Purpose of This Addendum This policy sets clear expectations for guest visits to protect the peaceful enjoyment of all tenants, maintain safety, and prevent unauthorized occupants. Guest policies are a commonly used and legally permissible addendum in Minnesota residential leases. 2. Definitions Guest A "Guest" is any person who is not listed as a Tenant on the Lease and who visits or temporarily stays at the Premises. Unauthorized Occupant Any person residing in the unit without being screened or approved through the landlord's application process. 3. Length of Stay Limits Tenant agrees to the following: a. Short-Term Visits Guests may visit for up to 14 total days within any 60 day period without prior written approval from the Landlord. b. Longer Stays Require Approval A guest staying more than 14 cumulative days within a 60 day period requires written permission from the Landlord. This prevents unauthorized occupancy, which Minnesota landlords may regulate through lease terms as long as they do not violate statutory tenant rights. 4. Tenant Responsibilities Regarding Guests Tenant is responsible for: Ensuring all guests follow all terms of the Lease and this Addendum. Any damage, nuisance behavior, or violations caused by guests. Ensuring guests do not interfere with other tenants' privacy or quiet enjoyment (protected under Minnesota tenant privacy and habitability laws). Ensuring guests do not engage in unlawful acts prohibited in Minnesota rental housing. 5. Restrictions on Guest Behavior The following are prohibited: Guests using or storing illegal substances Guests engaging in unlawful activities (prohibited under Minn. Stat. 504B.171) Guests disturbing neighbors, causing noise violations, or damaging property Guests occupying the unit as a residence without being screened and added to the lease. 6. Overnight Guests Overnight guests must comply with length of stay limits stated above. Tenant may not allow a guest to establish the Premises as their primary residence without Landlord's written approval. 7. Parking & Access Rules for Guests If the property has parking or controlled access: Guests may only park in designated guest parking or areas approved by the Landlord. Tenants must ensure guests do not block driveways, fire lanes, or other restricted areas. Guests must follow all building or community rules, which Minnesota landlords may adopt under property rights and lease agreements. 8. Safety & Security Tenant is responsible for: Ensuring guests do not allow entry to unauthorized persons Not providing keys, fobs, or access codes to guests without Landlord's approval Maintaining safety in compliance with building rules and Minnesota housing standards 9. Violations Violation of this Addendum constitutes a breach of the Lease and may result in: Written warnings Fees for damages caused by tenants or guests (if not prohibited under Minn. Stat. 504B.120) Nonrenewal or termination following proper Minnesota notice and eviction procedures, including pre eviction notice requirements when applicable Landlord must enforce this policy uniformly and without discrimination. 10. No Retaliation Tenants may report guest-related safety concerns without fear of retaliation. Minnesota law prohibits retaliation against tenants exercising lawful rights. Move-In/Move-Out Inspection Addendum Minnesota requires landlords to provide certain inspection opportunities and documentation, including new rules on initial + final inspections.
