with the Chicago Municipal Code. 2. Basic Terms and Fee Summary Every non-optional charge under this Lease is listed in the table below. No other mandatory fee is charged. Utilities are not included in rent except where the table says so. Item Terms Lease term 12 months, from [START DATE] through [END DATE] at 11:59 p.m. (Section 3) Monthly rent $1,800.00, due on the 1st day of each month (Section 4) Security deposit (refundable) $2,700.00, equal to 1.5 months' rent, due before keys are released; returned under the terms of Section 5 Move-in fee None. No move-in fee, administrative fee or other non-refundable charge is collected Late fee $75.00 if the full rent is not received by the end of the 3rd day of the month, calculated as $10 plus 5% of the portion of monthly rent above $500, which the parties agree is a reasonable late charge (Section 4) Returned-payment fee $35.00 for each payment returned unpaid or reversed (Section 4) Utilities Tenant pays directly Electricity (ComEd) and natural gas (Peoples Gas), in Tenant's name, including heat, cooking and hot water supplied through those services (Section 6) Included in rent Water and sewer; trash and recycling collection; snow removal; lawn and landscaping (Section 6) Parking None provided. Public street parking only, subject to City rules (Section 7) Pets Not permitted, except assistance animals required by law (Section 7). Occupants: only the persons listed in Section 1.3; no additional occupants, no subletting, no short-term rentals (Sections 1.3 and 8.3) Smoking and vaping Prohibited in the Unit, the Building, the rear stairs and common area, and within 15 feet of entrances (Section 7) Renter's insurance Required before move-in, with Landlord named as interested party (Section 11) Due before keys are released First month's rent ($1,800.00) plus the security deposit ($2,700.00), total $4,500.00, plus proof of renter's insurance 3. Term and Renewal 3.1 Fixed term. The term of this Lease ("Term") begins on the Start Date and ends on the Expiration Date stated in Section 2. The Term does not renew automatically, and this Lease does not convert to a month-to-month tenancy unless Landlord agrees in writing. 3.2 Renewal offer. No later than 60 days before the Expiration Date (or 120 days if Tenant has then occupied the Unit for more than three years), Landlord will deliver to Tenant a written Renewal Notice stating either (a) that Landlord offers to renew this Lease for a further 12-month term at the monthly rent stated in the notice, which may be higher than the current rent, together with any changed terms, or (b) that Landlord will not renew. Landlord will not require Tenant to commit to a renewal more than 90 days before the Expiration Date. 3.3 Acceptance. To renew, Tenant must sign and return the renewal lease or renewal addendum by the acceptance date stated in the Renewal Notice, which will be at least 14 days after delivery. A renewal is effective only when signed by both parties. If Tenant does not accept in writing by the acceptance date, the offer lapses, this Lease ends on the Expiration Date, and Tenant must vacate and surrender the Unit under Section 12. 3.4 Tenant's notice of intent to vacate. Tenant will tell Landlord in writing at least 30 days before the Expiration Date whether Tenant intends to move out. Failure to give this notice does not extend the Term and does not create any obligation to renew. 3.5 Fair Notice Ordinance. The notice periods in Chicago Municipal Code 5-12-130(j) apply to any non-renewal or rent increase: 30 days where Tenant has occupied the Unit for less than six months, 60 days for six months to three years, and 120 days for more than three years. If Landlord gives less notice than the ordinance requires, Tenant may remain in the Unit at the current rent for the period the ordinance provides. 3.6 Early move-out by Tenant. Tenant has no right to end this Lease before the Expiration Date except as provided by law (including the Illinois Safe Homes Act, the Servicemembers Civil Relief Act, the Illinois Radon Awareness Act and the Illinois Residential Tenants' Right to Repair Act). If Tenant vacates early, Tenant remains liable for rent through the Expiration Date or until the Unit is re-rented, whichever comes first, less the rent Landlord collects from a replacement tenant, plus Landlord's reasonable advertising costs. Landlord will take reasonable measures to re-rent the Unit at a fair rent and mitigate damages, as Illinois law requires (735 ILCS 5/9-213.1). 4. Rent and Payment 4.1 Monthly rent. Tenant will pay the Monthly Rent stated in Section 2, in advance, on or before the 1st day of each month of the Term, without demand, deduction or setoff except as permitted by law. The first month's rent is due before keys are released. Rent for any partial month is prorated on a 30-day month. 4.2 How to pay. Rent is payable to Managing Agent, for Landlord's account, by Zelle to the account Managing Agent designates in writing, or by check or money order payable to Elevation Point Properties LLC and delivered to Managing Agent's address in Section 14. Payment to Managing Agent is payment to Landlord. Landlord charges no transaction fee for any payment method. If Landlord ever adopts a third-party payment portal that charges a fee, Landlord will also offer a no-fee way to pay. Cash is accepted only if Landlord agrees in advance and gives a signed receipt. 4.3 Late fee. Rent is due on the 1st. If the full Monthly Rent is not received by 11:59 p.m. on the 3rd day of the month, Tenant will pay the Late Fee stated in Section 2, assessed on the 4th. The three-day window is a courtesy for bank processing and is not an extension of the due date; rent not received by the 1st is late, and Landlord may serve a notice of nonpayment at any time after the 1st regardless of the Late Fee. The Late Fee equals $10.00 per month plus 5% of the portion of Monthly Rent that exceeds $500.00, which the parties agree is a reasonable estimate of Landlord's added cost and inconvenience from late payment and not a penalty. Only one Late Fee may be charged per month. The Late Fee is a charge for late payment and is not itself rent. 4.4 Returned or reversed payments. Tenant will pay the Returned-Payment Fee stated in Section 2 for each payment that is returned unpaid, reversed or otherwise dishonored, plus any Late Fee that results. After two dishonored payments during the Term, Landlord may require all further payments by cashier's check or money order. 4.5 Application of payments. Landlord will apply payments first to unpaid charges other than rent, then to the oldest unpaid rent, except as the law requires otherwise. 4.6 Acceptance of late or partial payment. Landlord may accept a late or partial payment without waiving any right to collect the balance or to insist on timely payment in the future, except as the law provides otherwise. 4.7 Rent increases. Rent will not change during the Term. Any increase for a renewal term requires the written notice described in Section 3. 5. Security Deposit 5.1 Amount. Before keys are released, Tenant will pay Landlord a Security Deposit of $2,700.00, equal to one and one-half months' Monthly Rent. No move-in fee or other non-refundable charge is collected at move-in. Landlord will give Tenant a written or electronic receipt showing the amount and date received. 5.2 Purpose. The Security Deposit secures Tenant's payment of rent and other charges and Tenant's performance of this Lease. It remains Tenant's property, subject to Landlord's right to make the deductions described below. The deposit is not a limit on Tenant's liability, and Tenant may not treat it as payment of the last month's rent or any other rent. 5.3 How the deposit is held. Illinois law does not require a landlord of a building this size to keep the deposit in a separate account or to pay interest on it, and no interest will be paid. Landlord may hold the deposit with Landlord's other funds. If Landlord sells the Building, Landlord will transfer the deposit to the new owner and notify Tenant in writing within 14 days of the new owner's name and address, after which the new owner is responsible for the deposit. 5.4 Deductions. After Tenant vacates, Landlord may deduct from the deposit: (a) unpaid rent, late fees, returned-payment fees and other charges due under this Lease; (b) the reasonable cost to repair damage to the Unit or Building caused by Tenant, occupants, guests or animals beyond ordinary wear and tear; (c) the reasonable cost to clean the Unit to the condition in which it was delivered, if Tenant leaves it unclean; (d) the actual cost to replace unreturned keys and re-key the Unit's locks; (e) the reasonable cost to remove and store belongings left in the Unit; and (f) utility charges that were Tenant's responsibility and that Landlord paid. Landlord will not deduct for ordinary wear and tear or for repairs that are Landlord's responsibility. 5.5 Return. Within 30 days after Tenant vacates, Landlord will deliver to Tenant's forwarding address an itemized statement of any deductions, with paid receipts attached, or with written estimates if repairs are not yet complete, in which case Landlord will send the paid receipts within 30 days after the statement. Landlord will return the balance of the deposit within 45 days after Tenant vacates, by a single check or electronic payment payable to all Tenants jointly, in accordance with the Illinois Security Deposit Return Act (765 ILCS 710). If no deductions are made, Landlord will return the full deposit within 45 days. Tenant will give Landlord a forwarding address in writing at or before move-out; if Tenant does not, Landlord will send the statement and refund to Tenant's last known email and mailing address. 5.6 Shortfall. If the deductions exceed the deposit, Tenant will pay the difference within 30 days after receiving the itemized statement. 5.7 Acknowledgment. Tenant acknowledges that the deposit is refundable only as described in this Section and that no interest will be paid. Tenant's initials: ________ 6. Utilities and Services 6.1 Paid by Tenant. Tenant will open accounts in Tenant's name effective on or before the Start Date and pay directly to the provider for: (a) electricity (ComEd) and (b) natural gas (Peoples Gas). Heat, cooking and hot water for the Unit are supplied through these services and are Tenant's cost. Tenant will keep both services on continuously during the Term and will give Landlord proof of active accounts on request. Tenant may arrange internet, cable or phone service at Tenant's own cost; any installation that drills, mounts or wires into the Building needs Landlord's prior written consent, except as federal law permits within Tenant's exclusive-use area. 6.2 Provided by Landlord at no charge to Tenant. Landlord will provide and pay for: (a) water and sewer service; (b) trash and recycling collection through City of Chicago carts, which Tenant will roll to the alley on collection days as provided in Section 8.5(b); (c) snow and ice removal from the public sidewalk, front walk and rear entry; and (d) lawn care and landscaping. These services are included in Monthly Rent and carry no separate charge. 6.3 Heating cost disclosure. Because Tenant pays for heat, the City of Chicago Heating Cost Disclosure, showing the projected annual and average monthly heating cost for the Unit based on the prior 12 months, is attached and acknowledged by Tenant (Section 16). 6.4 Minimum heat. To prevent frozen pipes, Tenant will keep the Unit heated to at least 60 F from October 1 through April 30, including while away, and will tell Landlord if the Unit will be unoccupied for more than seven consecutive days. 6.5 If Tenant lets a utility lapse. If a Tenant-paid service is disconnected or billed to Landlord because of Tenant's failure, Landlord may pay it to protect the Building, and Tenant will reimburse Landlord within 15 days after receiving a copy of the bill. Landlord will never shut off or interfere with any utility serving the Unit; doing so is prohibited by Chicago Municipal Code 5-12-160. 6.6 Interruptions. Landlord is not liable for interruptions in utility service caused by the utility company, weather, repairs or other causes outside Landlord's control, but Tenant keeps all remedies under Illinois law if Landlord fails to provide a service Landlord is required to provide. 7. Parking, Pets and Smoking 7.1 Parking. No parking space, garage, driveway or vehicle storage is included in this Lease. Tenant and guests may use public street parking at their own risk and subject to City of Chicago regulations, permits, street-cleaning and snow rules. Landlord is not responsible for tickets, towing, theft or damage to any vehicle. Tenant will not park, store or repair any vehicle, trailer or inoperable vehicle on the Building's grounds, rear lot or alley frontage. 7.2 Pets. No pets or animals of any kind may be kept in the Unit or on the Building's grounds, even temporarily. Keeping an unauthorized animal is a breach of this Lease, and Tenant will pay for any resulting damage, cleaning, odor or pest treatment. This Section does not apply to a service animal or assistance animal that Landlord must allow as a reasonable accommodation under federal, Illinois or Chicago fair housing law; Tenant should submit any such request to Landlord in writing. 7.3 Smoking and vaping. Smoking or vaping of tobacco, cannabis or any other substance is prohibited inside the Unit, in all common areas of the Building, on the rear stairs, and within 15 feet of any Building entrance or window. Tenant will not permit occupants or guests to do so. Growing or cultivating cannabis in the Unit or on the premises is prohibited. Smoke damage, odor removal and repainting caused by a violation are Tenant's cost. 7.4 Grilling and open flame. Charcoal or gas grills, fire pits, fireworks and open flames may not be used on the rear stairs or landing, in the rear common area, or within 10 feet of the Building. 8. Use of the Unit and Tenant's Obligations 8.1 Residential use only. Tenant will use the Unit only as a private residence. No business that involves customers, clients, employees, inventory, manufacturing, frequent commercial deliveries or signage may be run from the Unit. Working from home on a computer is permitted. 8.2 Guests. A guest may stay no more than 14 consecutive days, or 30 days in any 12-month period, without Landlord's prior written consent. A guest who stays longer, receives mail at the Unit, keeps belongings there, or holds a key is an unauthorized occupant under Section 1.3. 8.3 No subletting or assignment. Tenant will not sublet all or any part of the Unit, assign or transfer this Lease, or allow anyone other than the occupants listed in Section 1.3 to live in the Unit, for any length of time or for any payment, and will not list or offer the Unit on Airbnb, VRBO or any other short-term or vacation rental service. Any attempted sublease, assignment or short-term rental is void, is a material breach of this Lease, and is grounds for termination after the notice in Section 12.1. This prohibition does not affect Landlord's duty under Illinois law to make reasonable efforts to re-rent the Unit if Tenant moves out early (Section 3.6). 8.4 No alterations. Tenant will not paint, wallpaper, install flooring, add or change locks, install shelving, dishes or antennas on the exterior, or make any other alteration without Landlord's prior written consent, except that Tenant may hang pictures with small nails and may request lock changes as allowed by the Illinois Safe Homes Act. Approved alterations become Landlord's property unless Landlord requires removal. Tenant will not permit any lien against the Building. 8.5 Care of the Unit. Tenant will: (a) keep the Unit clean, safe and sanitary and in the condition received, ordinary wear and tear excepted; (b) place all garbage in the City black cart assigned to the Unit and recyclables in the blue cart, keep cart lids closed, never leave bags beside the carts, and take the Unit's carts to the alley every week on the City's scheduled garbage and recycling collection days and return them to their place afterward; (c) use plumbing, electrical and appliances only for their intended purpose, and never pour grease, wipes or solvents down drains; (d) keep the rear stairs, rear exit and yards clear of belongings, strollers, bicycles and trash, as the Chicago fire code and Section 8.12 require; (e) not use the rear stairs or landing for seating, storage or gatherings, and not overload them; (f) report water leaks, pest sightings, mold or any condition needing repair to Landlord promptly in writing, and report any suspected bed bugs within five days; (g) cooperate with inspections and pest treatment; (h) test smoke and carbon monoxide detectors monthly, replace batteries, and never disable a detector; (i) not keep flammable, explosive or hazardous materials on the premises; (j) not use extension cords as permanent wiring or leave portable heaters unattended; and (k) replace light bulbs and furnace filters in the Unit. 8.6 Noise and conduct. Tenant, occupants and guests will not disturb other residents or neighbors, will keep noise reasonable at all times and quiet between 10 p.m. and 8 a.m., and will not engage in or permit any illegal activity, nuisance or damage in the Unit or on the premises. 8.7 Keys. Landlord will provide Tenant with two complete sets of keys to every lock serving the Unit, including the front entrance, the Unit's door, the rear common door and any yard gate. Tenant will not duplicate keys. Tenant will pay Landlord's actual cost to replace lost keys and, if keys are not returned at move-out, the actual cost to re-key the Unit's locks. 8.8 Tenant's belongings. Landlord's insurance does not cover Tenant's personal property. Tenant should insure belongings under the renter's insurance required by Section 11. 8.10 Tenant-supplied appliances. Tenant may install one refrigerator and one gas or electric range in the kitchen. A gas range must be connected to the existing gas supply by a licensed plumber or a Peoples Gas-approved installer using a new, approved flexible connector and shutoff valve, and Tenant will give Landlord the installer's receipt within seven days after installation. Tenant will not alter gas piping, add outlets, or run extension cords for appliances. Landlord may inspect the connection after notice under Section 10. At move-out, Tenant will remove Tenant's appliances, have the gas line capped or the shutoff valve closed and tested by a qualified installer, and repair any damage from installation or removal. Tenant is responsible for any damage, leak or injury caused by Tenant's appliances or their installation. 8.11 Furnace and air conditioning. The central furnace and air conditioning serve the Unit and are controlled by the thermostat in the Unit. The furnace is located outside the Unit in a space Tenant does not have access to; Landlord will change the furnace filter and arrange routine service and repairs at Landlord's cost. Tenant will keep supply and return vents unblocked, use the thermostat only for normal temperature adjustment, and report any unusual noise, smell, short-cycling or loss of heating or cooling the same day. Tenant will allow access to the Unit under Section 10 when service requires it. Tenant pays only for repairs made necessary by Tenant's misuse. 8.12 Shared Areas and yards. The rear common area and rear stairs, and the front and back yards, are shared with Landlord and other residents. Tenant will keep them clear and clean at all times and will not leave, store or keep any belongings in them, including furniture, bicycles, strollers, grills, tools, toys, pools, trash, bags, boxes, vehicles or building materials, and will not treat any Shared Area as storage, unless Landlord has approved a specific item in writing. Items left in a Shared Area without approval may be removed by Landlord after 48 hours' written notice (immediately if they block an exit or create a hazard) and stored or disposed of at Tenant's cost. Tenant will not alter the yards, plant, dig, fence, or install anything in them, Tenant may use the front and back yards for parties and events, subject to the following. Tenant must request the date, time and yard in writing (text or email) at least two days before the event; requests may be made as far in advance as Tenant likes. Landlord will confirm in writing, and dates are reserved on a first-come, first-served basis among the Building's residents and Landlord. Ordinary daily use of the yards does not require a request. During any party or event, all music, voices and activity must be brought down to quiet-hours level by 10:00 p.m., guests must park on the street and not block the alley or neighbors' driveways, no grills or open flames may be used within 10 feet of the Building, and Tenant must remove all trash, decorations, furniture and equipment from the yards the same night or by 9:00 a.m. the next morning and leaves the yards clean. If Tenant holds a party or event without a confirmed request, or breaks any of these conditions, Landlord may by written notice revoke Tenant's privilege to use the yards for parties and events for the rest of the Term; this revocation is in addition to Landlord's other remedies, and repeated noise complaints, police calls or damage from an event are also a breach of this Lease. Tenant will pick up after guests and keep gates closed. Snow removal and landscaping remain Landlord's responsibility under Section 6.2. 8.13 Building security. Every exterior door, common-area door and yard gate that locks must be closed and locked immediately after Tenant, an occupant or a guest passes through it. Tenant will never prop open, wedge, tape, or disable a lock on any common door or gate, or leave one unlocked for a guest or delivery, because the safety of Landlord and the other residents depends on it. Tenant will not give keys or copies to anyone who is not a listed occupant, and will tell Landlord immediately if a key is lost or a lock is not working. Leaving a common door or gate unlocked or propped is a material breach, and Tenant is responsible for loss or damage that results. 8.9 Compliance with law. Tenant will comply with all laws, the Chicago Municipal Code, the Rules Addendum (Section 15) and any reasonable written rules Landlord later adopts for the safety and cleanliness of the Building, provided those rules apply equally to all residents and do not change the terms of this Lease. 9. Landlord's Obligations, Maintenance and Repairs 9.1 Landlord's duties. Landlord will maintain the Unit and Building in a safe, habitable condition in compliance with the Chicago Building Code and applicable Illinois law, including the roof, structure, foundation, common areas, the central furnace and air conditioning, plumbing, electrical system, water heater, windows, doors and locks, and smoke and carbon monoxide detectors; keep common areas clean and safe; and provide the services listed in Section 6.2. 9.2 Repair requests. Tenant will send all repair requests in writing by text message or email to Managing Agent at the contact in Section 14; Tenant will not bring repair requests to Landlord personally or to Landlord's unit. Managing Agent will complete repairs within a reasonable time based on the nature of the problem. For emergencies (no heat in winter, major water leak, no water, electrical hazard, break-in), Tenant will call Managing Agent's phone number immediately and may also contact 311. If Tenant smells gas, Tenant will leave the Unit and call Peoples Gas or 911 before calling Landlord. 9.3 Damage caused by Tenant. Tenant will pay the actual, reasonable cost of repairing damage caused by Tenant, occupants, guests or pets beyond ordinary wear and tear, including clogged drains caused by misuse, broken windows, and damage from unreported leaks. Landlord will provide an itemized invoice with receipts. Landlord will not charge Tenant for routine maintenance, normal wear, or repairs that are Landlord's responsibility. 9.4 Tenant's remedies. Nothing in this Lease limits the remedies available to Tenant under the Illinois Residential Tenants' Right to Repair Act (765 ILCS 742), which allows Tenant, after 14 days' written notice to Landlord, to have a required repair made and deduct its reasonable cost (up to the lesser of $500 or one-half of one month's rent) from rent, or under any other applicable law. Tenant may not use those remedies for a condition caused by Tenant, an occupant or a guest. 9.5 No retaliation. Landlord will not raise rent, reduce services, refuse to renew, terminate this Lease or threaten any of those actions because Tenant complained to Landlord or a government agency about the condition of the Unit, exercised a legal right, or joined a tenant organization. The Illinois Landlord Retaliation Act (765 ILCS 721) applies. 9.6 Pests. Landlord will treat any pest or bed bug condition that exists at move-in or that arises from the Building's condition, and will arrange a licensed pest professional within 10 days after Tenant's written report. Tenant will pay for treatment made necessary by Tenant's housekeeping, unauthorized animals, or belongings brought into the Unit, and will cooperate with preparation and treatment instructions. 9.7 Detectors. Landlord confirms that working smoke detectors and a carbon monoxide alarm within 15 feet of each sleeping area are installed in the Unit at move-in, as the Illinois Smoke Detector Act and Carbon Monoxide Alarm Detector Act require. Tenant will test them monthly, replace batteries in battery-operated units, never remove or disable a detector, and report any detector that does not work. 9.8 Landlord's entry for repairs. Landlord's entry for maintenance and repairs is governed by Section 10. 10. Landlord's Access 10.1 Notice. Landlord and Landlord's agents or contractors may enter the Unit after giving Tenant at least two days' notice by phone, text, email, mail or written note, to inspect, make repairs or improvements, supply services, or show the Unit to prospective tenants, buyers, lenders or insurers. Entry will be between 8:00 a.m. and 8:00 p.m. unless Tenant agrees to another time. Landlord may give one general notice to all affected residents when work on common areas or other units requires access. 10.2 Emergencies. Landlord may enter without notice in an emergency, or when repairs elsewhere in the Building unexpectedly require access, and will give Tenant notice of the entry within two days afterward. 10.3 Showings. During the last 60 days of the Term, Landlord may show the Unit to prospective tenants after the notice in Section 10.1. Tenant will not unreasonably refuse access and will keep the Unit in reasonably presentable condition for showings. 10.4 Tenant's absence. Tenant's absence does not prevent entry after proper notice. Landlord will leave the Unit secured after each entry. 11. Renter's Insurance, Liability and Casualty 11.1 Renter's insurance. Throughout the Term, Tenant will keep a renter's insurance policy with personal liability coverage of at least $100,000 per occurrence and will name Landlord as an interested party (additional interest) so Landlord is notified of cancellation. Personal property coverage is strongly recommended. Tenant will give Landlord proof of coverage before keys are released, at each renewal, and within five days of any request. Letting the policy lapse is a breach of this Lease, curable under Section 12.1. 11.2 Liability. Landlord is not liable for loss of or damage to Tenant's property, or for injury to Tenant, occupants or guests, except to the extent caused by Landlord's negligence or Landlord's failure to perform this Lease or the law. Tenant is responsible for injury or damage caused by Tenant, occupants, guests or animals. Nothing in this Lease limits Landlord's liability in a way prohibited by law. 11.3 Fire or casualty. If the Unit is damaged by fire or other casualty so that it is unfit to live in, and Tenant, occupants or guests did not cause the damage, Tenant may: (a) move out and give Landlord written notice of termination within 14 days, in which case this Lease ends as of the date of the casualty and Landlord will refund any rent paid for the period after that date; or (b) stay in the Unit if it is lawful and safe to do so, vacate any part made unusable, and pay rent reduced in proportion to the usable area until repairs are complete. If Landlord decides not to rebuild, or another part of the Building is materially damaged, Landlord may terminate this Lease on 30 days' written notice. Tenant is liable for repair costs if the casualty was caused by the negligence or deliberate act of Tenant, an occupant or a guest. 11.4 Flooding. Landlord's written flood disclosure under the Illinois Landlord and Tenant Act is attached (Section 16). Most renter's insurance policies do not cover flood damage; Tenant should ask the insurer about separate flood coverage. 12. Default, Termination, Surrender and Notices 12.1 Tenant default. Tenant is in default if: (a) Tenant fails to pay rent or any other amount when due and does not pay it within five days after Landlord's written demand (735 ILCS 5/9-209); or (b) Tenant breaches any other term of this Lease and does not cure the breach within 10 days after Landlord's written notice (735 ILCS 5/9-210), or the breach is one that cannot be cured. Landlord's notices will be served as Illinois law requires. 12.2 Landlord's remedies. After an uncured default, Landlord may terminate this Lease and recover possession through the Illinois eviction process, and may recover unpaid rent, charges under this Lease, damage to the Unit beyond ordinary wear and tear, rent through the Expiration Date less amounts received from re-renting and amounts Landlord applies from the Security Deposit, and court costs and attorney's fees only to the extent a court or statute allows them. Landlord will use reasonable efforts to re-rent the Unit and mitigate damages. Landlord will never use lockouts, utility shutoffs, removal of doors or belongings, or any other self-help; these are prohibited by Chicago Municipal Code 5-12-160, which applies to every residential rental unit in Chicago, and by Illinois law. 12.3 Landlord default. If Landlord fails to perform a material obligation, Tenant has the remedies provided by Illinois law, including Section 9.4. 12.4 Holdover. If Tenant stays in the Unit after the Term ends or after this Lease is terminated without Landlord's written consent, Tenant will pay rent for each day of holdover equal to twice the Monthly Rent prorated daily, or the maximum holdover rent allowed by law if less, and Landlord may begin eviction proceedings. Acceptance of holdover rent does not create a new tenancy. This Section does not apply during any period Tenant is entitled to remain under Section 3.5. 12.5 Surrender. On the Expiration Date or earlier termination, Tenant will: (a) remove all belongings and leave the Unit clean, with all included appliances, fixtures and keys in place, in the condition received except ordinary wear and tear; (b) return all keys and any remotes or fobs; (c) give Landlord a forwarding address in writing; and (d) attend a joint move-out walkthrough if either party requests one. Landlord will not charge any fee for the walkthrough. Within 30 days after Tenant vacates, Landlord will send Tenant an itemized statement, with receipts or estimates, of any damage charges Tenant owes. 12.6 Abandonment and abandoned property. The Unit is deemed abandoned if Tenant has told Landlord in writing that Tenant has moved out, or if rent is more than 30 days past due, Tenant's belongings have been substantially removed, and Tenant has not responded to Landlord's written notice within seven days. If Tenant leaves belongings in the Unit after surrender or abandonment, Landlord will send written notice to Tenant's last known email and mailing address and hold the belongings for seven days after the notice. If Tenant does not claim them in that time, Landlord may sell, donate or dispose of them and charge Tenant the reasonable cost of removal and storage. Landlord will not dispose of government identification, financial records or medical records, and will return them to Tenant on request. 12.7 Early termination rights preserved. Nothing in this Lease waives Tenant's right to end this Lease early under the Illinois Safe Homes Act (765 ILCS 750), the Servicemembers Civil Relief Act, the Illinois Radon Awareness Act, the flood disclosure provisions of the Illinois Landlord and Tenant Act, or the Illinois Landlord Retaliation Act. 12.8 Notices. Notices of termination, default, non-renewal and rent increase must be in writing and delivered by hand, by mail, or by another method permitted by law, to Managing Agent at the address in Section 14 (for notices to Landlord) or to Tenant at the Unit. All other notices and repair requests may be sent by email or text message to Managing Agent's contacts in Section 14. Notices from Managing Agent have the same effect as notices from Landlord. Either party may update its address, email or phone number by written notice to the other. Notices to Tenant after the Start Date may be delivered to the Unit. 13. General Provisions 13.1 Governing law. This Lease is governed by the laws of the State of Illinois and the ordinances of the City of Chicago that apply to this tenancy. As stated in Section 1.4, the Building is owner-occupied and contains three units, so it is exempt from the Chicago Residential Landlord and Tenant Ordinance except Sections 5-12-130(j) and 5-12-160; this Lease does not adopt or incorporate any other part of that ordinance, and no reference in this Lease to a notice period, remedy or practice that resembles one in that ordinance makes the ordinance applicable. If any term of this Lease conflicts with applicable law, the law controls and the term is unenforceable to that extent, and the rest of this Lease remains in effect. 13.2 Entire agreement. This Lease, the Rules Addendum and the attachments listed in Section 16 are the entire agreement between the parties. Any change must be in writing and signed by Landlord and Tenant. No oral promises or representations are part of this Lease. 13.3 Joint and several liability. Each person signing as Tenant is responsible, individually and together, for all obligations under this Lease, and notice to one Tenant is notice to all. 13.4 No waiver. Landlord's acceptance of rent or failure to enforce a term on one occasion does not waive Landlord's right to enforce it later, except as the law provides otherwise. 13.5 Fair housing. Landlord does not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, ancestry, age, marital status, parental status, familial status, disability, military status, source of income, immigration or citizenship status, order of protection status, or any other class protected by federal, Illinois, Cook County or Chicago law. Landlord will not inquire about or act on a Tenant's immigration or citizenship status, as the Illinois Immigrant Tenant Protection Act provides. 13.6 Sale of the Building. If Landlord sells the Building, this Lease continues and the new owner takes Landlord's place from the date of transfer. Landlord will notify Tenant in writing of the new owner's name and contact information. 13.7 Severability. If any term is held invalid, the remaining terms stay in effect. 13.8 Electronic signatures. The parties may sign this Lease electronically, and signed copies delivered by email or through a leasing platform are as effective as originals. 13.9 Time is of the essence. Dates and deadlines in this Lease are material terms. 13.10 Language. Landlord may provide a Spanish courtesy translation of this Lease. The English version is the binding agreement. / El propietario puede entregar una traduccion al espanol como cortesia; la version en ingles es el contrato vinculante. 13.11 Acknowledgment of attachments. Tenant acknowledges receiving, before signing, each document listed in Section 16, including the Illinois Summary of Rights for Safer Homes, the Chicago Heating Cost Disclosure, the radon, flood and lead-based paint disclosures, and the Chicago bed bug brochure. 14. Rules Addendum This Rules Addendum is part of the Lease for 5237 S Francisco Ave, 2nd Floor. Capitalized terms have the meanings given in the Lease. If a rule conflicts with the Lease, the Lease controls. Trash and recycling Bag all garbage and place it inside the Unit's City black cart; place recyclables loose in the blue cart. Keep lids closed. Do not leave bags on the ground, in the gangway or on the rear stairs. Roll both carts to the alley every week on the City's garbage and recycling days and bring them back after pickup. Large items (furniture, mattresses) require a City bulk pickup request or private disposal; do not leave them in the alley. Shared areas, yards and exits Keep the rear common area, rear stairs, and the front and back yards clear at all times. Nothing may be stored in any shared area or yard without Landlord's written approval (Lease Section 8.12). Items left there may be removed at Tenant's cost. Do not use the rear stairs or landing for seating, storage or gatherings. Parties belong in the yards (see below). No grills, fire pits or open flames on the rear stairs, in the rear common area, or within 10 feet of the Building (see Lease Section 7.4). Lock every common door and yard gate behind you, every time. Never prop a door open or leave it unlocked for someone else; other people live here (Lease Section 8.13). Inside the Unit No smoking or vaping of any substance anywhere in the Unit or Building (Lease Section 7.3). No pets (Lease Section 7.2). No candles or incense left burning unattended. No space heaters left running when the Unit is unoccupied. The Unit has central air conditioning. Window air-conditioning units may not be installed without Landlord's written approval. Landlord changes the furnace filter; report any heating or cooling problem the same day (Lease Section 8.11). Report leaks, drips, running toilets, pests, mold or peeling paint to Landlord in writing right away. Do not flush wipes, paper towels or hygiene products. Do not pour grease down any drain. Keep windows closed and heat on during freezing weather; keep the Unit at 60 F or warmer from October 1 through April 30. Noise Quiet hours are 10:00 p.m. to 8:00 a.m. Keep music, television and conversation at a level that cannot be heard in other units. Keys and locks Do not duplicate keys or add locks (Lease Section 8.4). Report lost keys immediately. Vehicles Street parking only. No vehicle storage, repairs or washing on the Building's grounds. Other Parties and events are welcome in the front and back yards. Request the date in writing at least 2 days ahead (earlier is fine); dates go first-come, first-served and Landlord confirms in writing. Quiet by 10:00 p.m., guests park on the street, no grills or open flames near the Building, and clean up completely the same night or by 9:00 a.m. the next morning. Breaking these rules, or holding an event without a confirmed request, means losing party and event use of the yards for the rest of the lease (Lease Section 8.12). Snow and ice removal and landscaping are handled by Landlord at no cost to Tenant; Tenant may not alter the yards, plantings or fencing, and must pick up after guests and keep yard gates closed. Landlord may adopt additional reasonable written rules for safety and cleanliness that apply to all residents, after 30 days' written notice. Tenant initials: ________ Landlord initials: ________ 16.
