Resident agrees to pay owners equal monthly installments of $1,500.00 ("Total") including any Rent and Monthly Fees (Pet, Short Term and Risk). Rent will be collected by electronic debit or cashier's check/personal check/money order by the 1st day of each month for the current month (for example, February Rent will be collected by February 1st). Resident's failure to pay shall constitute a breach of this Agreement and subject Resident to the Remedies in Section 14 below. 2. Term. In exchange for the Rent and Resident's other promises in this Agreement, owner agrees to lease the Home to Resident beginning _________ and ending __________("Term"). 3. Late Fee. If Rent is not received on or before the 1st day of the month, preceding the month for which rent is to be paid, Resident will be assessed a late fee of $50.00 . There will also be a $35 NSF Fee each time ACH Automatic Withdrawal is denied or personal checks are returned. 4. Security Deposit. Resident shall supply a deposit of $1,250.00 ("Security Deposit"). Owner need not apply this Security Deposit to Rent or other charges in arrears. Owner may use Security Deposit for: (a) actual damages Resident causes to the Home; (b) past due Rent and Rent due for premature termination of this Agreement; and (c) unpaid utility bills. Resident will be liable for damages in excess of Security Deposit amount. At least 14 days prior to the termination of this lease or successor extensions of the lease, owner will conduct and provide the resident an initial list of items of actual damage that may result in withholding of security deposit and thereby provide resident with an opportunity to correct such damages. The Security Deposit will be held at: The Huntington National Bank, 450 E. Michigan Avenue, Saline, MI 48176 and backed by any applicable State laws regarding interest and days needed to inform you of our move-out inspection. 5. Lease Termination. If Resident wishes to terminate this Agreement before the end of the Term, a written 30 day Notice to Vacate (Section 15) is required and Resident shall pay a Lease Termination Fee equal to two months of Rent prior to vacating the Home. If Resident fails to pay this Lease Termination Fee, Resident shall remain liable for Rent and all other covenants contained in this Agreement until the expiration date of this lease. 6. Maintenance. Resident accepts responsibility for keeping the Home in good repair and sanitary condition. Owner will perform the specified routine maintenance and upkeep of the Home and pay costs associated with such including, but not limited to, lawn and landscape care, snow and ice removal and furnace filter replacement every three (3) months. Resident is responsible for basic cleaning, pest control, replacement of non-working light bulbs, and monthly inspection of fire extinguisher along with testing of smoke/carbon monoxide detector. If after notice of 10 days resident does not comply, owner will hire contractors to perform necessary maintenance at Resident's expense. 7. Right of Inspection. Resident agrees that the owner of the Home and their agents have the right to enter the Home at any time after providing 24-hour notice to Resident. 8. Lease Renewal. At least 60 days prior to the end of this Agreement, owner may offer residents renewal of this Agreement with reasonable changes. Resident must execute a Renewal Agreement within thirty (30) days of the end of the Agreement Term or be subject to Holdover Fee per Section 9 as described below. A lease renewal will not be automatically generated. All parties will need to sign a new Lease in order to activate a new term. The owners are not under any obligation to renew the lease agreement or offer additional time. Either party may reserve the right to non-renew any lease 30 days prior to Lease end date. 9. Holdover. If Resident remains in the Home after the end of the Term of this Agreement, without any notice given to owner, a $250 Holdover Fee will be added to the Rent that will be increased to Market Rate and paid monthly and shall be subject to all terms and conditions of this Agreement, until a new lease is signed. 10. Short Term. A monthly $50 Short Term Fee will be added to any lease less than 12 months on your first term. Other Short-Term options can be added to your lease renewal once your initial term was met. A Month to Month (MTM) lease, if approved by owner will be Market Rate plus a monthly $100 MTM Fee. A 6 Month lease will be at Market Rate plus a monthly $50 Short Term Fee. 11. Utilities. Resident shall be responsible for payment of utilities ("Utilities") listed below. Utilities shall be placed in Resident's name prior to possession of the Home. If any Utilities become past due for more than 60 days, owner will pay Utilities on behalf of Resident, and Resident will be charged the full past due amount to be paid in full with the next month's rent. Resident Responsibilities: * Gas *Electric *Water *Internet 12. As Is. It is agreed that Resident will accept the dwelling "as is," subject to any federal, state or local limitations. Resident shall complete a Move-In Checklist to document items in the Home. Resident shall be responsible for any items not noted on the Move-In Checklist. Move-In Checklist must be returned to owner within 7 days of move-in. If not, any prior damages or needed repairs, unknown to owner, shall be considered current Resident's responsibility. 13. Remedies. If Resident violates any federal, state or local law in connection with occupancy of the Home, or breaches any covenant in this Agreement, including but not limited to, payment of Rent, owner may exercise any right or remedy available under law. 14. Property Damage. Resident is responsible for the cost of any damages caused by Resident, Resident's household members and/or Resident's guests. 15. Use of the Home. Resident agrees that the Home shall be used exclusively as a private single- family dwelling. Any other use constitutes grounds for breach of this Agreement. No businesses of any kind may be run out of the Home. 16. Assignment and Subletting. Under no circumstances may Resident assign its interest in this Agreement. Resident agrees that only persons listed on the Lease occupy the Home. Resident understands and agrees that owner may assign its interest in this Agreement without prior consent from Resident. 17. Alterations. Resident shall not make any changes or additions to the Home without prior written consent from owner through a Cosmetic Change Form, which will be provided by your Property Manager. 18. Move-Out Responsibilities. Upon move-out, Resident agrees to leave the Home in good condition, subject to normal wear and tear, as determined by owner during final inspection while utilizing your Move-In checklist. The Home must be swept and vacuumed; all cabinets, drawers, closets and appliances must be empty and scrubbed clean; bathrooms (including toilets, sinks, showers, bathtubs, cabinets, floors) must be scrubbed clean. All Resident's furniture and belongings must be removed from the Home. Owner reserves the right to deduct from the Security Deposit any costs associated with, but not limited to, noncompliance with these Move-Out Responsibilities. 19. Notice to Vacate (NTV). Resident must provide a 30-Day NTV. If NTV is not given 30 days prior to lease end date, Resident will be responsible for the equivalent rent amount due during that 30-day notice period. Resident must also notify owner of new address within 4 days after move-out date. 20. Risk. Risk Fees will be applied to your monthly rent depending on your qualifications. If Approval Assessment is Conditional, an additional $25 Risk fee per month plus a 1 month Security Deposit shall be required. If Approval Assessment is denied, an additional $50 Risk fee per month plus a 2-month Security Deposit shall be required. Owner reserves the right to accept or deny any Conditional or Denied Applicant. 21. Pets. Resident agrees that no more than 2 pets or animals (under 40 lbs) shall be kept in the Home. If any unpermitted pet is on the property, Resident will be in breach of this lease, and in addition to all other rights of owner, Resident will pay a fee of $25.00 per day. 22. Smoking. Resident shall not smoke or allow any other person to smoke inside Home. If resident smokes, or allows Resident's guests to smoke inside the Home, Resident will be subject to a $1,000.00 cleaning fee. 23. Entire Agreement. No other agreements are part of this Agreement and this Agreement may only be changed with mutual consent of Resident and Owner. If a clause of this Agreement is found by a court to be invalid, such finding will not invalidate any other clause or provision of this Agreement. 24. Joint and Several Liability. Each Resident is jointly and severally liable for all covenants and obligations of this Agreement. 25. Prohibited Conduct. Resident and Resident's invitees, occupants, or guests may not engage in the following activities: behaving in a loud or obnoxious manner; disturbing or threatening the rights, comfort, health, safety, or convenience of others (including Home Owner or their agents and employees) in or near the Home and its community; disrupting owner's business operations; manufacturing, delivering, possessing with intent to deliver, or otherwise possessing a controlled substance or drug paraphernalia in or around the Premises; engaging in or threatening violence or any criminal activity; possessing a weapon prohibited by state law; discharging a firearm in the community; displaying or possessing a gun, knife, or other weapon in any common area; storing anything in closets having gas appliances; tampering with utilities or telecommunications; bringing hazardous materials into the Home; or injuring owner's reputation by making bad faith allegations against owner to others. Resident is responsible for the conduct of Resident's invitees, occupants, and guests. Neither Resident nor any people occupying or visiting the Home shall have been convicted of a crime relating to illegal sexual conduct nor shall be a registered sex offender in any state. 26. Surrender of Premises and Return of Possession. At the termination or expiration of this Lease, Resident shall yield up and surrender immediate possession of the Home to owner and deliver all keys to owner. If Resident fails to vacate the Home when this Lease expires, then: a. If owner files an eviction lawsuit based on Resident's failure to vacate the Premises, Resident shall pay owner a sum equal to double the amount of rent then in effect as liquidated damages as use and occupancy for the time that possession is withheld; or b. If owner does not file an eviction lawsuit, Resident shall become a month-to-month tenant on the same terms and conditions contained in this Lease, except that the monthly rent shall increase $250 per month over the rent then in effect. 27. Insurance. Owner is not an insurer of Resident's property. Resident, although not required, is strongly encouraged to obtain renter's insurance to insure all of Resident's personal property located at the Home. Owner does not maintain insurance to cover Resident's personal property or personal injury. Owner is not responsible to any resident, guest, or occupant for damage or loss of personal property or personal injury from (including but not limited to) fire, smoke, rain, flood, water and pipe leaks, hail, ice, snow, lightning, wind, explosions, earthquake, interruption of utilities, theft, hurricane, negligence of other residents, occupants, or invited/ uninvited guests or vandalism unless otherwise required by law. 28. Security of Premises. Resident shall always leave the Home locked and secure. Owner is not liable for any theft or damage to Resident's property or the Home resulting from Resident's failure to lock or otherwise secure the premises. Resident understands that Ring doorbell cameras have been installed and Resident has option to use those devices. 29. Crime and Drug Free Housing. Resident(s), its household members, invitees, guests, and family members shall not engage in any illegal or criminal activity on or about the Home. The phrase, "illegal or criminal activity" shall include, but is not limited to, the following: (1) engaging in any act intended to facilitate any type of criminal activity; (2) permitting the Premises to be used for, or facilitating, any type of criminal activity or drug related activity, regardless of whether the individual engaging in such activity is a member of the household, or a guest; (3) the unlawful manufacturing, selling, using, storing, keeping, purchasing, possessing, or giving of an illegal or controlled substance; (4) violation of any federal drug laws governing the use, possession, sale, manufacturing, and distribution of marijuana, regardless of state or local laws (so long as the use, possession, sale, manufacturing and distribution of marijuana remains a violation of federal law, violation of any such federal law shall constitute a material violation of this rental agreement); (5) engaging in, or allowing, any behavior that is associated with drug activity, including but not having excessive vehicle or foot traffic to the Home; (6) any breach of this Lease that otherwise jeopardizes the health, safety, or welfare of owner or other residents; (7) engaging in any activity that constitutes waste, nuisance, or unlawful use. owner, using their own judgment, may determine if a violation of this paragraph has occurred. Owner need not show that Resident or any other covered person was arrested or convicted for the criminal activity-giving rise to termination of this Lease. Owner need only show whether it was more probably true than not true that Resident(s) or its invitee, guest, household member, or family member violated this paragraph of the Lease. 30. Rules and Regulations. Resident agrees to be bound by and comply with any reasonable rules and regulations established by owner. Such rules or regulations shall take effect 30 days after owner provides notice of the rule or regulation to Resident and shall constitute a part of this Lease. If Resident thereafter violates or fails to comply with the rule or regulation, owner may terminate this Lease as it may for any other default under this Lease. a. No more than 2 dogs or cats, under 40 lbs and no other animals may be kept or allowed in the premises. b. No additional locks or other similar devices may be attached to any door without owner's written consent. Resident shall not change a lock or latching device on any door or window of the Premises. c. Resident shall not install or operate any machinery, refrigeration, or heating devices or use or permit into the Home any flammable fluids or materials that may be hazardous to life or property. d. Hallways, stairways, and common areas shall not be obstructed or used for any purpose other than ingress and egress from the building. Resident shall not permit any clutter or personal property to obstruct any common area. e. Resident shall not leave food cooking on the premises unattended. f. Washrooms shall not be used for any purpose other than that, for which they are designed, and no rubbish, rags, or injurious items shall be placed in plumbing facilities or receptacles. g. Resident shall not place nor permit any article or antenna outside of the windows, on the exterior walls or on the roof of the building and shall not throw or drop any item from any window. h. Resident shall not place, erect, or install any signs or advertisements on the windows nor on any part of the building or premises. I. Waterbeds are not permitted in the Home without BLD's prior written consent. j. Resident shall not interfere in any manner with the heating system, lighting fixtures, or any other fixtures in the building nor run extension cords or electrical appliances in violation of the local building code. k. Resident shall not solicit, canvass, or conduct any door-to-door activities on the premises. l. Owner has the right to bar individuals from the Home and property generally. Resident must inform its guests of all requirements under this Lease. If any provision of this Lease is violated by Resident's guests, household members, or any other person at the Home at Resident's invitation or the invitation of any other person who resides in the Home, Owner may bar the individual from the Home, have them arrested for criminal trespass, and terminate this Lease. m. The building, property, and Home is a smoke-free area. There shall be no smoking of any kind in the Home or anywhere on the property. n. You must notify owner in writing within 4 days after you move of a forwarding address where you can be reached and where you will receive mail; otherwise, your landlord shall be relieved of sending you an itemized list of damages and the penalties adherent to that failure.
