PROPOSED LEASE TERMS UNIT 1077 These terms are provided so prospective tenants can review the anticipated lease requirements before applying. The final lease agreement will identify the landlord, tenant, lease dates, and any authorized occupants. PREMISES The rental premises are identified as Unit 1077, including the areas accessed through doors 1075 and 1077 and the rear French doors leading to the parking lot ("Premises"). 1. LEASE TERM AND USE OF PREMISES The initial lease will be for a fixed term specified in the final lease agreement. After the initial term expires, the tenancy may continue on a month-to-month basis until terminated by either party with at least thirty (30) days' written notice. The Premises shall be used solely as a private residence by the Tenant and approved occupants. No commercial, unlawful, or hazardous activities shall be permitted on the property. No pets are permitted. No smoking or vaping is allowed anywhere on the Premises. 2. RENT, SECURITY DEPOSIT, AND PAYMENTS Monthly Rent: $2,400.00 To secure the lease, Tenant shall pay: First month's rent: $2,400.00 Security deposit: $2,400.00 Total due at signing: $4,800.00 Beginning with the second month, rent shall be due before the first day of each month. The security deposit will be held to secure Tenant's obligations under the lease and may be used for unpaid rent, damage beyond normal wear and tear, cleaning expenses, or other amounts owed upon termination of the tenancy. Landlord will provide a written statement of any deductions and refund the remaining balance within thirty (30) days after Tenant vacates, in accordance with Utah law. A portion of the security deposit, currently estimated at $425.00, will be applied toward the property's required move-out deep-cleaning service. Payments may be made by check, ACH, or another mutually agreed-upon payment method. LATE FEES AND RETURNED PAYMENTS If rent is not received by the third day of the month, Tenant shall pay a $42.00 late fee, plus $17.00 per day until the rent is paid. Returned checks or rejected payments shall incur a $35.00 fee, in addition to any applicable late fees. 3. OCCUPANTS AND GUESTS Only the Tenant, approved occupants, and reasonable guests of the Tenant may occupy the Premises. Any additional long-term occupants require prior written approval from the Landlord. Unauthorized occupants may constitute a material breach of the lease. Unless otherwise approved in writing, occupancy shall not exceed eight (8) total persons. Tenant and Tenant's guests may reasonably use the property amenities, subject to all property, resort, and HOA rules. 4. UTILITIES AND APPLIANCES The following utilities and services are included in the monthly rent and paid by the Landlord: Water Sewer Electricity Gas Trash and recycling Internet Cable or television service, if provided by the property Utilities and services are generally provided through the property or resort. Tenant agrees to use all utilities reasonably and responsibly. The following appliances are provided with the Premises: Refrigerator Garbage disposal Range Stovetop Dishwasher Microwave Coffee maker Landlord will ensure that the provided appliances are functional at move-in and will repair or replace appliances that fail through ordinary use. Tenant may be responsible for damage caused by misuse, negligence, or abuse. 5. MOVE-IN AND MOVE-OUT CLEANING MOVE-IN A deep cleaning of the unit will be performed by the property's cleaning staff before Tenant moves in and will be paid for by the Landlord. Tenant shall complete a move-in inspection and notify Landlord of any damage, cleanliness concerns, or maintenance issues within seventy-two (72) hours after taking possession. Failure to notify Landlord within seventy-two (72) hours may constitute acceptance of the Premises in its existing condition. MOVE-OUT When vacating the Premises, Tenant must: Remove all personal property Remove all trash Return all keys and access devices Provide a forwarding address Leave the Premises in reasonably clean condition, subject to normal wear and tear The property's required move-out deep cleaning will be performed by its designated cleaning staff. The applicable cleaning charge, currently estimated at $425.00, will be deducted from the security deposit. Additional cleaning, damage, trash removal, or property-removal expenses may also be deducted from the security deposit when permitted by law. 6. RENTER'S INSURANCE Tenant shall obtain and maintain renter's insurance for the entire duration of the tenancy at Tenant's expense. The policy must provide reasonable coverage for: Tenant's personal property Personal liability Losses resulting from theft, water damage, fire, or other covered events Landlord shall not be responsible for the loss, theft, or damage of Tenant's personal property, except as otherwise required by law.
