We will receive background checks, credit checks, etc. to ensure qualifications. TERM OF LEASE AGREEMENT: The rent of $1300 is due the first of each month and is the responsibility of the tenant. Security Deposit of $2,600 due prior to obtaining the keys. USE & OCCUPANCY OF PROPERTY: A. The only person(s) living in the Leased Premises are the names of the person(s) on the lease. B. Any change in occupancy will require written consent of the Landlord after receipt of new application and background/ credit checks, and may be subject to an adjustment in the amount of rent. C. The Tenant will use the Rented Premises only as a residence, not a business. 1. RENT: A. The amount of the Rent is $ 1,300.00 per month to be paid by the first of the month via money order, Zelle, Cash or certified check. A $10 per day late fee will be applied.. 2. SECURITY DEPOSIT: A. The Tenant(s) will pay to the Landlord a Security Deposit of $2,600. The condominium is received in clean and workable condition and must be returned in such condition at the end of rental term. B. Tenant agrees that this security deposit is intended to secure the faithful performance by the Tenant of all terms, covenants and conditions of this Lease Agreement including but not limited to the cost of damages beyond normal wear and tear, unreturned keys, uncleaned premises, unpaid rent and any other amount due and legally allowable under the terms of this Lease Agreement and in accordance with state and local laws and regulations. C. Tenant may be responsible for any unpaid charges or attorney fees, suffered by the Landlord by reason of Tenant's default of this Lease in accordance with state and local laws and regulations. D. Under no circumstance can the tenant use Security Deposit to be used as payment for rent and/or other charges due during the term of this Lease Agreement. E. Landlord's recovery of damages will not be limited to the amount of the Security Deposit. F. Tenant is responsible for renters insurance within 30 days of occupancy. G. A fee of $75 will be charged for all Tennant caused services in which the landlord attends to (ie., but not limited to, Lost keys, flooded toilets from, for example, tenant putting items in the toilet, broken bottles in garbage disposal, broken door handle, Tenent leaving water run, etc.). The Landlord is responsible for all natural and normal wear and tear. H. Tenant agrees to use a cutting board on the counter when cutting as not to damage the counter top. 3. ENDING THE LEASE: After a minimum of one year of residence, a 30 day notice (60 days preferred) must be received by the Landlord from the tenant prior to vacating premises. If the tenant breaks the lease, tenant is responsible for paying for the rent until the end of the lease. At the end of this Lease Agreement or any renewal thereof, Tenant must vacate and shall immediately and peacefully surrender and return to the Landlord the possession of the Leased Premises in broom-clean condition and in as good condition as when Tenant took possession. The Leased Premises shall be cleared out of all occupants, furniture, personal articles, and effects of any kind. A charge will be made for items left behind. 4. UTILITIES & SERVICES: A. B. Tenant is responsible for the following utilities and services: Electricity, (tv, internet, telephone if desired). Registered electric utility and services must be placed in Tenant's name. Tenant understands and agrees that essential service is to be maintained and operational at all times. I. Tenant agrees that Landlord will not be held responsible for the loss of use, or discontinuation or interruption of any utility or extra services beyond the Landlord's control. II. Tenant shall notify the Landlord of any malfunction of a utility. III. Tenant may not be negligent in his/her use of any included utility or service. 5. APPLIANCES: A. Appliances when receiving the unit, are in good working order. Any damage or nonworking appliance will become the full responsibility of the Tenant, either in the appliance repair or replacement. Any appliances purchased by the tenant become property of the tenant. B. Tenant must have approval before installing any appliance. Landlord accepts no responsibility for the maintenance, repair or upkeep of any appliance supplied by the Tenant. Tenant agrees he/she is responsible for any damage that occurs to the Leased Premises resulting from the addition of any appliance that is supplied by the Tenant. 6. CONDITION OF PROPERTY: A. The Tenant will enter the unit with all equipment and appliances to be in an acceptable condition and in good working order. B. The Tenant agrees to return the Leased Premises to Landlord at end of the Lease Agreement in the same condition it was at the beginning of the Lease Agreement. 7. PETS: Pets are not allowed. If the tenant chooses to have a pet, it is in violation of this contract and grounds for eviction. 8. RULES AND REGULATIONS: A. The Tenant may not interfere with the peaceful enjoyment of the neighbors. B. The tenant is responsible for ensuring safety for children by stairs, balcony, parking areas, sidewalks and any other location on the premises. C. Garbage/Trash must be taken to the dumpster and neatly deposited. (Not deposited down the garbage disposal which is available for light scraps when cleaning the sink.) D. The Tenant will be responsible for any fine and/or violation that is imposed on the Landlord due to the Tenant's negligence. E. The Tenant shall abide by all Federal, State, and Local laws. F. The Tenant shall notify the police and Landlord of any illegal activity that is witnessed in or around the Leased Premises. G. The Tenant agrees not to use the Leased Premises for any unlawful purpose including but not limited to the sale, use or possession of illegal drugs on or around the Leased Premises. H. The Tenant agrees to test smoke detector(s) periodically as well as maintain operational batteries at all times. I. The Tenant must report any malfunction with smoke detector(s) immediately to Landlord. The Tenant agrees not to remove, dismantle or take any action to interfere with the operation of any smoke detector(s) installed on the Leased Premises. J. Absolutely no hazardous materials are permitted to be in or around the Leased Premises at any time. K. The Tenant may not use or store Kerosene or space heaters at any time in or around the Leased Premises.(Grills must be used at least ten feet away from the building) L. Under no circumstance may a stove, oven or range be used as a source for heat. M. The Tenant shall use ventilating fans at all times when bathing and cooking to prevent mold.
