"Termination and Notice of Intent to Vacate:
Early Termination:
a. Notice of Intent to Vacate: In the event of early termination before the designated end date of the lease agreement, the renter agrees to provide a minimum of 45 days written notice of their intent to vacate the rental property. The notice should clearly state the intended date of vacating the premises.
b. Rent Liability and Replacement Tenant: If the renter terminates the lease agreement before the designated end date and provides the required 45 days notice of intent to vacate, they will be responsible for paying the rent up until the intended date of vacating. And any cleaning fee after vacating to be transferred by the renter
c. Security Deposit: The security deposit will not be returned to the renter if a new tenant lease is not executed by end of 45 days notice.
Notice at the End of the Term:
a. Notice of Non-Renewal: If the renter intends to vacate the rental property at the end of the term without early termination, they agree to provide a minimum of 45 days written notice prior to the end of the lease term. The notice should clearly state the intended date of vacating the premises.
b. Rent Liability and Replacement Tenant: If the renter provides the required 45 days notice and vacates the property at the end of the lease term, they will not be liable for any rent beyond the lease term, provided all other obligations of the lease agreement have been fulfilled.
c. Security Deposit: The security deposit will be returned to the renter, minus any deductions for unpaid rent, damages, or cleaning fees, within the timeframe specified by local laws and regulations, after the end of the lease term.
Insufficient Notice at the End of the Term:
a. If the renter fails to provide the required 45 days notice at the end of the term, they will be responsible for paying the rent for the following month. The rent will be due and payable as if the lease term had been extended for an additional month.
The renter acknowledges that failure to comply with the termination and notice requirements may result in additional penalties or legal action.
The renter acknowledges and agrees that the owner shall not be liable for any insurance claims, damages, losses, injuries, accidents, legal actions, or expenses arising from the renter's use, occupancy, or presence on the property, including but not limited to:
Personal injuries or property damage caused by the renter, their guests, or any third party present on the premises with the renter's consent.
Theft, loss, or damage to personal property belonging to the renter or their guests.
Acts of nature, including but not limited to storms, floods, earthquakes, or other natural disasters.
Fire, water damage, or any other unforeseen events resulting from causes beyond the owner's control.
Failure or malfunction of any appliances, utilities, or systems within the property, including electrical, plumbing, heating, or cooling systems.
Any disturbances, nuisances, or illegal activities conducted by third parties neighboring the property.
Any disputes or conflicts between the renter and other tenants, neighbors, or individuals in the vicinity of the property.
Any health or safety hazards or conditions caused by the renter's failure to maintain cleanliness, hygiene, or compliance with applicable laws and regulations.
The renter agrees to maintain a valid renters insurance policy throughout the term of this agreement, with coverage including personal liability and property damage. The renter shall provide proof of such insurance to the owner on the first day of the contract term. The owner shall not be responsible for any claims, damages, or losses that should be covered by the renter's insurance policy.
The renter further agrees not to bring any legal action or lawsuit against the owner, their representatives, or agents for any reason, including but not limited to disputes related to the rental property, tenancy, or this agreement. The renter releases and discharges the owner from all liability, claims, demands, suits, and causes of action, whether known or unknown, arising from any circumstances related to the rental property or this agreement.
The renter acknowledges that this clause is a material condition of this agreement and that failure to comply with this clause may result in termination of the tenancy and other legal remedies available to the owner.
The renter expressly agrees to indemnify, defend, and hold the owner harmless from any claims, damages, losses, expenses, or legal actions brought against the owner as a result of the renter's use, occupancy, or presence on the property or any violation of this agreement
