OTHER THINGS TO NOTE: - This is a 2nd-floor apartment in a 2-family house (3 Stories). - You will have the entire 2nd-floor apartment for yourself. - There is 1 apartment above you and garage on first floor below you. - Smoking or vaping of any kind is not allowed indoors and is strictly enforced. This property has a minimum stay requirement of 31 nights, in accordance with local zoning regulations. No short-term stays accepted; Security deposit and 50% of 1st Months rent due at booking. Remaining first month rent is due 2 days before move in. All administrative task (which includes background check, credit check, and ID verification) and pre-booking fees must be completed in order to finalize booking. House Rules: 1. Trash & Recycling Please bring garbage and recycling bins to the curb the night of pickup after 7pm and return them to the inside of the garage, next to the side garage door on the left, once emptied. The pickup schedules are as follows: - Trash: Sunday Night & Wednesday Night - Recycling: Monday Night The schedule is also located inside the House Manual for your convenience with further details. 2. Absolutely No Smoking or Vaping This is a strict no-smoking property. Smoking, vaping, or marijuana use of any kind is prohibited indoors and outdoors, including within 25 feet of the property. This applies to both guests and visitors. A minimum $1,000 fee will be charged for any evidence of smoking inside the home, including but not limited to odor, ashes, burn marks, cigarette butts, or smoke residue. This fee covers the cost of professional remediation and any lost revenue due to guest complaints or listing deactivation. 3. Pets Guest to place a cover over the couch including armrests (Pet cover is provided Gray cover with non-slip back located in basket next to living room tv console). Dogs must always be on a leash when outside. Curb your dog and promptly pick up and dispose of waste. This includes the outside backyard space. Guests with cats must place a waterproof mat under the litter box to protect the floors. Please clean up any spills or messes promptly. 4. Check-Out Time Check-out is at 10:00 AM sharp. Our cleaners arrive shortly after, so please plan accordingly. Late check-outs may result in additional fees. 5. Excessive Cleaning Fees Guests agree to cover additional charges if the property is left excessively dirty or requires deep cleaning beyond standard turnover. Guests are also required to maintain a reasonable level of cleanliness and tidiness throughout the home and are expected to keep the property and all furnishings in good condition. Charges apply for stained or damaged sheets and towels. No moving or rearranging of furniture is allowed. 6. Utility Use Please help us conserve water and energy when possible. Be mindful of lights, heating/cooling, and faucet use. To ensure sustainable energy use, a monthly utility cap of $400 is applied to variable utilities (Electricity, gas, and water). Any usage exceeding this amount will be the responsibility of the guest. Copies of utility bills will be provided upon request for any overage charges. 7. Food in Bedrooms To maintain cleanliness and avoid pests, please keep all food in the kitchen and dining areas only. 8. Open Flames For fire safety, no candles, incense, or open flames are allowed anywhere in the home. 9. Glitter & Confetti Absolutely no glitter or confetti is allowed on the property. These items are difficult to clean and may result in additional cleaning charges. 10. Quiet Hours To ensure a peaceful environment for everyone, quiet hours are observed from 11:00 PM to 8:00 AM daily. During this time, please keep noise to a minimum, including music, television, conversation, and any activities that may disturb neighbors. 11. Parking Vehicle owners must read street parking signs and must not block driveways. The host is not liable for parking tickets or legal violations for street parking. Guests are assigned one (1) garage parking space. At no time should you park in any way to prevent a vehicle from exiting or entering the garage or obstruct the driveway in any manner. 12. Maintenance & Plumbing Guests are not to place into any drain lines of the Premises any non-approved substances, such as flushable wipes, cooking grease, sanitary napkins, food, diapers, children's toys or other similar object that may cause a stoppage. Flush toilet paper only. Guests will be held responsible for any plumbing system freeze-ups occasioned by Guest's negligence, with a charge of $300 for a plumber to snake the main line if clogged. 13. Security & Doors For the safety of all guests and the property, please ensure all exterior doors are always locked when entering or leaving the home, including the full closure of the garage door upon entering and leaving the home. Do not leave the garage door open or unattended. No security cameras on the property (to include Ring Doorbell) should be blocked, tampered with, or disconnected. No tampering or unplugging the WIFI equipment next to tv console. 14. The following is a template of the RENTAL AGREEMENT: This Rental Agreement is entered into on the date hereof, by and between ("Host") and ("Guest") for the property located in Union City, NJ and listed as ("Property"). 14.1 TERM: The term of the Rental Agreement shall begin on the arrival date of (date) and end on the departure date of (date) for (number of nights) . The property will be ready for occupancy no earlier than (4 PM) on the arrival date and must be vacated no later than (10 AM) on the departure date. The term of the Rental Agreement may be reduced or extended upon mutual consent, following payment of any additional fees agreed between the parties, and confirmed in writing by the Host. 14.2 RENT: The total rent is (amount) , payable at the time of booking. For stays longer than 1 month, payments are split into monthly installments. 14.3 LIMITED OCCUPANCY: Occupancy is limited to the number of guests specified on the booking: (Number of Guests). If the Host concludes that this policy has been breached, the Host reserves the right to expel the entire party with no refund. 14.4 NON-DISTURBANCE CLAUSE: The booking Guest and their guests shall not disturb, annoy, endanger (fireworks), or create inconvenience for neighbors nor use the premises for any unlawful purposes. You agree to keep outside noise to a minimum between the hours of 11:00 pm and 8:00 am. You and all other guests agree to abide by all applicable parking restrictions and limitations. 14.5 CARE OF PREMISES/DAMAGES: NO UNAUTHORIZED PETS ALLOWED. NO SMOKING PERMITTED IN HOUSE. Automatic eviction plus forfeit of any deposit and rent if violated. Guest agrees to pay the Host for any damages to furnishings or household items that occur as a result of Renter's occupancy. This will include payment of any additional cleaning charges over $100.00 incurred due to the Guest's occupancy. To prevent theft of, or damage to, the Guest's personal property and that of the Property, Guest agrees to close and lock doors and windows when not present at the Property, including upon check-out. Guest will be charged $100 per item for any lost, damaged, or stolen remotes; to include Garage door remote and In-motion motorized blind remote. 14.6 HOST'S RIGHTS: Guest agrees that if the conditions and limitations set forth herein are not met, Host shall have the right to cancel this agreement and may enter the Property, either by statutory proceedings or by force, to inspect the Property and ensure that Guest has vacated the Property. All monies paid by Guest shall be forfeited as liquidated damages. 14.7 INDEMNITY CLAUSE: Guest hereby agrees to Indemnify and hold the Host harmless from any and all claims, including those of third parties, arising out of or in any way related to Guest's use of Property or the items of personal property provided therein. Guest assumes all risk of injury or other losses relating to any recreational activities and will hold Host harmless with respect thereto. 14.8 NO SUBLETTING: Guest may not sublet or assign this Rental Agreement for all or any part of the premises without the prior written consent of the Host. 14.9 NO PERMANENT RESIDENCE: The Guest expressly waives any claims to tenant rights under applicable state or local law governing residential lease agreements. Therefore, the Guest is not a tenant under New Jersey landlord tenant laws and does not gain rights typically afforded to residential tenants, including but not limited to long term occupancy, notice periods, or eviction proceedings. If the Guest commits a material breach of this Agreement including, but not limited to: - Failure to pay agreed-upon amounts in full and on time; - Causing significant damage to the property or failing to maintain reasonable cleanliness and care; - Exceeding the permitted number of occupants or allowing unauthorized visitors; - Refusing to vacate the premises after notice from the Host; then the Host may: - Terminate this Rent Agreement immediately; - Provide or serve notice to vacate via written or digital delivery (including Airbnb messages, text messages, or email); - If the Guest remains unlawfully on the property after termination or expiration of this Rental Agreement, the Host may contact local law enforcement and request their removal on the grounds of criminal trespass or defiant trespass under New Jersey law (N.J.S.A. 2C:18 3), to the extent permitted by law. The Guest is advised that remaining on the property without authorization after the termination or expiration of this Rental Agreement may be treated as unlawful occupancy. Under N.J.S.A. 2C:18 3, a person commits criminal trespass or defiant trespass by "knowingly remaining in any place where notice against trespass is given by actual communication, posting, or other lawful means." Such conduct may be treated as criminal trespass or defiant trespass, which constitutes a petty disorderly persons offense in the State of New Jersey, potentially subject to fines and/or arrest. The Guest, including visitors of the Guest (both approved and unapproved by the Host) acknowledge and agree to these terms as a condition of their stay. 14.10 REPAIRS AND MAINTENANCE: The Property is rented with the Host's furniture and household furnishings. The Host shall not be responsible for providing additional furnishings or equipment not presently available in the Property. Guest will report any maintenance issues immediately to the Host. The Host will make every effort to repair and/or replace any equipment that is not working properly but cannot guarantee that all equipment is in good operating order at all times and no rate adjustments or refund will be made for equipment or appliance failures. 14.11 CANCELLATIONS: Guest may cancel at any time with 1 month's notice. The Host will return any refundable amount, if applicable, according to the reservation's cancellation policy. 14.12 SECURITY DEPOSIT: The Host will hold a $1000 security deposit through the Guest Portal, which will be required at time of booking, in addition too 50% of first month rent, and released 2 days after check-out (unless charges are incurred). The security deposit will be used to charge the Guest for breaking House Rules, excessive cleaning beyond standard turnover, broken furniture or appliances, or violating the non-smoking policy. 14.13 ADDITIONAL HOUSE RULES: - Trash: Please bring garbage and recycling bins to the curb the night of pickup after 7pm and return them to the inside of the garage, next to the side garage door on the left, once emptied. Additionally, Guest will properly dispose of waste when outside. - Pets - if applicable. Guest agrees to place covering on couch (including armrests) and place a waterproof mat on floor where pet(s) will be using the bathroom (or litterbox). Guest agrees to protect the furniture and floors from pet damage. Guests with cats must place a waterproof mat under the litterbox and provide scratching pad/post if the cat has claws. The cost to repair and/or replace furniture due to damage from the pet(s) will be deducted from the security deposit and may incur additional charges for damage. - Utility Use: Please help us conserve water and energy when possible. Guest shall notify Host of any plumbing leak or slow drainage within twenty-four (24) hours. Host shall use reasonable efforts to remedy the plumbing problem. Guest shall only use a plunger to attempt to fix a slow or stopped drain, and shall not pour chemical or other drain cleaners into any stopped or slow drains. Guests will be held responsible for any plumbing system freeze-ups occasioned by Guest's negligence, with a charge of $600 for a plumber to snake the main line if clogged. 14.15 PARKING: Guest will be provided 1 parking space. Unless written consent is provided by Host, no oversize or commercial vehicles are permitted on the Premises. If permission is granted, such vehicle(s) must be parked completely within the bounds of the assigned parking area. The driveway must remain completely clear at all times. Do not park in a way that blocks, hinders, or impedes the driveway in any manner. Direct access for vehicles to enter and exit the garage must be maintained 24/7. Any vehicle found obstructing the garage door or the flow of traffic will be subject to immediate towing at the owners expense. One (1) garage door opener remote is provided. 14.16 SECURITY AND DOORS: For the security of the property and your belongings, the garage door must be closed and secured immediately after every entry or exit. Do not leave the garage door open for extended periods while the vehicle is stationary. Additionally, all exterior doors, to include back and side garage entry doors must remain locked at all times, except during active use of the outdoor space. By signing this Rental Agreement, you acknowledge that you will comply with the terms of this agreement, and each party assumes the responsibility for the obligations set forth herein. Guest acknowledges receipt of the House Rules. Guest acknowledges that they have read, accept, and agree to the terms set forth.
