Rent Payment Terms - Monthly rent is due on the 1st day of each month. - Rent shall be paid via the approved payment method in Zillow Rental Manager or as otherwise agreed in writing. - Any rent not received by 5th day may incur a late fee of $150, in compliance with California law. 2. Security Deposit - Tenant has paid a security deposit of one month's rent. - Deposit will be returned within 21 days after move-out, less lawful deductions for: a) unpaid rent b) cleaning beyond normal wear and tear c) repairs for damages beyond normal wear and tear 3. Utilities - Landlord will cover: Water - Tenant is responsible for: Electricity and waste management - Tenant must transfer applicable utility accounts into their name within 5 7 days of lease start and maintain continuous service. 4. Renters Insurance (Required) - Tenant shall maintain renters insurance throughout the lease term with: minimum $100,000 liability coverage (recommended $300,000) - Proof of insurance must be provided prior to move-in and upon request. 5. Property Inspections - Landlord may conduct up to two (2) inspections per year. - Inspections will be scheduled with at least 24 hours' written notice, in accordance with California law. 6. Maintenance & Care of Property - Tenant agrees to: a) Maintain the premises in a clean and sanitary condition b) Promptly report maintenance issues c) Use appliances and fixtures in a reasonable manner d) Follow general manufacturer-recommended care for appliances 7. Yard & Outdoor Maintenance - Tenant is responsible for basic upkeep of existing plants and trees, including watering and general care. - Tenant may use designated open areas for personal planting, provided: - no permanent alterations are made without written approval - all modifications are reversible 8. Alterations & Wall Modifications - Tenant shall not make material alterations (including painting, drilling large holes, or installations) without prior written consent from Landlord. - Any approved or unapproved modifications must be restored to original condition at move-out, unless otherwise agreed in writing. 9. Smart Home Devices - The property includes smart devices (e.g., Nest thermostat and doorbell), which remain property of the Landlord. - Tenant may use these devices during tenancy but: a) must not tamper with or damage them b) must remove personal accounts and restore access to Landlord at move-out 10. Repairs & Damage - Tenant is responsible for damages caused by negligence, misuse, or failure to report issues in a timely manner. - Landlord remains responsible for major repairs as required under California law. 11. Move-In / Move-Out Condition - A move-in condition checklist will be completed and signed by both parties. - Tenant is encouraged to document the condition with photos/videos at move-in. - Property must be returned in substantially the same condition, excluding normal wear and tear. 12. Smoking Policy - Smoking of any kind (including tobacco, cannabis, vaping, or similar products) is strictly prohibited inside the property. - Smoking is only permitted outside the home in designated parking lot or outdoor areas, and must not create nuisance, odor intrusion, or damage to the property. - Tenant is responsible for proper disposal of smoking materials. 13. Early Termination - Tenant must provide [30 or 60 days] written notice for early termination. - Early termination may be subject to a fee of 2 month's rent, unless otherwise required by law or mutually agreed in writing. 14. Smoke & Carbon Monoxide Detectors - The property is equipped with required smoke and carbon monoxide detectors. - Tenant shall: a) not tamper with, disable, or remove detectors b) promptly notify Landlord if any device is not functioning 15. Attorney's Fees - In any legal action or proceeding arising out of this lease, the prevailing party shall be entitled to recover reasonable attorney's fees and costs, to the extent permitted by California law. 16. Compliance with Laws - Tenant agrees to comply with all applicable local, state, and federal laws, including occupancy and use regulations.
