1. Smoking Prohibition
Smoking Prohibited. Smoking of any kind, including but not limited to cigarettes, cigars, pipes, vaping devices, or similar products, is strictly prohibited inside the dwelling unit. Violation of this provision shall constitute a material breach of the lease and may result in charges for cleaning, deodorizing, repairs, or termination of tenancy as permitted by Virginia law.
2. Pets
No Pets Allowed. No animals, pets, reptiles, birds, or other creatures are permitted on or about the premises at any time without the prior written consent of Landlord. This restriction does not apply to legally recognized service animals or assistance animals as required by applicable federal or state law. Unauthorized animals shall constitute a lease violation and may result in fees, damages, or termination of tenancy.
3. Security Deposit
Security Deposit. Tenant shall pay a security deposit in the amount of $2,000 upon execution of this Lease. The security deposit shall be held and applied in accordance with the Virginia Residential Landlord and Tenant Act and may be used to cover unpaid rent, damages beyond ordinary wear and tear, or other lawful charges. Any remaining balance shall be returned to Tenant within forty-five (45) days after termination of tenancy and delivery of possession.
4. Renters Insurance
Renters Insurance Required. Tenant shall maintain an active renter's insurance policy for the duration of the Lease term, with coverage for personal property and liability. Proof of insurance must be provided prior to move-in and upon renewal. Failure to maintain renter's insurance shall constitute a lease violation.
5. Rent, Grace Period, and Late Fees
Rent Due and Late Fees. Rent is due on the date stated in this Lease and shall be paid in full without demand. If rent is not received within five (5) days after the due date, Tenant agrees to pay a late fee of $150, which complies with Virginia law. Late fees shall not exceed the statutory maximum and shall be assessed only as permitted by law.
6. Utilities
Utilities. Tenant shall be responsible for the payment of all utilities and services serving the premises, including but not limited to electricity, water, sewer, trash, gas, cable, and internet, unless otherwise expressly stated in writing. Utilities shall be maintained in Tenant's name during occupancy.
7. Landlord Right of Entry
Right of Entry. Landlord or Landlord's agents may enter the premises with at least twenty-four (24) hours' prior notice for the purpose of inspection, repairs, maintenance, improvements, or showing the property, except in the case of emergency, abandonment, or as otherwise permitted by Virginia law.
8. Yard and Exterior Maintenance
Yard Maintenance. Tenant shall be responsible for routine lawn care and yard maintenance, including mowing, edging, trimming, weeding, snow removal and keeping exterior areas free of debris. Failure to maintain the yard may result in corrective action or charges for services performed by Landlord or third parties, as permitted by law.
9. Maintenance and Repairs
Maintenance and Repairs. Tenant shall keep the premises in a clean, safe, and sanitary condition and shall promptly notify Landlord of any maintenance issues or conditions requiring repair. Tenant shall be responsible for damages caused by misuse, neglect, or failure to report issues in a timely manner.
10. Alterations
Alterations and Improvements. Tenant shall not paint, install fixtures, mount televisions, or make any alterations to the premises without prior written consent of Landlord. Any approved alterations may be required to be removed and the premises restored to its original condition at Tenant's expense prior to move-out.
11. Occupancy and Guests
Occupancy Limits. Only the individuals listed in this Lease may occupy the premises. Guests may not remain on the premises for more than 14 days without Landlord's written consent. Extended or unauthorized occupancy shall constitute a lease violation.
12. Lead-Based Paint Disclosure
Lead-Based Paint Disclosure. Because the dwelling was constructed prior to 1978, Tenant acknowledges receipt of all required lead-based paint disclosures, pamphlets, and notices in compliance with federal law.
13. Lease Violations and Remedies
Default. Any violation of the Lease terms may be considered a default. Landlord may pursue all remedies available under Virginia law, including notice to cure, termination of tenancy, and recovery of damages.
