SINGLE FAMILY ONLY. 1. ASSIGNMENT AND SUBLETTING: Tenant agrees that the Property shall not be occupied by any person(s) other than those previously identified in this lease as Lessee and/or Tenant. Tenant shall not sublet the Property or assign this lease or permit any transfer of Tenant interest in the Property. 2. TERMS OF LEASE: The term of the lease begins on, and will continue through. 3. RENT: Tenant agrees to pay the total sum of $26,400.00 /year as rent ($2,200 monthly). All rent payments, payable to, are due (if mailed, must be postmarked) no later than the 1st day of each month. Any fees associated with processing rent payments shall be the responsibility of the Tenant. Rents may be paid: Tenant may mail checks early and post-date checks to due date. Tenant may not deduct any rent payments from the security deposit. Unless otherwise addressed in this Lease Agreement, Tenant shall pay for electric, water and sewer, gas, cable, telephone, and all other utilities connected to the Property during lease period. 4. LATE FEES: If rent is not received by 6:00 pm on the due date, Tenant will be charged a late fee of $5.00 per day until the rent is paid. A bad check is considered non-payment of rent and Landlord will enforce late fee charges the same as non-payment, commencing with the date after the rent is due. In addition, a $35.00 service charge will be assessed against a check that is returned from the bank for whatever reason. All bad check must be redeemed in cash or money order. 5. TERMINATION OF LEASE DUE TO NON-PAYMENT OF RENT: Landlord shall have the right of terminating the lease should rent become delinquent. If rent is ten (10) or more days in default, the rent balance remaining under this lease contract shall become immediately due and payable. If Tenant is in default because of delinquent rent, Landlord may send Tenant a 10-day "Notice to Quit the Premises (Property)." The notice may be given in writing, mailed by United States Mail, to the Tenant and this written notification shall constitute notice. Tenant is responsible for any fees involved with serving Notice. If Tenant pays the amount due, or cures the default as stated in the "Notice to Quit the Premises" before the end of the ten (10)-day period, the Tenant's possession of the Property may continue. 6. SECURITY DEPOSIT: a. No later than at time lease expires, Tenant shall provide Landlord with forwarding address so Landlord shall be able to mail them any balance due for security deposit reimbursement. Tenant may not take action against Landlord for security deposit reimbursement should they fail to provide Landlord with forwarding address. Provided that Tenant provides forwarding address, all other terms contained within this paragraph 6 shall apply. b. AMOUNT. Tenant shall deposit with Landlord the sum of $2,200 as a security deposit for the performance of each and every provision of this lease. c. HOW IT MAY BE USED: Landlord may deduct from the security deposit the following charges: 1) any payments or parts thereof required by the terms of this lease which are not paid when due. 2) any attorney's fees Landlord incurs by the breach of provision(s) of this lease. 3) unpaid late fees or service charges as provided by this lease. 4) any court costs Landlord incurs by enforcement of the terms and provisions of this lease. 5) the cost of any repairs, replacements, redecorating, and/or refurnishings of the Property or any fixtures, systems, or appliances caused by other than normal wear and tear. 6) costs and expenses incurred by Landlord as a result of Tenant's breach of any provisions of this lease 7) a reasonable cleaning expense to return the Property to a condition as annotated in this Lease Agreement. 8) any unpaid utility bills incurred through date Tenant vacates the Property. d. HOW IT WILL BE RETURNED. If Tenant fully performs their obligations under the terms of this lease, the deposit will be returned by mail to the Tenant no later than thirty days after termination of the lease, after the lease period has ended and the Property has been vacated, and as soon as is reasonable.In no event is the Landlord obligated to return the deposit until within thirty (30) days after the Property is vacated and Landlord receives receipts showing that the final utility bills, which Tenant is obligated to pay under the terms of this lease, have been paid in full. Tenants are responsible for utilities through final date of lease, regardless of when Tenants vacate Property. If Tenants shut off utilities prior to end of lease and utilities need to turned on so Property can be professionally cleaned and/or repaired, the resulting utility cost that is incurred shall be the responsibility of the Tenant even if the utility service is started in the Landlord's name so that cleaning/repairs may be completed.
