Tenant pays electric on a monthly basis along along with rent on the first of every month. Trash, water, and 1 gig Google Fiber internet included. No smoking of any kind allowed. First and last month's rent due at signing, as well as, damage deposit. Flexible move in dates. Minimum of a twelve month lease agreement. In the event tenant fails to pay rent when due, or if any rent check is returned unpaid by the bank, Tenant shall pay a late charge of 6.5% of the monthly rent ($150.00). This will be charged as additional rent. This late charge will be imposed on the tenant if the rent is not received by the 7 th day of the month before 5:00PM. If rent is still overdue by the 10 th of the month, the Eviction Process will commence and a "Demand for Compliance or Right to Possession Notice" will be served immediately. Late charges are due immediately; however, the Landlord has the option to deduct late charges from the security deposit if Tenant fails to pay rent and fees due. Tenants agree to promptly pay the monthly rental installments, without deductions, and to abide by all other terms, covenants, and conditions of this lease. No more than 2 occupants or immediate family (i.e., children of the Tenants) shall occupy the premises. Tenants agree to use the premises for residential purposes only. Tenants understand and agree that these limitations on occupancy and use of the leased premises are a material inducement for the granting of this lease by Landlord to the Tenants. Tenants shall not alter or make additions to the premises, its painting, or its fixtures and appliances without the Landlord's written consent. Tenant agrees not to do or permit any act or practices injurious to the premises, which may affect the insurance risk factor or insurability of the premises, or which may be otherwise prohibited by law. Tenants promise and agree not to transfer or assign this lease, nor sublet the leased premises or any portion thereof, without the prior written consent of the Landlord. Any such assignment without the proper written consent of the Landlord shall be void. In the event such consent is given, any assignee or subleasee must agree in writing that the premises will be returned to the Landlord in the same condition as at the commencement of this lease, normal wear and tear accepted, and that certain charges may have already been applied to the Security Deposit. Tenants agree to look only to the assignee or subleasee for reimbursement of the Security Deposit prior to the termination of this Lease. Tenants and assignee or subleasee agree that their liability under this Lease shall be joint and several. Up to 1 dog permitted in premise. Must be well trained and have no behavioral or noise issues. There will be no smoking permitted in any area of the leased premises. The term "smoking" means inhaling, exhaling, burning or carrying any lighted cigar, cigarette (electronic or otherwise), any tobacco or marijuana product in any manner, or in any form. Growing of cannabis, marijuana or any other drug is also prohibited. Due to the increased risk of fire and the known adverse health effects of secondhand smoke, smoking is prohibited in any area of the property, both private and common, whether enclosed or outdoors. This policy applies to all tenants, guests, employees, and service persons. Tenants shall provide Landlord written notice of any defects in the leased premises within five (5) days of taking occupancy. In the event Tenants fails to so notify the Landlord, Tenants shall be deemed to have accepted the leased premises in their present condition, waiving all claims for defects or otherwise. Tenants also have examined all appliances and furnishings in the leased premises. Tenants agree at the termination of the Lease to return the leased premises, furnishings and appliances to Landlord in the same condition, normal wear and tear excepted. Tenants agree to keep the leased premises, the improvements thereon, all fixtures and appliances in good repair at the expense of Tenants. Tenants hereby promise and agree that Tenants will not cause or permit any neglect or deliberate misuse of the premises, appliances or furnishings therein provided by the Landlord. In the event of any misuse of appliances or furnishings therein provided by the Landlord, Tenants agree to bear the expense of the repair and any and all damage resulting therefrom. Additionally, if Tenants fail to thoroughly clean the premises, the Landlord, or their agents will perform the final cleaning, if not satisfactorily performed by Tenants. In Landlord's sole determination, this shall be deducted from Tenant's Security Deposit at the rate of $50.00 per hour for labor, plus costs of supplies. When tenants vacate the premises, it is expected the house will be in similar condition as it was received bearing minor wear and tear. Should items of any kind be left behind, the Landlord or their agents will dispose of items and/or hire contractors as needed. In Landlord's sole determination, this shall be deducted from Tenant's Security Deposit at the rate of $75.00 per hour for labor, plus costs of supplies/contractors.
