Plenty of walking and bike paths. Small Water Park in subdivision. Mountain view, Dona Ana. TERM: 12-month lease...then converts on a month to month basis. On the last day of the Term of this Agreement, it will automatically be renewed as a month-to-month tenancy unless written notice of termination has been sent by either party no less than thirty (30) days prior to the beginning of the rental period. LATE FEE: If rent is not paid within three (3) days of the due date on the First (1st) of the month, Tenant will pay a penalty in the amount of $100 per occurrence. The Landlord/Owner will provide notice of the late fee no later than the last day of the rental period immediately following the period in which the default occurred. This is not a grace period. If notice of non-payment is issued to Tenant, a $50 service fee shall apply in addition to the late charge. DEPOSITS: Tenant will pay the amount of $1,750 as a deposit to be used by Landlord/Owner to recover any losses incurred as a result of Tenant's noncompliance with this Agreement including, but not limited to, unpaid deposits, damages, repair, cleaning, utilities, or rent. Tenant cannot use any part of the deposit in lieu of rent. Within thirty (30) days after the end of the term or departure, whichever is later, Landlord/Owner will provide to Tenant a written itemized statement showing any deduction from the deposit and then will return the balance of the deposit, if any, to Tenant. Deposits and prepaid rent will be held by Landlord/Owner. USE: The Property shall be used by Tenant only as a residence. Tenant agrees to limit the number of occupants and Landlord/Owner consents to occupancy by Tenant. Any change in the occupancy must be approved by Landlord/Owner in advance and in writing. PETS: Unless otherwise provided below in this paragraph, Dogs under 30 pounds, unless pet is a certified service dog to assist a disabled person. NO AGGRESSIVE BREEDS! The Landlord/Owner approves to allow Tenant to have one small dog. UTILITIES: Tenant will be responsible for the payment of all utilities including, but not limited to, water, gas/propane, trash, sewer, cable TV and Internet. Tenant must place all utilities for which Tenant is responsible in Tenant's name upon commencement of the term and must leave them in the Tenant's name until this Agreement is terminated. All utilities for which Tenant is responsible will be disconnected by Landlord/Owner three (3) business days after end of rental term. Any failure by Tenant to place Tenant's utilities in Tenant's name or to pay utility bills when due will constitute a breach of this Agreement. Landlord/Owner will have no liability if Tenant fails to contract or pay utilities. MAINTENANCE: Tenant agrees to maintain the exterior of the Property, including lawns, shrubs, plants, etc. in the back yard enclosed by rock wall. Maintenance includes watering, weeding and raking. A/C filter is to be changed every three (3) months. The Landlord/Owner will provide filters. It is Tenant's responsibility to change the provided filters and request filters in advance. Pest control is the responsibility of the Tenant. ADDITIONAL PROVISIONS: This is a non-smoking home. No smoking allowed anywhere on the Property. No hot tubs allowed on the Property. BBQ grills should not be used under the covered porch, but pulled out while in use. When Tenant moves out, carpets will be cleaned by Landlord/Owner and the cleaning fee charged to Tenant's deposit. When Tenant moves out, electricity and city utilities will be left on in Tenant's name for ten (10) days for landlord/Owner to perform cleaning and repairs. If the utilities are turned off prior to Ten (10) days, the cost of getting utilities turned on will be charged to Tenant's deposit. Only short nails/tacks to be used to hang things on walls. Wiring and plumbing can be damaged by nails and Tenant is responsible for any damage caused by nails. Tenant will be charged for holes in the walls. Tenant may not perform the work to repair holes or paint touch up. Tenant may not do any painting to the home.
