Parties: The parties to this agreement are ___________________, herein after called "Landlord," _______________________________________________ hereinafter called "Responsible parties" or "Tenants". 2. Property: Landlord hereby leases the following property to responsible parties for the term of this Agreement: (a) the real property known as: 3121 Hood Ave. G205 Kennewick, WA 99336 and (b) the following furniture and appliances on said property: - REFRIGERATOR, DISHWASHER, STOVE, WASHER/DRYER. 3. Term: -The minimum Lease shall be for 12 months beginning on ________ until ________ and shall continue month to month without notice beginning on: __________. 4. Rent and Late Charges: The monthly rental for said property shall be One Thousand Six Hundred Twenty-Five Dollars and Zero Cents ($1625.00) due and payable on the first day of each month AND will be considered late after the 5rd day of each month in which a $100 late fee will be added to the payment. Additional late fees will be charged at the rate of $100 every 5 days late. Last months rent due with first months rent. A $500 damage deposit due with first and last months rent also, which will be returned two weeks upon vacating the property as long as the property didn't suffer extensive damage beyond normal wear and tear. a.IN THE EVENT OF FAILURE TO PAY: 10 days late will result in eviction notice. If landlord brings any action or suit for recovery of possession of said premises, tenant shall pay to the landlord attorney's fees and costs as the courts shall determine to be reasonable. Any failure by tenant to pay rent or other charges promptly when due, or failure to comply with any other terms or conditions thereof, shall at option of landlord forthwith terminate this tenancy. 5. Utilities: Responsible parties agrees to pay for the following services, and is included with the $225/mo HOA fee: Garbage collection, Irrigation, Water, and Sewer services. TV/phone/internet (changes to TV/phone wiring will need to be approved by the landlord.), and Electrical Utilities will be paid by tenant. 6. Deposits: Responsible parties will pay the following deposits and/ or fees One Thousand Two Hundred Fifty Dollars and Zero Cents ($1250.00) This amount will be refunded within two weeks following the termination of the tenancy; final utility bills must be paid before deposit refund is issued. Unpaid rent, charges for damages beyond normal wear and tear, and costs for reasonable cleaning may be deducted. A $100.00 fee will be deducted from the deposit and kept for the carpet cleaning. If a pet has left odors/stains the fee may change depending on the cost to clean or replace damage caused (Pets are not allowed). Deposits will not be refunded if the lease is broken unless agreed upon by the landlord. In addition it is agreed: 7. Responsible parties shall not lease, sublease or assign the premises without the prior written consent of the Landlord (but this consent shall not be with held unreasonably). 8. Landlord may enter the premises at reasonable times for the purpose of inspection, maintenance or repair, and to show the premises to buyers or prospective Responsible parties. In all instances, except those of emergency or abandonment, the Landlord shall give Responsible parties reasonable notice (at least 24 hours) prior to such an entry. 9. Responsible parties agree to occupy the premises and shall keep the same in good condition, reasonable wear and tear expected, and shall not make any alterations thereon without the written consent of the Landlord. 10. Landlord agrees to maintain regularly the building orderly and neat manner. Landlord further agrees upon notice by Responsible parties to complete within a reasonable time all necessary repairs, including those of appliances and utilities, which are furnished with the premises. 11. Lawn care and rock area including watering, trimming, and weeding of lawn will be done by the HOA hired contractors, and is included with the $225 HOA fee. 12. Responsible parties shall, upon termination of this agreement, vacate and return dwelling in the same condition that it was received, less reasonable wear and tear, and other damages beyond the Responsible parties' control. 13. In a dispute between Landlord and Responsible parties which gives rise to any action in court, the losing Party will pay the court costs and reasonable attorney fees of the successful party. 14. Additional Terms: To avoid additional rent Responsible parties shall provide a 45 day written and signed notice when moving from the property. Property shall be kept in a clean presentable condition to allow for prospective tenants .Failure to move out and turn the keys in by the date on the written notice may result in an additional monthly rental fee charged 15. Pets: No Pets Allowed per HOA rules. Injuries. Residents shall be strictly liable for the entire amount of any injury to any person or property caused by a Pet, and shall indemnify Landlord for all costs of litigation and attorney's fees resulting From same. 16. Responsible parties right to buy: In the event the owner shall decide to sell the house the Tenant/responsible party will have the option to buy the property before it is offered for sale to another party. 17. All tenants who reside in the property are responsible for the above terms and agreements set forth in this contract. 18. Cancellation Clause: After a minimum of two months the landlord without notice gives the binding party in agreement the right to cancel this contract by making a penalty payment of $1475.00 and providing the standard 30 day notice of intent to vacate to the landlord. The penalty is separate from and will not count toward monthly rent. The notice to cancel/vacate cannot be submitted without the penalty payment if less than 10 months from the beginning date on the contract has not passed. 19. THERE IS NO SMOKING ALLOWED IN THE HOUSE. 20. The pre filter to the HVAC intake shall be cleaned every two months by the tenant. 21. During freezing weather heat must be kept at a reasonable level to prevent freezing at all times during the winter. 22. No illegal activities are allowed on the property. Violation of this cause will result in the landlord's option to evict the responsible party. 23. Severability clause: if one part of the contract is declared to be void the rest of the contract will remain unaffected. 24. Indemnification: Landlord shall not be liable and tenant hereby waives all claims against landlord for any damage to any property or any injury to any person in or about the Premises by or from any cause whatsoever, except to the extent caused by or arising from the gross negligence or willful misconduct of landlord or its agents, employees or contractors. Tenant shall protect, indemnify and hold the landlord entities harmless from and against any and all loss, claims, liability or costs (including court costs and attorney's fees) incurred by reason of (a) any damage to any property or any injury to any person occurring in, on or about the Premises to the extent that such injury or damage shall be caused by or arise from any actual or alleged act, neglect, fault, or omission by or of tenant, its agents, servants, employees, invitees, or visitors to meet any standards imposed by any duty with respect to the injury or damage; (b) the conduct or management of any work or thing whatsoever done by the tenant in or about the Premises or from transactions of the tenant concerning the Premises; (c) tenant's failure to comply with any and all governmental laws, ordinances and regulations applicable to the condition or use of the Premises or its occupancy; or (d)any breach or default on the part of tenant in the performance of any covenant or agreement on the part of the tenant to be performed pursuant to this Lease. The provisions of this Article shall survive the termination of this Lease with respect to any claims or liability accruing prior to such termination. 25. Hazardous Materials: Neither tenant, nor any of tenant's agents, contractors, employees, licensees or invitees shall at any time handle, use, manufacture, store or dispose of in or about the Premises or the Shopping Center any flammables, explosives, radioactive materials, hazardous wastes or materials, toxic wastes or materials, or other similar substances, petroleum products or derivatives or any substance (collectively "Hazardous Materials") subject to regulation by or under any federal, state and local laws and ordinances relating to the protection of the environment or the keeping, use or disposition of environmentally hazardous materials, substances, or wastes, presently in effect or hereafter adopted, all amendments to any of them, and all rules and regulations issued pursuant to any of such laws or ordinances (collectively "Environmental Laws"). Tenant shall protect, defend, indemnify and hold landlord harmless from and against any and all loss, claims, liability or costs (including court costs and attorney's fees) incurred by reason of any actual or asserted failure of tenant to fully comply with all applicable Environmental Laws, or the presence, handling, use or disposition in or from the Premises of any Hazardous Materials, or by reason of any actual or asserted Failures of tenant to keep, observe, or perform any provision of this paragraph. Notwithstanding the foregoing, and subject to landlord's prior consent, tenant may handle, store, use or dispose of products containing small quantities of Hazardous Materials (such as aerosol cans containing insecticides, toner for copiers, paints, paint remover and the like) to the extent customary and necessary for the use of the Premises for general Household purposes; provided that tenant shall always handle, store, use, and dispose of any such Hazardous Materials in a safe and lawful manner and never allow such Hazardous Materials to contaminate the Premises, Building and appurtenant land or the environment. 26. Tenant shall be responsible for the cleaning or repair to any plumbing fixture where a stoppage has occurred due to misuse of plumbing fixtures and drains. TENANT shall also be responsible for repair or replacement of the garbage disposal where the cause has been a result of bones, grease, pits, or any other item which normally causes blockage of the mechanism including any other misuse of the garbage disposal. 27. ALTERATIONS: TENANT shall not make any alterations to the premises, including but not limited to installing aerials, lighting fixtures, dishwashers, or other items without first obtaining written permission from LANDLORD. TENANT shall not change or install locks, paint, or wallpaper said premises without LANDLORD'S prior written consent; TENANT shall not drill, hammer, or attach anything to the stucco exterior of the house. Renters Insurance TENANT will maintain a personal property(renters, tenants) insurance coverage to cover any losses sustained to TENANT'S personal property, vehicle, or accidents resulting from damage or loss caused by fire, theft, rain, water overflow/leakage, acts of GOD, and/or any other causes. Insurance must include liability insurance that does not exclude canine-inflicted injuries or injuries from other animals tenant may own. At least $250,000 liability insurance will be required if pets are on the property. It is acknowledged that LANDLORD does not maintain this insurance to cover personal property. It is acknowledged that LANDLORD is not liable for these occurrences. It is acknowledged that TENANT'S insurance policy shall solely indemnify TENANT for any losses sustained. TENANT'S failure to maintain said policy shall be a complete waiver of TENANT'S right to seek damages against LANDLORD for the above stated losses. The parties acknowledge that the premises are not to be considered a security building which would hold LANDLORD to a higher degree of care. 28. All renters/tenants must read and abide by the IVY Club's By-laws, House Rules, and Enabling Declaration, which will be presented by the owner, and signed by both parties. Fines related to violations of these written documents incurred by the tenant will be the responsibility of the tenant.
