1) Rent is due the 1st of each month. A late fee of $50.00 will be paid by the TENANT and due to the LANDLORD if payment is not received after 5 calendar days from the due date. $50 will be charged to the TENANT for any returned rent check.
2) TENANT pays Electricity, Cable TV/Internet and telephone. A/C, Water, Sewer and Garbage Removal are included in the monthly rent as is access to and use of the condo amenities
3.) TENANT to pay a$350 non-refundable move-in fee, a $350 non-refundable move-out fee levied by the Condo Association;
4.) TENANT may not sublet the unit under any circumstances.
5.) TENANT will obtain Renter's Insurance with $500K of personal liability insurance and provide proof of policy to the LANDLORD.
6.) Smoking is not allowed on the premises.
7.) Lease may be extended upon mutual agreement between LANDLORD and TENANT. LANDLORD has authorization to list and market the condo for rent 45 days out from the term of the lease. TENANT will be given the right of first refusal. If TENANT is not going to continue their lease past the agreed upon lease term date, the LANDLORD will hire a realtor to show the property for rent to prospective tenants. The TENANT will be given 24 hours notice for all showings and will have the option to approve or decline showing requests.
8.) TENANT's Duty to Repair and Maintain: The TENANT shall make ordinary repairs, resulting from TENANT's use, at his own expense, including but not limited to, heating, plumbing and electric, and the like. LANDLORD shall be responsible for extraordinary repairs, including, but not limited to, structural repairs and repairs to the heating, plumbing and electric systems. TENANT shall allow reasonable access to the premises to LANDLORD's contractors. If TENANT fails to permit access to LANDLORD's contractors, TENANT shall indemnify and hold harmless the LANDLORD for the costs associated with the repair(s) and any incidental or consequential damages associated with the denial of access. TENANT shall be responsible for the cost of any repairs, replacements or maintenance if such is caused by, or is a result of, the
negligence, waste or misuse by TENANT or their guests or invitees. LANDLORD will pay for any appliance repair or replacement unless caused by or a result of the negligence, waste or misuse of TENANT, their guests or invitees. TENANT shall advise the LANDLORD in writing via email of any structural damages and or repairs that are required, within five (5) days of TENANT learning of said damage or item in need of repair. TENANT's failure to notify LANDLORD shall be deemed a material breach of this Lease. If TENANT fails to make the required repairs, LANDLORD has the right, but not the obligation, to make such repairs and charge TENANT the cost of the same as additional rent. TENANT shall only use licensed and insured contractors or repairmen to perform maintenance or make repairs at the premises. TENANT is authorized to contact the Property Manager for assistance with any urgent unit repair issues. Repair issues that are non-urgent should be directed to the owner for approval.
9.) Alterations by the TENANT: The TENANT shall not make any alterations, additions or
improvements to the house without the written consent of the LANDLORD. The kinds of
alterations, additions or improvements referred to are those which are of a more or less
permanent nature, such as new floors, partitions, wallpaper and paneling. If consent of the LANDLORD is given, then any or all of such alterations, additions or improvements, may, if the LANDLORD wishes, become the property of the LANDLORD at the end of the term of the lease. However, at LANDLORD's sole option, LANDLORD may require the TENANT to remove any or all of such alterations, additions or improvements at the end of the term of lease and restore the premises to the condition in which they were when the term of this lease began, solely at the expense of TENANT.
10.) Professional cleaning will be done at the end of the lease and may be deducted from the security deposit if the required cleaning beyond the normal move-out cleaning due to normal wear and tear.
11.) If TENANT fails to start the lease or breaks the lease before the lease term, the entire security deposit will be retained by the LANDLORD and the TENANT is legally obligated to fulfill their financial responsibility for the entire term of the lease. The rules and regulations of Sherman Plaza Condominium stipulate that once leased a unit is not re-rentable and cannot be
subletted at any time during the term of the executed lease. However, if a hardship is the cause of
the TENANT'S need to break the lease, the LANDLORD will apply, expediently, to the condo Board for a hardship exception. If the hardship exception is approved and the Board gives permission to the LANDLORD to be re-lease the property, the TENANT is responsible for all associated expenses with re-leasing the property (including real estate commissions, new resident fees) and is financially obligated to pay the monthly rent until a new tenant is in place and a new lease begins.
