Lease Agreement This lease agreement is between David Ahijevych, hereinafter referred to as "owner," and John Doe, hereinafter referred to as "resident." Leased Premises Owner leases to the resident the premises known as: 6054 Gunbarrel Ave, Unit F Boulder, CO 80301 This includes a refrigerator, dishwasher, stove, microwave, clothes washer, and dryer. Only the resident(s) who have signed this lease may live on the premises. Term The term of this lease is from A to B, with the possibility of extension. If the resident retains possession of the premises after the expiration of the fixed lease term without permission from the owner, the resident will be subject to eviction. Partial months will be charged on a prorated basis. Rent Rent is $1,850 per month, due on the 1st of each month. Rent may be paid by ACH (automatic transfer from resident's bank) or Venmo. If the resident does not pay all rent by the 5th day of the month, they will incur a $20 late fee, plus $10 per day until paid in full. The resident will also reimburse the owner for any fees resulting from non-sufficient funds. Security Deposit In addition to the first month's rent, a $2000 security deposit is due before move-in. If the resident has an approved pet, an additional $400 refundable pet deposit will also be required. After move-out, the cost of cleaning or damage repair needed to restore the premises to move-in condition will be deducted from the security and pet deposits. Any outstanding rent or penalties will also be deducted. The remainder of the deposits will be returned to the resident within 30 days of moving out. Indemnification and Release The owner shall not be responsible for loss, injury, or damage to the personal property of the resident or their guests, caused directly or indirectly by acts of God, fire, smoke, theft, malicious acts, riots, civil commotion, the elements, defects in the building or furnishings, defects in the walks or landscaping, or by the neglect of other residents of contiguous property. The owner shall not be liable for any loss caused by the failure to make available water, sewer, electricity, or gas. The owner does not insure and is in no way responsible for the personal property of the resident. The resident is strongly encouraged to obtain renter's insurance covering personal property, personal liability, and pet-related damage (if applicable). This insurance provides protection against losses not covered by the owner's policy. Utilities The resident will set up an account with Xcel Energy to pay for gas and electricity. Rent includes trash and snow removal, as well as water. The resident is responsible for placing trash and recycling in the designated containers and for following all waste disposal and recycling rules established by the Powderhorn Condo Association. Improper disposal may result in fines or penalties, which will be the responsibility of the resident. Use of Premises The resident shall use the leased premises exclusively for private residential purposes. The resident agrees not to violate any federal or state law or city ordinance, nor to wastefully use any utilities furnished by the owner. The resident agrees that no resident or visitor will smoke inside the leased premises. Use of the fireplace for burning items is strictly prohibited, as it may cause smoke to back up into the unit, resulting in smoke damage and health hazards. Any use of the fireplace for burning will be considered a lease violation and may result in financial liability for cleaning and damage repair. Inspection The resident will permit the owner to enter the premises to make emergency repairs or retrieve items that belong to the owner. The owner will make reasonable attempts to notify the resident 24 hours in advance before entering. Repairs and Maintenance The resident agrees that they have received the leased premises in good order and condition. The resident agrees to repair, at their sole expense, any damage caused by them, their guests, or their pets. The resident agrees to keep the garbage disposal free from clogs, remove excess lint from the dryer screen, and promptly notify the owner of any damaged, broken, or malfunctioning appliance, equipment, or part of the premises. The owner shall be responsible for maintenance and repair of the premises and any damaged or malfunctioning appliances or fixtures upon receipt of notice. Upon vacating the premises, the resident is required to have the carpet professionally cleaned and to provide the owner with a valid receipt from the cleaning company. Failure to do so will result in the cost of professional carpet cleaning being deducted from the security deposit. Pet Policy One pet (either a cat or a dog) is allowed on the premises, subject to the following conditions: - The pet must weigh 20 pounds or less. - Only one pet is permitted. - The resident must obtain written approval from the owner before bringing the pet onto the premises. - An additional refundable pet deposit of $400 is required before move-in or pet occupancy. - The resident is responsible for any damage caused by the pet, including damage to floors, doors, walls, furniture, or landscaping. - Pet waste must be promptly removed from common areas. Violation of this policy may result in the loss of pet privileges, additional charges for cleaning or damage, or termination of the lease. Condo Association This lease is subject to the terms of the Powderhorn Condo Association, including the Declarations, By-laws, and Rules and Regulations of the Association. Any failure of the resident to comply with these terms shall be considered a default under this lease and may be enforced by the Board of Directors. The resident will be responsible for paying any fines assessed against the unit for rule violations. Modification, Severability, and Waiver This lease may only be modified by written agreement between the parties. The unenforceability of any provision of this lease shall not affect the enforceability of the remaining provisions. Any waiver by either party of a breach of any provision shall not be considered a continuing waiver of a subsequent breach.
